Lloyd Pickering - (Item determined to be categorically exempt from environmental.
.review) ,Use Permit to allow the expansion of a nonconforming use on property zoned'
kR-MH-1 (Agricultural Residential Mobile Home 1 acre parcels) located on the
west side of Lincoln Blvd., approximately 1,450 feet north of Messina Avenue;
identified as AP 026-050-040, Palermo.
The Commissioner waived the reading of the Staff Findings.
The hearing was opt aed to the public.
Mr. Pickering said he is trying ',o expand his building to add another 900 square feet: He �
said the new building section would be 2 ft. higher than the old building to allow for the
installation of Gar racks. He said the staff analysis says he will not be able to work in the
new section, and this is not the case.
Commissioner Matson said the use of the building is not in the conditions.
Mr. Pickering discussed the problems with flower planters being put in the front yard for
landscaping. He said he would like to pave the whole area. He said the pavement would
make for better access and parking;
Staff said the off-street parking regulations require that open parking areas for more than
4 spaces have landscaping.
Commissioner Lynch said if there is a problem with people finding the business, this might
be handled with a small sign:
Mr. Pickering said his ,problem is on approach from the north, not the south. 144 Eaid the
planters would make it difficult for delivery trucks to turn into the lot.
Commissioner Lynch noted that one of the problems is that property to the north of this
property was granted a use permit and that use permit required landscaping. tie said it
would not be possible to drop the requirement for this use permit.
Chairman Forbes suggested the condition refer to the section of the code, rather than saying
where the landscaping will occur.
The hearing was closed=
Commissioner Lynch asked. if changing the landscaping requirement would change the size
of the building. Staff said no, but the number of parking spaces is contingent upon the size
of the building; and number of employees.

ANALYSIS:
This project is a request for a Use Permit to allow the expansion of a nonconforming use as
required by Section 24-37.4 of the Butte .County Code. It is proposed to expand an existing 40
foot b 30 foot butler utler building by approximately 30 feet to an overall size of 70 feet by 30 feet.
The building has been occupied since October of 1976 by Lloyd Pick,ering's Auto Repair business.
Lloyd's Auto Repair was established under the A-2 zoning in 1976 which was a legal use under
that zoning classification.

When considering a Use Permit for a nonconforming use, the Planning Commission shall grant
the Use Permit when it finds that the change, expansion, enlargement, extension, reconstruction,
or structural alterations of such uses will not conflict with, impair, or be detrimental to the uses
both permitted and conditional of the zone in which it is located and/or adjoins. This finding
shall be made in addition to the findings required by Section 2447 of the Butte County Zoning
Ordinance. Pursuant to Section 24-43; the Planninq, Commission may impose conditions upon
the issuance of 'the `Lise Permit which are reasmiably related to the use of the property for which
the Use Permit is requested In addition, ti'ie Planning Commission may at its own discretion
establish a date for either the terminator, of the use or review of the Use Permit. Whenever
a nonconforming use has been changed to conform to the uses, standards, and regulations of the

If applicant is not the owner, written authorization by the owner' or other proof of agency must
be submitted in order for the applicant to legally sign the application. Applicationshall be
considered void if not signed by the owner or legal agent.

conditions set forth below: Lloyd Pickering is hereby granted a Use Permit in accordance
with application filed: August 15, 1990 to allow the expansion of a non-conforming use, on

revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.

3. If any use for which a use permit has been granted is not established within

the permit shall, become null' and void and reapplication and a new permit
shall' be required to W.ablish the use.
The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee;
