Commissioner Leland returned to the hearing at this time.
Cingular Wireless, (Item determined to be categorically exempt from environmental
review) Minor Use Permit to collocate twelve (12) 4.6 square foot panel antennas centered
at the 162 -foot level on an existing 181 -foot tall lattice tower. A 10 -foot by 16 -foot (160
square feet) equipment shelter is proposed to be placed at the base of the tower within an
existing lease area on property zoned A-40 (Agricultural, 40 -acre minimum parcel size). The
property is located on the east side of SR -99, approximately 0.23 miles south of Ord Ranch
Road, north of Gridley. APN 025-200-119 (SB) (MUP 04-02)
Steve Betts gave a brief summary of the project.
Commissioner Nelson asked if there were any comments at the time the tower was originally
proposed.
Mr. Betts replied this tower was put up at a time when agricultural zones allowed towers by right,
about a month prior to the moratorium on new towers. He said it was a speculation tower, erected in
anticipation that someone would go on it. He said one company did build on it, and this would be
the second set of antennas on the tower. He said if someone came with a new tower application for
that location, the County would probably say to go elsewhere.
Commissioner Nelson asked if the tower is colored.
Mr. Betts said the top 50 feet or so is orange and white.
Chairman Lambert said the colors on the lattice are not noticeable. 10
The hearing was opened to the public.
Rama Gulati, representing Cingular Wireless, explained that this application is a collocation, in
compliance with Butte County's code, and her company is looking to improve Cingular Wireless'
coverage primarily on Highway 99 and surrounding areas.
Mr. Wannenmacher asked Ms. Gulati if she had looked at the conditions and agreed to them.
Ms. Gulati replied "yes."
The hearing was closed to the public and comments were confined to Commission and staff.
Chairman Lambert commented that the County wants people to collocate on existing towers so there
would not be more towers, and since the tower already exists, we should use it rather than put
another tower in nearby.
It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried
to approve the Minor Use Permit, MUP 04-02, for Cingular Wireless subject to the findings set out
in the staff report and the conditions set out on Exhibit A.

I. Find that this project is exempt from the provisions of the California Environmental Quality
Act under Section 15311. Section 15311 consists of construction of minor structures
accessory (appurtenant) to existing facilities. Antennas placed on an existing tower are
considered to be accessory structures. The payment of fees pursuant to Fish and Game Code
Section 711.4 and 14 CCR 753.5 is not required.
II. Approve Minor Use Permit 04-02 for Cingular Wireless, subject to the following findings
and the conditions in Exhibit "A":
A. The proposed location, size, design, and operating characteristics of the proposed use
are in accordance with the purpose of this Ordinance, the purpose of the zone in
which the site is located, the Butte County General Plan, and the development
policies and standards of the County because:
Conditions of approval have been applied to this project pursuant to the applicable
requirements of Section 24-262 (Wireless Communication Facilities). The project is
in accordance with the purpose of the zone in which the land lies and the Butte
County General Plan because the project site is designated Orchard and Field Crops
and is zoned A-40. The Orchard and Field Crops land use designation allows public
utilities as Secondary Uses. The A-40 zone allows collocation of communication
facilities with approval of a Minor Use Permit.
B. The location, size, design, and operating characteristics of the proposed use would be
compatible with, and would not adversely affect, or be detrimental to adjacent uses,
residents, buildings, structures, or natural resources, with consideration given to:
1. Harmony in scale, bulk, coverage, and density:
The proposed antennas would not increase the height of the existing lattice
tower or extend horizontally beyond the existing antennas.
2. The availability of public facilities, services and utilities:
Electrical power service is already established to the property and no
additional services or utilities are required.
3. The harmful effect, if any, upon desirable neighborhood character:
The project site is already developed with a 181 foot tall lattice tower. The
proposed antennas to be mounted on the existing tower would not have a
harmful effect upon the neighborhood character. The radio-frequency
emissions from the proposed antennas must meet FCC standards. The
proposed antennas would not result in a significant visual impact to the
neighborhood.
Only a, minor amount of vehicle traffic would be generated during
installation of the antennas and equipment shelter. The communications

facility is unmanned and only one to two site visits per month per wireless
carrier would be required after installation of the antennas. The proposed
antennas and the equipment shelter would not generate any significant noise
levels.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
The project would result in approximately one to two site visits per month by
maintenance personnel. SR -99, which would provide access for the project
site, would not be significantly impacted by this increase in vehicular traffic.
5. The suitability of the site for the type and intensity of use or development
which is proposed:
The site is ideally suited for the project because the proposed antennas would
be mounted on an existing 181 foot tall lattice tower. The project would not
have an impact on the agricultural use established on the site.
6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed communication facility
application to County Agencies and has received no evidence that the use
would cause any other relevant impact.
C. Based on the above findings, the proposed location, size, design, and operating
characteristics of the proposed use and the conditions under which it would be
operated or maintained would not be detrimental to the public health, safety, or
welfare, or injurious to properties or improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of Butte County
Code Chapter 24, Section 262.
E. This project would collocate antennas on an existing communications tower, which
eliminates the need for a new communications tower to be erected elsewhere in the
project area.
F. The radio-frequency emissions generated by the existing and proposed antennas on
the tower would be below the public exposure limits set by the Federal
Communications Commission for wireless communication facilities.
G. The proposed antennas would not create any impacts to aircraft or helicopter
operations because they will not increase the height of the existing lattice tower nor
extend horizontally beyond the existing antennas.
H. Wireless telephone services are regulated by the California Public Utilities
Commission and are considered to be a public use.

