White; This department has received a complaint alleging health and/or safety hazards at the above - referenced property. Butte County Assessor's records indicate that you own or control the property. On October 26, 2005 made regarding the complaint and the following conditions were observed which are in violation of the California Health and Safety Code, Section 17920.3 (a) 12, 15; (b) 2, 4; (d); (g) 2; which pose health and safety hazards to the occupants and render the dwelling substandard. This letter is your thirty (30) day warning letter to correct or abate the following violation: Any building or portion thereof including any dwelling unit, guest room or suite of rooms, or the premises on which the same is located, in which there exists any of the following listed conditions to an extent that endangers the life, limb, health, property, safety, or welfare of the public or the occupants thereof shall be deemed and hereby is declared to be a substandard building: 1. Infestation of roaches throughout residence. (a) 12 2. Lack of adequate garbage storage and removal. (a) 15 3. Deteriorated flooring and floor supports throughout the structure. (b) 2 4. Exposed wiring, open splices, missing receptacles, and switch plates throughout structure. (d) 6. Faulty weather protection around, windows and doors throughout. (g) 7. Deteriorated exterior siding. (g) 2 The determination that these violations exist on the property is based on the following definitions in the Butte County Code: • Butte County Code,Chapter 26 - C.B.C., 1998 Addition, Section 102 - Unsafe Buildings or Structures. All buildings or structures regulated by this code which are structurally unsafe or not provided with adequate egress, or which constitute a fire hazard, or are otherwise . dangerous to human life are, for the purpose of this section, unsafe. Any use of buildings or structures constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster, damage or abandonment is, for the purpose of this section, an unsafe use. Parapet walls, cornices, spires, towers, tanks, statuary and other appendages or structural members which are supported by, attached to, or a part of a building and which are in deteriorated condition or otherwise unable to sustain the design loads which are specified in this code are hereby designated as unsafe building appendages. All such unsafe buildings, structures or appendages are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the procedures set forth in the Dangerous Building Codes or such alternate procedures as may have been or as may be adopted by this jurisdiction. As an alternative,' the building official, or other employee or official of this jurisdiction as designated by the governing body, may institute any other appropriate action to prevent, restrain, correct or abate the violation. • Butte County Code, Chapter 26, Section 26-6(b) - Unsafe for Human Habitation. This dwelling has been posted by the Butte County Department of Development Services, Building Division as unsafe for human habitation. There are numerous conditions existing which are in violation of the State Housing Law and the Health and Safety Code. It is unlawful to occupy this dwelling. It shall be vacated at once and remain vacant until clearance to occupy is received from the Butte County Department of Development Services, Building Division. It is a misdemeanor to occupy this building, or to remove or deface. this notice: Butte County Code Section 26-6 (b). Failure to vacate this dwelling as required by law will result in legal action through the District Attorney's Office. Patricia B. It is the County's goal to obtain voluntary compliance with the California Health and Safety Code. However, you should be advised that Butte County has an active code enforcement program which provides an effective means of enforcement. A re -inspection will be made to determine compliance. If voluntary compliance with this notice is not accomplished by correction of the above -referenced violations, enforcement may be pursued through the issuance of a citation to appear in the Butte County Municipal Court. Upon conviction and per Section 41-7 of the Butte County Code, violators may be fined ,and a Notice of Violation may be recorded which include a description of the action necessary to correct the violation. Furthermore, failure to comply will result in the Franchise Tax Board being notified of your non-compliance. You will then be prevented from claiming state tax deductions for taxes, depreciation, amortization, or interest expenses connected with the property as long as it remains substandard. This notice is given to you pursuant to Section 24436.5 of the California Revenue and Taxation Code. To comply with the California Health and Safety Code, Section 17920.3; you must obtain all required permits for repairs from the Butte County Department of Development Services, Building Division, 7 County Center Drive, Oroville; California.
