Reed B. Johnson -Appeal of a Denial of a Certificate of Merger- confirmation of an August 2, 2005, motion of
intent to uphold the appeal and approve the Certificate of merger for a project to reconfigure 2 two parcels into
5.13 acres each, on property located on the northwest corner of Larkin Road and Johnson Clan Avenue in the
Gridley area, and identified as AP 024-200-067 and 068.
ACTION REQUESTED:
Uphold the appeal of the denial to the Reed B. Johnson Merger application, AP 024-200-067 & 068, finding that:
A. Due to existing development, the proposed 5.1 acre parcels will provide less conflict with
agricultural practices (300-f6ot setback) due to the reduction in actual agricultural buffer
area from each residential dwelling on the 5.1 acre parcels compared to the existing 1.0 acre
and 9.2 acre parcels.
B. Would make agricultural more viable on both properties and reduce any health risks.
C. That agricultural use will be better served by two 5.1 acre intensively farmed parcels than
with a 1.0 acre and 9.2 acre parcels.
D. That 5 acre parcels may be found conditionally consistent with the General Plan
Designation of Orchard and Field Crops.

The Board of Supervisors made a Motion of Intent to uphold the appeal of the
Johnson Merger (MER 04-01) based on the new Lot Line Adjustment/Merger
Ordinance (Ord. No. 3877). Under the ordinance, a Merger (Lot Line
Adjustment) can be approved if one of three options can be satisfied. The Merger
appeal was upheld on the basis that the resulting parcels will improve the design.
The findings for upholding the appeal are listed below.
Uphold the Appeal for the Johnson Merger (MER 04-01), subject to the following
findings:
A. Due to existing development, the proposed 5.1 acre parcels will provide less
conflict with agricultural practices (300 -foot setback) due to the reduction in
actual agricultural buffer area from each residential dwelling on the 5.1 acre
parcels compared to the existing 1.0 acre and 9.2 acre parcels.
B. Would make agricultural more viable on both properties and reduce any

In regards to your letter of November 16, 1982, and to the above
original building permit. I applied.for and received the permit; during
the repairs, I even received a correction notice. The corrections were ;

approximately 10 or 11 months ago, the,project was completed and
a person is living in the house: Therefore, we are not in need of