Conditions of Approval:
Planning Division
The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified as
"Attachment D" and date-stamped October 7, 2003, and is incorporated herein by this
reference.
2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC,
the County, and any other agency of the Federal or State government with the authority to
regulate such Facilities.
3. The installation of the Facility shall comply with all applicable building and electrical codes.
The Facility operator shall submit certification from a registered structural engineer to the
Building Division, that all associated monopoles and towers in excess of thirty (30) feet in
height will withstand sustained winds as required by the Uniform Building Code.
4. No advertising or display shall be permitted on the Facility.
5. The placement of any antenna or structure shall not adversely affect any on-site sewage
disposal system or its repair area without written approval from the Division of
Environmental Health.
6. The installation of the Facility shall not violate any existing deed restrictions.
7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained
road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15)
feet of vertical clearance.
There shall be no outdoor vehicle or equipment storage except for emergency purposes.
9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any
other State and/or Federal agency with the authority to regulate such Facility. If such
standards and regulations are changed, the property owner or responsible party shall bring the
Facility into compliance with such revised standards and regulations within ninety (90) days
of the effective date of such standards and regulations, unless a more stringent compliance
schedule is mandated by the controlling agency.
10. The Facility or combination of the Facilities on the site shall not generate, at any time,
electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the
FCC adopted standards for human exposure, as amended over time.
11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of
persons working or residing near such facility, then the service provider(s) and property
owner shall be jointly and solely responsible for the removal, adjustment, or replacement of

the Facility. In no case shall the Facility remain in operation if it is found to create a hazard
to health, safety, and welfare. The Facility shall not be found to create a hazard to health,
safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all
current standards established by the FCC, pursuant to FCC OET 65.
12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall
post a performance security in an amount and form determined by the Director of
Development Services that is sufficient to cover the cost of a one-time test by a radio
frequency consultant selected by the County, sufficient to determine whether the Facility's
RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined
to exceed FCC standards, the applicant is required to pay for such other tests and other
corrective measures as are necessary to establish compliance with FCC OET 65 and its
successors and such noncompliance shall constitute sufficient grounds to commence a permit
revocation hearing which may lead to permit revocation. The applicant shall cooperate in all
respects with the County's consultant to assist the consultant to reach his/her conclusion.
13. All Facilities that are not in continual use for a period of six (6) months shall be considered
abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances,
requiring no amortization period.
14. All ground level support Facilities shall be painted and/or screened from view with adequate
landscaping appropriate to the surrounding environment. All aesthetic treatments, including
landscaping shall be maintained as approved for the life of the Facility.
15. The Facility may not encroach into, under, over, above, or upon any, public street in the
unincorporated area of the County in the absence of a valid encroachment permit from the
County.
16. The owner/operator of the Facility shall annually submit a written verification, attested to
under penalty of perjury, signed by both the owner/operator and an FCC licensee in the
employ of or retained by the owner/operator, that the radio frequency
radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety
standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to
reporting requirements set by the FCC and the County. The reports shall be submitted to the
Planning Division no later than January 31 of each year.
17. The Facility shall be secured at all times to prevent access by the public.
Building Division
18. Building and electrical permits required. Structural calculations prepared by an engineer
licensed to practice in the State of California shall be provided verifying adequacy of existing
tower to support added loads.

19. Prior to issuance of a building permit, provide a completed Hazardous Materials and

County Counsel
20. If this entire matter or any finding, action or condition of this matter is appealed to the Board
of Supervisors, the applicant or any other developer/operator other than the applicant agrees
to indemnify the County of Butte from liability or loss related to the approval of this project
and agrees to sign an indemnification agreement in a form approved by County Counsel
before the Board's appeal hearing. If the application is not appealed, this condition is
deemed satisfied.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Cingular Wireless is hereby granted a Minor Use Permit in
accordance with application filed to allow the collocation of twelve (12) 4.6 square foot panel
antennas centered at the 162 -foot level on a 181 -foot tall lattice tower and for the installation of a
10 -foot by 16 -foot (160 square feet) equipment shelter within the existing fenced lease area. The
project site is zoned A-40 and has a General Plan land use designation of Orchard and Field
Crops.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-41.
2. Unless otherwise .provided for in a special condition to this Minor Use Permit, all
conditions must be completed prior to or concurrently with the establishment of the
granted use. The use granted by this permit must be established within 12 months of.the
delivery of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid, and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one
year of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to establish
the use.
5. The terms and conditions of this permit shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
Conditions of Approval:
Planning Division
1. The project site shall be developed in accordance with the approved project site plan and
the conditions contained herein. Said site plan is on file in the Planning .Division, is
identified as "Attachment D" and date-stamped October 7, 2003, and is incorporated
herein by this reference.
2. The Facility must meet or fall within current standards and regulations of the FAA, the
FCC, the County, and any other agency of the Federal or State government with the
authority to regulate such Facilities.
3. The installation of the Facility shall comply with all applicable building and electrical
codes. The Facility operator shall submit certification from a registered structural
engineer to the Building Division, that all associated monopoles and towers in excess of
thirty (30) feet in height will withstand sustained winds as required .by the Uniform
Building Code.
4. No advertising or display shall be permitted on the Facility.
5. The placement of any antenna or structure shall not adversely affect any on-site sewage
disposal system or its repair area without written approval from the Division of
Environmehtal Health.
6. The installation of the Facility shall not violate any existing deed restrictions.
7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly
maintained road capable of supporting a forty thousand (40,000) pound fire apparatus
with fifteen (15) feet of vertical clearance.
8. There shall be no outdoor vehicle or equipment storage except for emergency purposes.
9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and
any other State and/or Federal agency with the authority to regulate such Facility. If such
standards and regulations are changed, the property owner or responsible party shall
bring the Facility into compliance . with such revised standards and regulations within
ninety (90) days of the effective date of such standards and regulations, unless a more
stringent compliance schedule is mandated by the controlling agency.
10. The Facility or combination of the Facilities on the site shall not generate, at any time,
electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of
the FCC adopted standards for human exposure, as amended over time.
11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of
persons working or residing near such facility, then the service provider(s) and property
owner shall be jointly and solely responsible for the removal, adjustment, or replacement
of the Facility. In no case shall the Facility remain in operation if it is found to create a
hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to

