ZYMIRONMENTAL SETTING
The proposed project site is a relatively flat area which may be
prone to periodic flooding if large areas are overcovered by
InVervious su faces. Disruption, displacement, compaction, and
overcovering 'of the soil is considered to be relatively minor due to
.the relatively flat terrain of the project site and minimu amounts
of earthwork necessary for the proposed development. No change in
topography or gound surface relieffeatures will be necessary or
extensive earthwork required to accommodate the proposed structure_.
Soils in the surrounding area have generally been considered
agriculturally productive soils. The project site has not been
utilized in a number of years in an agriclUtural capacity. No loss
of prime agriculturally productive soils outside designated urban
areas is anticipated to occur as a result. sof the proposed project.
All of Butte County Is within a ,Moderate tarthcluake Intensity Zone
"VIII,. The project site is located off of Htunble Avenue. Humble
.Avenue is to be upgraded in the near future 1-.;y Gridley Assembly of

260-052,
DATE: September 3, 1991
This is a. proposal to subdivide 6.5 +/ acres to create four parcels: three parcels at 1
acre each and one parcel at 3.33 acres. The present zoning is SR -1. The Land Use
Plan Map of the Butte County General Plan designates this area as Low Density
Residential.
The proposal does not meet the requirements of the Gridley Urban Reserve General
Plan Policies as currently proposed. The Butte County General Plan requires all projects
within the Gridley Urban Reserve be coordinated with the City of Gridley. The City of
Gridley has stated "This property lies within the Sphere of Influence for the City, of
Gridley, and has been prezoned AR -5 wit?t minimum parcel size of S acres. The
proposed subdivision is inconsistent with that zoning. It is difficult to provide cost
effective 'urban services to one acre parcels
The Initial Study conducted on the proposed Tentative Parcel Map identified the
following areas of concern: Extension of "Water and Sewer lines; Transportation
/Circulation; Public Services; and Cultural )Resources. The Urban Reserve Policies
requires the extension of the City of Gridley `)Vater and Sewer Systems. Extension of
the water and sewer mains would be considered growth inducing and will require an. EIR
under the California Environmental Quality Act. The project site is also located directly
on the centerline of the proposed State Highway 99 bypass; Some 250' of this 280' deep
property, lies 'within the State Highway 90 alignment adopted by the California
Transportation 'Commission. The California. Streets and Highway Code Section 75.9
requires the County to include in its General Plan any route alignment adopted by the
California Transportation Commission; In additior;, Caltrans and the California
Transportatiort Commission, require assistance in protecting the route through zoning the
corridor for non -conflicting uses such as open space or agriculture. The Urban Reserve
also requires the project be coordinated with these plans. The prof ect will also
cumulatively impact public services. Finally, the protect s'te was identified as an area
of high sensitivity fo;r archaeological resources and as such requires an archaeological
records search and possibly a survey. The applicant has not provided adequate mitigation
measures for the above concerns not agreed to conduct an Environmental, Impact Report
to address environthdrital issues of concern.

�. Caltrans has recently become aware that the adopted State Route 99 alignment
from Horth of Lomo Crossing in Sutter County to neat- State Route 162 (east)
in, Butte County (Live Oak/Gridley Bypass) has been deleted frOm the Butte
and Sutter County General Plans. While the adopted alignment has remained
unconstructed for many year.., the statutory requirement for an adopted route
to be included in the General Plan remains in effect; Streets & Highways Code
7S.9.
Caltrans over the next three months will be reevaluating the adopted
corridor's viability as a future State highway: Based on the findings of the
study, a decision will be made by Caltrans on whether to proceed with a
formal action to 1-ecommend rescission of the route adoption to the
Califbrnia Transportation Cormn ssion or whether to affirm the eXisting route
adoption and work with local agencies to protect the corridor fromdevelopment.

State Route 99
Live Oak/Gridley Bypass
Background
The State Route. 99 alignment bypassing Live Oak and Gridley (map attached)
was adopted by the California Highway Commission (now the California
Transportation Commission) in 1963. The adopted freeway alignment is
actually part of a larger adoptedfreeway corridor beginning ,at Oswald Road
in Sutter County and continuing north to the junction of Aoute 149 in Butte
County. Portions of the Route were constructed over the years to expressway
standards (thru 'tuba City) and other parts to full freeway (From Route 20 to
Lomo Crossing). Other segments remain unconstructed due o state highway ,
financial constraints.
While the State Routes 99/70 Corridor Study recommends a Route 70 freeway for
initial construction, the Study did not 'negate the issue cf the adopted
alignmort on State Route 99 bypassing Live Oak and Gridley. The Study put
forward a local, Regional, and Caltrans agreed upon concept for the
Sacramento to Chico corridor to expedite programming of state highway
dollars With self help in the Sutter/Yuba area. The Study recommendation
includes continuation of a 99 expressway to ,Live Oak.
Continuation of the expressway to 'Live Oak will require, under California and
Federal Environmental Laws, analysis of other alignments, Constructionon
the existing highway (by adding two lanes and taking access) is doubtful
though can't be ruled out. The adopted freeway alignment will be considered
with other alternative alignments for construction of the expressway,
Route Adoption and Gener 1 Flan
California Statutes, Streets and Highways C;&i 75.9, requires a City or
County to include in its General Plan any route alignment adopted by the
California Transportation Commission. There is no law alloiWing a City/County
to remove the Route unless the Route Adoption is formally r►5scinded by the
California Transportation Commission.

Caltrans reviews Routes that have been adopted by the CTC th`,at have remained
unconstructed to determine their continued viability as a ful"Wre state
transportation corridor. Key factors looked at in this revi6w are:
1) Future need for the Route;

In response to your interdepartmental review request, I have reviewed the
proposed parcel map, and offer the following comments:
1. As you noted, the property is located directly on the centerline of the
proposed Highway 99 bypass,. If Caltrans does not ,abandon this proposed
route, the map should not be approved.
2. According to the toporgraphic information obtained for the 1980 Master
Drainage Study, the levees alongIrrigation Lateral No.. 6 are
approximately 3 feet above the adjoining land. The Master Drainage
Study indicated that the property drains southeasterly to a drainage
lateral of Drainage District No. 1; located approximately 600 feet east
of Humble (Davis?) Avenue. I question whether or not it is practical
to drain the property into the irrigatioia lateral, evert if the water
district changes their policy to allow it

Water District will request a 50 -foot setback for building foundations
