Francis Tate said she has done everything she was asked to do. She said she put w slats over the chain wood ' hnl , and the kennels are concrete. She said she agreed to all the conditions. Chairman. Ostrows-k said the ,first letter was .from Margaret R. Shea objecting to the kennel., The letter states that the dogs bark and disturb their sleep. Mrs. Shea states in the letter that herro ert p p y is for sale and people will not buy it because of the kennel 1text door. Chairman OstroWski said the Second letter was from Z'eane Andes stating that her children are afraid to go to the bus stop, Nyluch is past the kennels; because they are afraid of the dogs. Ili said her letter also states that the dogs have gotten out and come in her yard and' also that the dogs bark at night. Ms. Tate said she does not let her dogs barb at night. Tom Reid, Environmental' Health Department, said some of the problems in the past were because the Health Department did not have access to inspect the property, He said the Use Permit would give the department this kind of access and would help with enforcement of the conditions. Commissioner 'Matson discussed needing a sound meter on Condition 2. Col"nmssioner Lynch was concerned with Condition 4; Commissioner ;Lambert said with a Use Permit there will be inspections to snake sure the conditions are met. The property is a 1/2 acre parcel located at the southeast corner of Larkin road and Vance Ave.,' ve. south of Oroville i o parcel is part os a pocket of small residential parcels surrounded by larger agricultural properties. There is a mobile home and some existing kennels on site, The applicant wishes to enlarge the kennel area from 990 square feet to 1490square feet. The applicant. purchased thero e p p rty in 1989 and started a kennel using dog runs that were already on the property. The previous owner has stated in a letter that he raised hunting dogs; and kept between 5' and 7 dogs on the property. However, a check with Butte County .Rabies: Control indicated that no kennel license has ever been issued for this location. This means that the use of the property for a fennel was never legally established. This Use Permit will Consider the entiro, kennel operation on site. The. This permit will allow the applicant to keep 3 more dogs than allowed without the permit. During the site visit it appeared that there were at least 10 dogs on the property. The main kennels are located on the northwest corner of the lot, as far away from neighboring residences as possible, This puts the kennel approximately 150' away from tho two nearest residences; To this date, the Planning Department has not received any complaints from neighbors regarding this facility, There still remains some potential for land use conflicts.