health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as
it meets all current standards established by the FCC, pursuant to FCC OET 65.
12. Prior to issuance of the building permit for the installation of the Facility, the applicant
shall post a performance security in an amount and form determined by the Director of
Development Services that is sufficient to cover the cost of a one-time test by.a radio
frequency consultant selected by the County, sufficient to determine whether the
Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are
determined to exceed FCC standards, the applicant is required to pay for such other tests
and other corrective measures as are necessary to establish compliance with FCC OET 65
and its successors and such noncompliance shall constitute sufficient grounds to
commence a permit revocation hearing which may lead to permit revocation. The
applicant shall cooperate in all respects with the County's consultant to assist the
consultant to reach his/her conclusion.
13. All Facilities that are not in continual use for a period of six (6) months. shall be
considered abandoned. Abandoned Facilities are hereby designated as unlawful and as
public nuisances, requiring no amortization period.
14. All ground level support Facilities shall be painted and/or screened from view with
adequate landscaping appropriate to the surrounding environment. All aesthetic
treatments, including landscaping shall be maintained as approved for the life of the
Facility:
15. The Facility may not encroach into, under, over, above, or upon any public street in the
unincorporated area of the County in the absence of a valid encroachment permit from
the County.
16. The owner/operator of the Facility shall annually submit a written verification, attested to
under penalty of perjury, signed by both the owner/operator and an FCC licensee in the
employ of or retained by . the owner/operator, that the radio frequency
radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety
standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to
reporting requirements set by the FCC and the County. The reports shall be submitted to
the Planning Division no later than January 31 of each year.
17. The Facility shall be secured at all times to prevent access by the public.
Building Division
18. Building and electrical permits required. Structural calculations prepared by an engineer
licensed to practice in the State of California shall be provided verifying adequacy of
existing tower to support added loads.
Environmental Health Division
19. Prior to issuance of a building permit, provide a completed Hazardous Materials and
Emissions Questionnaire.

20. If this entire matter or any finding, action or condition of this matter is appealed to the
Board of Supervisors, the applicant or any other developer/operator other than the
applicant agrees to indemnify the County of Butte from liability or loss related to the
approval of this project and agrees to sign an indemnification agreement in a form
approved by County Counsel before the Board's appeal hearing. If the application is not
appealed, this condition is deemed satisfied.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building
and Health Division permits before starting construction, nor does it waive any other
requirements.

At the regular meeting of the Butte County Planning Commission held December 11, 2003, your
request for a Minor Use Permit to collocate 12 panel antennas centered at the 162 -foot level on
an existing 181 -foot tall lattice tower, and install a 10' X 16' prefabricated equipment shelter
within the existing lease area, on property zoned A-40, (Agricultural, 40 -acre parcels) and
located on the east side of SR -99, approximately 0.23 miles south of Ord Ranch Road, north of
Gridley, was approved subject to the conditions listed on the Agenda Report.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you
must do so in writing, prior to 5:00 p.m., Monday, December 22, 2003 to the:

The appeal fee of $50.00 must be paid at that time. If you do not appeal, and if there are no other

PLANNING FEES
Your project required a deposit of funds to begin processing of your application. You will be
receiving an invoice detailing the planning charges incurred against that deposit. In the event the
charges have exceeded the initial deposit, you will be invoiced for those charges that have
exceeded the amount deposited and for additional funds to be deposited for the completion of the
proj ect.
If your project has been completed and there is a balance remaining of your initial deposit, it may
be applied to any applicable additional fees as described below. If there are no additional fees,

EXECUTIVE SUMMARY:
The project would allow the collocation of twelve panel antennas centered at the 162 -foot level
on an existing 181 -foot tall lattice tower. The City of Gridley is opposed to the project. Staff
recommends approval of this Minor Use Permit with findings and conditions.
PROJECT DESCRIPTION/SITE CHARACTERISTICS:
• The project would allow the collocation of twelve 4.6 square foot panel antennas centered at
the 162 -foot level on an existing 181 -foot tall lattice tower.
• The project would also allow the installation of a 10 -foot by 16 -foot (160 square feet)
prefabricated equipment shelter to be placed within an existing 8,000 square foot lease area.
• The proposed antennas will provide improved personal communications services to the
public in the Gridley/Biggs/SR-99 corridor area.
• The project parcel is developed with a 181 -foot tall lattice tower and row crops.

