The Planning Department is acutely aware of the scarce resources local government agincies dace in delivering services. The Planning Department is currently in the process g11 of seeking the adoption of the "Energy, Natural Resources and Recreation Element" of the Butte County General Plari. The Recreation Element calls for the County to adopt and implement an ordinance pursuant to the Quirnby Act Legislation. However; the riimby Act also requires that the County adopt a Recreation Element wh-4ch meets the requirements of the state guidelines and contains policies requiring a park fee prior to. adipting a Quimby Ordinance. w As you are aware, the Cot.yty has established, -park. facility fees for the Chico Urban area; However, these fees have been enacted under the gen-aral police powers authority granted ' to the County by its Charter, and the State Constitution Article XI, Section 7i Tit addition,, these park fees are collected at the building permit stage rather than at the map stage as allowed by the Quimby Act. (Ord. No. 2750, § 1 5-23.89) Sec. 16-27. Findings. The board of supervisors makes the following findings and determin.litions required by section 66001-of the California Gov- ernment Code iti regard to the park facility fees assessed and levied pursuant to the provisions of this article: (a) lnzportance of Parks, .Increased Need Resulting !from Neuf Residential Development; The presence of park :facilities svlthin the Chico Urban Area contributes significantly to the ",mu6- and ambience of said area, together With the physical health and emotional well-being of its residents. New Tesidential develop y ment octnuxing within said area will create a need for the at,qui sition, and development of additional park facilities within said area in ):hat "the existing park facilities, including Bidwell Park; are insullicient in number, sizer location, and the kinds of retrea tional oppbrtunities which they present to meet the park and recreatiobal heeds of both the existing residents of said area plus those additional residents who will eventimily inhabit such anew residential development. Based on the general plans of the 1'ality of Chico and the County of Butte as well as the park and reoro- ation plant prepared for the Chico Area Recrealion and Park District, now 'residential development occurring within said area 4 will create the need for at least three and one-hal f t;t,5) acres of `V neighborhood and corrimunity park facilities, dev860od pritnar• x y onal pursuits, for every one thousar;d (1,600) l for active recre.ti 188A atbpp, No. .5,80 , 116-27 BUTTE COUNTY CODE 116-27 new residents who eventually inhabit such new residential de. velopment, By reason of the foregoing, the board of supervisors determines that there is a reasonable relationship between the need for the park facilities to be .funded with the park facility fees provided for by this article and the residential development union which such fees are imposed. (b) Use of Revenues,From fees To Meet Parc Needs: All reve nues from the park facility fees assessed and lovied on new rosi- dential development pursuant to the provisions of this article will be used for the acquisition and development of additional park facilities within the Chico Urban Area which will meet the need for such facilities caused by such new residential develop- ment. In accordance with the provisions of this article, all such revenues must be deposited in a park fund and thereafter appro• priated by the board of directors of the Chit,o Area Recreation and Park District for the acquisition and development of park' facilities of benefit Ix the persons 'residing in the residential development upon which the fees are unposed. By reason of the foregoing, the board of supervisors ,determines that there is a reasonable relationship between the -use of the ;park facility fees provided for by this article and the residential development upon which such fees are imposed„ (c) Fees Do Not Exceed Level Necessary To Areet Need: The paxk facility fees assessed and levied on new;residontial development pursuant to the provisions of this article Will not exceed that which is necessary to: fund the park facilities attributable to the residential development upon which such fein are imposed. In particular, the parkfacility fees assessed and 'levied on new residential development will be equal to that necessary to fund the three and one-half (34 acres of neighborhood and community park facilities'' heretofore found to be necessary for every one thousand (1,0.00) now'residentis who eventually inhabit such hew development, By reason of the foregoing, the board of supervisors determines that there is a reasonable relationship between the amount of the park facility fees provided for by this article and the cost of the park facilities attributable to the new residential development upon which thu fees are impi)sed.
