Sept.18, 1998 This letter is to confirm our phone conversation of a week ago regarding the swimming pool at 9 Stimpson Road, Oroville. As I told you then, the pool was installed by a licensed contractor in about 1977. Because it was installed by a licensed contractor, we naturally assumed that all permits and inspections were done as required. However, about six years later in 1983, the county contacted us to say that no permits had ever been obtained for our swimming pool. Needless to say, we were quite surprised and unsure as to what to do. We were told by the Butte County Building Department, at that time, that they would rectify the situation through contact with the contractor and the Contractor's Licensing Board. We heard nothing more about it and of course assumed that everything had been taken care of, at that time, to the county's satisfaction. Now here we are fifteen years later, and we are suddenly informed by letter,.that no permits have ever been obtained for the pool installed in 1977, and that if we do not obtain the permits immediately wewill be found to be in non-compliance. Needless to say, we were shocked to receive this letter as we assumed this whole matter had been taken care of fifteen years ago. We definitely feel that the county dropped the ball in. this case by not informing us fifteen years ago that this matter had indeed not been corrected, and thereby given us a chance to have some recourse from the contractor, who of course is long gone now. Five years ago we sold the property at 9 Stimpson Road and have only just taken possession of it again by foreclosure in July. As I told you on the phone, the previous owners did a great deal of damage to the pool leaving it unusable at this time. Because the swimming season is over for this year, no repairs to the pool are expected to be done before at least spring 1999. When the repairs are ready to be made, the county building department will be informed so that inspections can be made as required. Please kindly refer all correspondence and communications in regard to this matter to this office rather than to the client. I am advised that the Connell pool was installed at least seven or eight years ago, and it was installed as a portable pool in that the lining and coping could be removed at any time and reinstalled elsewhere and by merely filling in the hole. Therefore, a permit would not be necessary. It is possible that since the Connell pool was installed, there may be some dispute that such a pool would be a permanent installation and, therefore, require a permit but I certainly don't believe that this would apply to a pool built so long ago. Further- more, it would appear to me that any enforcement as to the particular pool in question would be barred by the statute of limitations. Lastly, under the interpre- tation you appear to be giving as to the requirement of permits for pools, I submit that if a person put in a Doughboy, a permit would be required if the weight of the water in the pool caused it to sink into the ground. I suggest that we get together to discuss this matter at our mutual convenience to see if we can J. F.