• The existing lattice tower was placed on the project site at a time when communications
facilities were allowed by right in the Agricultural zones.
• Minor Use Permit 01-05 was approved in 2000 to allow the installation of six panel antennas
at the top of the lattice tower.
• The upper portion of the existing tower is painted alternating orange and white stripes and is
lighted with a white strobe light during the day and a red obstruction light at night.
• The existing 8,000 square foot lease area is surrounded by a 6 -foot tall chain link fence
topped with 3 strands of barbed wire.
• Vehicular access to the existing communication facility lease area is from SR -99 via an
existing 70 -foot long, gravel driveway.
• The project site is zoned A-40 and has a General Plan Land Use designation of Orchard and
Field Crops.
• Surrounding parcels are zoned A-40 or are within the City of Gridley (zoned for
manufacturing/industrial uses). Land uses on the surrounding/nearby parcels include
agricultural uses (orchards and field crops), a cemetery, manufacturing/industrial, and single
family dwellings at rural densities.
• The project site is not located within an Airport Compatibility Zone.
• The project site is within the City of Gridley's Sphere of Influence.
• The project site is owned by the Robinson Family Trust. The 8,000 square foot lease area is
owned by American Tower Corporation.
ANALYSIS:
• The project would not result in a significant increase in air emissions, fugitive dust
emissions, light, noise, or vehicle traffic.
• Only a minor amount of construction activity and soil disturbance would be required due to
the project.
• The proposed panel antennas are not expected to create any significant visual impacts
because they will not increase the height of the existing tower nor will they extend
horizontally beyond the existing antennas.
• The proposed antennas and mounting hardware are required to be painted the same color as
the existing lattice tower to help reduce their visibility. The tower is painted white at the
height where the proposed antennas would be located.
• A photo simulation of the proposed antennas on the existing lattice tower shows that the
proposed antennas would not be highly conspicuous.
• The. access driveway to the existing communications facility lease area is long enough so that
vehicles entering the project site would not cause any safety concerns on SR -99.
• The City of Gridley commented that the proposed antennas would further decrease the
aesthetic value of the northern entryway to their city.

Zoning Consistency
• The project site is designated as Orchard and Field Crops by the Land Use Element Map of
the General Plan, which allows public uses as secondary uses (note: cellular phone service
providers are considered a public utility because they are regulated by the California Public
Utilities Commission).
• Section 24-91 of Butte County Code states that communications facilities, including the
collocation of antennas on existing towers/monopoles, are not permitted in the A-40 zone
unless a permit is obtained (subject to the requirements of Butte County Code Section 24-
262). Section 24-262(d) states that a Minor Use Permit must be obtained for collocation of
antennas in the A-40 zone.
The project has been conditioned to meet the requirements of Section 24-262, including:
• Radio-frequency emissions in excess of FCC standards are not allowed.
• Facilities that are not in continual use for a period of six (6) months shall be considered to be
abandoned.
• Verification submitted annually attesting that the radio frequency radiation/electromagnetic
frequency (RF/EMF) emitted by. the facility conforms to safety standards set forth in FCC
OET 65.
• Access to the site must be at least 12 feet wide and capable of supporting a 40,000 -pound fire
apparatus.
Radio -Frequency Emissions
• A radio-frequency analysis determined that the emissions from the existing and proposed
antennas would be 0.02% of the FCC standard for public exposure to radio-frequency
emissions at the base of the tower.
• The proposed operation of the site would be in compliance with the FCC requirements for
public exposure to RF radiation.
City of Gridley Comments
The City of Gridley is opposed to the additional antennas on the tower due to visual impacts.
Their comment letter, which is attached to this report, notes that the existing tower is located on
the City's northern entryway and an ongoing goal of the City is to develop this area as an
attractive entryway. The City would like the existing tower to be relocated to a less obtrusive
location. They further state that if the tower is to remain, efforts should be made to camouflage
the structure and fixture additions.
As already noted above, the building permit for the existing tower was issued in 1997, a time
when communications facilities were allowed by right in the Agricultural zones. Had a
discretionary permit been required the Planning Division would most likely not have

recommended approval of the tower due to visual impacts. However, it must be recognized that
the tower was placed on the site legally and that itis capable of supporting additional antennas.
Denial of the project would prevent the proposed antennas from being placed on the tower, but
the tower will still be there. Denial. of the project may force the applicant to seek to construct a
new tower elsewhere in the project area, which could lead to much greater impacts than the
proposed antennas. While the City of Gridley has valid concerns about the visual impacts caused
by the tower itself, the proposed antennas would not significantly decrease the visual aesthetics
of the project area.
ENVIRONMENTAL REVIEW:
This application for a Minor Use Permit to allow the collocation of antennas on an existing
communications tower is Categorically Exempt from the provisions of the California
Environmental Quality Act under Section 15311. Section 15311 consists of construction of
minor structures accessory (appurtenant) to existing facilities. Antennas placed on an existing
tower are considered to be accessory structures.
ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:
I. Find that this project is exempt from the provisions of the California Environmental
Quality Act under Section 15311. Section 15311 consists of construction of minor
structures accessory (appurtenant) to existing facilities. Antennas placed on an existing
tower are considered to be accessory structures. The payment of fees pursuant to Fish
and Game Code Section 711.4 and 14 CCR 753.5 are not required.
II. Approve Minor Use Permit 04-02 for Cingular Wireless, subject to the following findings
and the conditions in Exhibit "A":
A. The proposed location, size, design, and operating characteristics of the proposed
use are in accordance with the purpose of this Ordinance, the purpose of the zone
in which the site is located, the Butte County General Plan, and the development
policies and standards of the County because:
Conditions of approval have been applied to this project pursuant to the
applicable requirements of Section 24-262 (Wireless Communication Facilities).
The project is in accordance with the purpose of the zone in which the land lies
and the Butte County General Plan because the project site is designated Orchard
and Field Crops and is zoned A-40. The Orchard and Field Crops land use
designation allows public utilities as Secondary Uses. The A-40 zone allows
collocation of communication facilities with approval of a Minor Use Permit.

B. The location, size, design, and operating characteristics of the proposed use would
be compatible with, and would not adversely affect, or be detrimental to adjacent
uses, residents, buildings, structures, or natural resources, with consideration
given to:
1. Harmony in scale, bulk, coverage, and density:
The proposed antennas would not increase the height of the existing
lattice tower or extend horizontally beyond the existing antennas.
2. The availability of public facilities, services and utilities:
Electrical power service is already established to the property and no
additional services or utilities are required.
3. The harmful effect, if any, upon desirable neighborhood character:
The project site is already developed with a 181 foot tall lattice tower.
The proposed antennas to be mounted on the existing tower would not
have a harmful effect upon the neighborhood character. The radio-
frequency emissions from the proposed antennas must meet FCC
standards. The proposed antennas would not result in a significant visual
impact to the neighborhood.
Only a minor amount of vehicle traffic would be generated during
installation of the antennas and equipment shelter. The communications
facility is unmanned and only one to two site visits per month per wireless
carrier would be required after installation of the antennas. The proposed
antennas and the equipment shelter would not generate any significant
noise levels.
4. The generation of traffic and the capacity and physical character of
surrounding streets:
The project would result in approximately one to two site visits per month
by maintenance personnel. SR -99, which would provide access for the
project site, would not be significantly impacted by this increase in
vehicular traffic.
5. The suitability of the site for the type and intensity of use or development
which is proposed:
The site is ideally suited for the project because the proposed antennas
would be mounted on an existing 181 foot tall lattice tower. The project
would not have an impact on the agricultural use established on the site.

6. Any other relevant impact of the proposed use:
The Planning Division has circulated the proposed communication facility
application to County Agencies and has received no evidence that the use
would cause any other relevant impact.
C. Based on the above findings, the proposed location, size, design, and operating
characteristics of the proposed use and the conditions under which it would be
operated or maintained would not be detrimental to the public health, safety, or
welfare, or injurious to properties or improvements in the vicinity.
D. The proposed use will comply with each of the applicable provisions of Butte
County Code Chapter 24, Section 262.
E. This project would collocate antennas on an existing communications tower,
which eliminates the need for a new communications tower to be erected
elsewhere in the project area.
F. The radio-frequency emissions generated by the existing and proposed antennas
on the tower would be below the public exposure limits set by the Federal
Communications Commission for wireless communication facilities.
G. The proposed antennas would not create any impacts to aircraft or helicopter
operations because they will not increase the height of the existing lattice tower
nor extend horizontally beyond the existing antennas.
H. Wireless telephone services are regulated by the California Public Utilities
Commission and are considered to be a public use.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Cingular Wireless is hereby granted a Minor Use Permit in
accordance with .application filed to allow the collocation of twelve (12) 4.6 square foot panel
antennas centered at the 162 -foot level on a 181 -foot tall lattice tower and for the installation of a
10 -foot by 16 -foot (160 square feet) equipment shelter within the existing fenced lease area. The
project site is zoned A-40 and has a General Plan land use designation of Orchard and Field
Crops.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-41.
2. Unless otherwise provided for in a special condition to this Minor Use Permit, all
conditions must be completed prior to or concurrently with the establishment of the
granted use. The use granted by this permit must be established within 12 months of the
delivery of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid, and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one
year of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to establish
the use.

5. The terms and conditions of this permit shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
Conditions of Approval:
Planning Division
1. The project site shall be developed in accordance with the approved project site plan and
the conditions contained herein. Said site plan is on file in the Planning Division, is
identified as "Attachment D" and date-stamped October 7, 2003, and is incorporated
herein by this reference.
2. The Facility must meet or fall within current standards and regulations of the FAA, the
FCC, the County, and any other agency of the Federal or State government with the
authority to regulate such Facilities.
3. The installation of the Facility shall comply with all applicable building and electrical
codes. The Facility operator shall submit certification from a registered structural
engineer to the Building Division, that all associated monopoles and towers in excess of
thirty (30) feet in height will withstand sustained winds as required by the Uniform
Building Code.
4. No advertising or display shall be permitted on the Facility.
5. The placement of any antenna or structure shall not adversely affect any on-site sewage
disposal system or its repair area without written approval from the Division of
Environmental Health.
6. The installation of the Facility shall not violate any existing deed restrictions.
7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly
maintained road capable of supporting a forty thousand (40,000) pound fire apparatus
with fifteen (15) feet of vertical clearance.
8. There shall be no outdoor vehicle or equipment storage except for emergency purposes.
9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and
any other State and/or Federal agency with the authority to regulate such Facility. If such
standards and regulations are changed, the property owner or responsible party shall
bring the Facility into compliance with such revised standards and regulations within
ninety (90) days of the effective date of such standards and regulations, unless a more
stringent compliance schedule is mandated by the controlling agency.
10. The Facility or combination of the Facilities on the site shall not generate, at any time,
electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of
the FCC adopted standards for human exposure, as amended over time.

11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of
persons working or residing near such facility, then the service provider(s) and property
owner shall be jointly and solely responsible for the removal, adjustment, or replacement
of the Facility. In no case shall the Facility remain in operation if it is found to create a
hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to
health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as
it meets all current standards established by the FCC, pursuant to FCC OET 65.
12. Prior to issuance of the building permit for the installation of the Facility, the applicant
shall post a performance security in an amount and form determined by the Director of
Development Services that is sufficient to cover the cost of a one-time test by a radio
frequency consultant selected by the County, sufficient to determine whether the
Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are
determined to exceed FCC standards, the applicant is required to pay for such other tests
and other corrective measures as are necessary to establish compliance with FCC OET 65
and its successors and such noncompliance shall constitute sufficient grounds to
commence a permit revocation hearing which may lead to permit revocation. The
applicant shall cooperate in all respects with the County's consultant to assist the
consultant to reach his/her conclusion.
13. All Facilities that are not in continual .use for a period of six (6) months shall be
considered abandoned. Abandoned Facilities are hereby designated as unlawful and as
public nuisances, requiring no amortization period.
14: All ground level support Facilities shall be painted and/or screened from view with
adequate landscaping appropriate to the surrounding environment. All aesthetic
treatments, including landscaping shall be maintained as approved for the life of the
Facility.
15. The Facility may not encroach into, under, over, above, or upon any public street in the
unincorporated area of the County in the absence of a valid encroachment permit from
the County.
16. The owner/operator of the Facility shall annually submit a written verification, attested to
under penalty of perjury, signed by both the owner/operator and an FCC licensee in the
employ of or retained by the owner/operator, that the radio frequency
radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety.

reporting requirements set by the FCC and the County. The reports shall be submitted to
the Planning Division no later than January 31 of each year.
17. The Facility shall be secured at all times to prevent access by the public.

existing tower to support added loads.

19. Prior to issuance of a building permit, provide a completed Hazardous Materials and
Emissions Questionnaire.
County Counsel
20. If this entire matter or any finding, action or condition of this matter is appealed to the
Board of Supervisors, the applicant or any other developer/operator other than the
applicant agrees to indemnify the County of Butte from liability or loss related to the
approval of this project and agrees to sign an indemnification agreement in a form
approved by County Counsel before the Board's appeal hearing. If the application is not
appealed, this condition is deemed satisfied.
NOTE: Issuance of this Minor Use Permit does not waive requirement of obtaining Building
and Health Division permits before starting construction, nor does it waive any other
requirements.

The City of Gridley has received the above noted application to construct
and operate a wireless facility consisting of twelve panel antennas to be mounted
at a height of 162' on an existing communications tower. The application also
includes construction of related equipment at the base of the tower within the
existing fenced compound. The existing tower is located just north of the City
limits, within the Sphere of Influence.
The location of the tower is located at the northern entrance to the City.
The City has invested considerable expense and efforts in planning studies and
public participation in an attempt to beautify the Highway 99 corridor. An
ongoing goal of the City is to. develop this area as an attractive entryway — one
that would attract passing motorists and increase investment for the community.
As such, the City has always been opposed to the placement of a 182'
communication tower adjacent to Highway 99. Although the City understands the
necessity to provide this type of service, more appropriate locations with less of a
visual impact on the 99 corridor should have been considered and required.
Because of the visual impact the communications tower and any additional
panels and related construction would have on the City's northern entryway, the
City is opposed to Minor Use Permit No. 04-02. Obviously the City would like to
request that the entire tower be moved to a less obtrusive location away from the
highway and passing motorists. If the tower is to remain, efforts should be made
to camouflage the structure and future additions.
With regards to the attached environmental questionnaire, the City does
not agree with the applicants' analysis that, there will.be no change in character or
visual impact to the project area

Introduction
As the nation's second largest wireless service provider, Cingular Wireless, formerly Pacific Bell
Mobile Services, is continuing to expand its network in Caifornia. In addition to mobile phone
services, Cingular's network offers wireless email, text messaging, internet access, paging, photo
messaging and data transmission. Cingular Wireless owns radio frequency spectrum licenses
auctioned by the Federal Communications Commission (FCC) for wireless communications. The
FCC mandates that the licensees comply with stringent requirements including providing high
quality in -building coverage to the general public within an aggressive timeframe.
Cingular's wireless network employs a series of antenna base stations that receive and send
signals from a user's mobile phone and then "hand the call off' to another base station as the
user moves from one area to another.
The coverage objective for the proposed project is to improve coverage along Hwy 99 and the
surrounding areas.
Project Description
Cingular Wireless hereby requests approval of its application for a Minor Use Permit to construct
and operate a wireless telecommunications facility at 46 Ord Ranch Road, Gridley, CA. The
facility will consist of twelve (12) panel antennas 'to be mounted at a height of 162' on an
existing 181' 3 5/8" lattice tower. The height of the antennas from natural grade to the top of the
antennas will be 164'1.5". Related equipment cabinets will be housed in a pre -fabricated 10' x
16' shelter which will be located within the existing lease area. The facility will be unmanned,
but visited on an average of once per month for routine maintenance purposes.
No water or sewer service is required for the site. No advertising or signage is proposed, except
signs required by the FCC and emergency contact information. No exterior lighting is proposed
and noise output will be minimal, comparable to a household refrigerator. Access to the site will
be from Hwy 99 to the existing driveway off of Ord Ranch Road.
Site Selection
Whenever possible, Cingular Wireless seeks to collocate its facility on existing structures in lieu
of building new ones. The current proposal is a collocation on an existing lattice tower that
allows Cingular to meet its coverage objective with little, if any, visual impact.

Zoning Code Compliance
This project is in compliance with Butte. County's Zoning Ordinance Section 24-262. The
subject property is zoned A=40 and a Minor Use Permit is required for the proposed project.
Cingular Wireless will comply with the safety requirements of the Uniform Building Code, as
well as all other applicable regulations and permits, including those of the Public Utilities.
Commission (PUC) and the FCC. If the facility is unused or becomes obsolete, it will be
removed within six months after its operation has ceased. Cingular Wireless respectfully requests
approval of its application for a minor use permit.

Report Summary
Based upon information provided by Cingular Wireless, and through physical verification of the
emitted RF field strength, and through calculations of expected field strength, it is the engineer's
opinion that the proposed Cingular Wireless Personal Communication System (PCS) site which
will be located at 46 Ord Ranch Road, Gridley, California will comply with the FCC's current
prevailing standard for limiting human exposure to RF energy. Therefore, no significant impact
on the environment or general population is expected. The measured and calculated
electromagnetic field strength in normally publicly accessible areas is less than the existing
standard allows for general population uncontrolled exposure. All accessible areas around the
existing tower were surveyed, and the maximum measured RF level at ground level was .67% of
the limit for general population uncontrolled exposure. The maximum level was measured
approximately 30' from the existing tower.
The combined effect of the measured RF level and the maximum calculated additional
contribution at ground level is .69% of the existing standard for general population uncontrolled
exposure.
General Recommendations
Maintenance personnel should be instructed to notify the appropriate carrier(s) prior to working
(painting, maintenance, etc.) near any antenna. Any person who is allowed access to areas near
the antennas should be provided with RF safety instruction.
RF warning signs should be posted at the base of the existing tower.
Background
Diamond Services' has been retained by Cingular Wireless Inc. to conduct a Radio Frequency
(RF) electromagnetic field analysis for a proposed PCS site to be located.at 46 Ord Ranch Road,
Gridley, California. This analysis consists of a review of the site conditions, measurement of the
RF field strength in the accessible areas around the existing tower, calculation of the expected
contribution by the additional Cingular antennas, and the provision of a ,comparison of the
estimated field strength with the Federal Communication Commission (FCC) recommended
guidelines for human exposure to RF electromagnetic fields.

Site Description
Based upon observations at the site, multiple antennas are mounted on an existing tower.
Twelve new Cingular Wireless panel antennas will be mounted on the existing tower,
approximately 159 10'/2" (to bottom of antennas) above ground level.
The antennas at this site are not accessible to the public.
RF Field Strength Survey Methodology
Weston Frey, of Diamond Services utilized a Holaday HI -4460 RF field strength survey meter
with model HI -4455 probe to quantify the RF field strength at various points around the existing
tower. The calibration date for the Holaday HI -4455 probe is May 28, 2003. The maximum
observed field at ground level was 0.004 mW/cm2, measured approximately 30' from the
existing tower. The survey was performed on 09/30/03 at approximately 08:20:00 AM.
See Table 1 for the FCC's guidelines on Maximum Permissible Exposure (MPE). Note that the
RF ranges referenced for this analysis are the ranges of 300-1500 Mhz and 1500 — 100,000 Mhz
shown in Table 1, which is included in Appendix A.
RF Field Strength Calculation Methodology
A generally accepted method is used to calculate the expected RF field strength. The method
uses the FCC's recommended equation2 which predicts field strength on a worst case basis by
doubling the predicted field strength. The following equation is used to predict maximum RF
field strength:

Using a maximum effective radiated power of 400 watts, and a down tilt of 5° the maximum
calculated field strength for this site at 6'-6" above ground level in front of a Cingular antenna is
0.0002 mW/cm2. Using this result, the maximum calculated additional field strength at ground
level is .02% of the applicable public limit for uncontrolled exposure.

Expos.ure Environments
The FCC guidelines incorporate two separate tiers of exposure limits that are dependent
on the situation in which the exposure takes place and/or the status of the individuals who are
subject to exposure. The decision as to which tier applies in a given situation should be based on
the application of the following definitions.
Occupational/controlled exposure limits apply to situations in which persons are exposed
as a consequence of their employment and in which those persons who are exposed have been
made fully aware of the potential for exposure and can exercise control over their exposure.
Occupational/controlled exposure limits also apply where exposure is of a transient nature as a
result of incidental passage through a location where exposure levels may be above general
population/uncontrolled limits (see below), as long as the exposed person has been made fully
aware of the potential for exposure and can exercise control over his or her exposure by leaving
the area or by some other appropriate means.
General population/uncontrolled exposure limits apply to situations in which the general
public may be exposed or in which persons who are exposed as a consequence of their
employment may not be made fully aware of the potential for exposure or cannot exercise
control over their exposure. Therefore, members of the general public always fall under this
category when exposure is not employment-related.
For purposes of applying these definitions, awareness of the potential for RF exposure in
a workplace or similar environment can be provided through specific training as part of a RF
safety program. Warning signs and labels can also be used to establish such awareness as long
as they provide information, in a prominent manner, on risk of potential exposure and
instructions on methods to minimize such exposure risk. For example, a sign warning of RF
exposure risk and indicating that individuals should not remain in the area for more than a certain
period of time could be acceptable.
Another important point to remember concerning the FCC's exposure guidelines is that
they constitute exposure limits (not emission limits), and they are relevant only to locations that
are accessible to workers or members of the public. Such access can be restricted or controlled
by appropriate means such as the use of fences, warning signs, etc., as noted above. 'For the case
of occupational/controlled exposure, procedures can be instituted for working in the vicinity of
RF sources that will prevent exposures in excess of the guidelines. An example of such
procedures would be restricting the time an individual could be near an RF source or requiring
that work on or near such sources be performed while the transmitter is turned off or while
power is appropriately reduced.

Mr. Runte has been involved in the measurement and analysis of RF emissions since 1979. He
has designed numerous RF systems including both site design and RF system design. He is a•
registered Professional Engineer in the state of California, and all contents of this report are true

Term Definitions
•
Exposure Exposure occurs whenever and wherever a person is subjected to electric, magnetic
or electromagnetic fields other than those originating from physiological processes in the body
and other natural phenomena.
Exposure, partial -body. Partial -body exposure results when RF fields are substantially
nonuniform over the body. Fields that are nonuniform over volumes comparable to the human
body may occur due to highly directional sources, standing -waves, re -radiating sources or in the
near field.
General population/uncontrolled exposure. For FCC purposes, applies to human exposure to
RF fields when the general public is exposed or in which persons who are exposed as a
consequence of their employment may not be made fully aware of the potential for exposure or
cannot exercise control over their exposure. Therefore, members of the general public always
fall under this category when exposure is not employment-related.
Maximum permissible exposure (MPE). The rms and peak electric and magnetic field
strength, their squares, or the plane -wave equivalent power densities associated with these fields
to which a person may be exposed without harmful effect and with an acceptable safety factor.
Occupational/controlled exposure. For FCC purposes, applies to human exposure to RF fields
when persons are exposed as a consequence of their employment and in which those persons

NOTICE OF A PUBLIC HEARING
Notice is hereby given by the Butte County Planning Commission that a public hearing is published
for Thursday, December 11, 2003, in the Butte County Board of Supervisors' Room, County
Administration Center, 25 County Center Drive, Oroville, California, regarding the following item:
ITEM DETERMINED TO BE CATEGORICALLY EXEMPT
FROM ENVIRONMENTAL REVIEW
9:00 a.m. - Cingular Wireless, Minor Use Permit to collocate twelve (12) 4.6 square foot panel
antennas centered at the 162 -foot level on an existing 181 -foot tall lattice tower. A 10 -
foot by 16 -foot (160 square feet) equipment shelter is proposed to be placed at the
base of the tower within an existing lease area on property zoned A-40 (Agricultural,
40 -acre minimum parcel size). The property is located on the east side of SR -99,
approximately 0.23 miles south of Ord Ranch Road, north of Gridley. APN 025-200-
119 (SB) (MUP 04-02)
The above mentioned application is on file and available for public viewing at the office of the Butte
County Development Services Department, Planning Division, 7 County Center Drive, Oroville,
California. For information call: (530) 538-7601 (Monday through Friday, 8:00 a.m. to 4:00 p.m.)
Comments may be submitted in writing at any time prior to the hearing or orally at the meeting listed
above or as maybe continued to a later date. Upon action taken by the Planning Commission on the
project an appeal maybe filed with the Clerk of the Board of Supervisors. The appeal period is 10
days. If youchallenge the above application in court, you maybe limited to raising only those issues
you or some else raised at the public hearing described in this notice or in written correspondence
delivered to the Planning Commission, at or prior to, the public hearing.
