EXISTING ZONING: AR -MH -1 ZONING 'HISTORY: Zoned AR -MR -1 by Ordinance No. 2393 on February 28th, 1984. SURROUNDING ZONING; AR -MH -1 SURROUNDING LAND USE: Commercial to the south; residential to the east and north, vacant land to the west, SITE HISTORY: parcel has had it light industrial type of use on it since at 'Least 1978. Butte County Department of Public Works: " Project is in flood plain and driveway must meet County standards." .Butte County Department of Environmental 1h-110- "Ne requirements for this project." ANALYSIS: I This is a Use Permit request to allow the expansion of a pre-existing, non -conforming use to allow two additional storage structures: The current use on site is the fabrication of stainless steel food processing equipment for various food processors in the northern California area, There are five full time and one part time employees. The entire manufacturing operation is done within the existing structure. There, is some cutting and grinding of metal, however, it is intermittent And noise is not severe. The noise from the operation that can be heard outside the building is co-tisiderable less than the noise from traffic on Lincoln Boulevard. The closest residential use is approximately 250 feet away. There are only four homes within a 600 foot radius of the proposed structure. The applicant proposes to construct 2 storage structures totaling approximately 8400 square feet. The construction will be in 2 phases. Phase one will consist of a 2035 square foot building to be located to the rear of the main structure that exists on site. Phase two is a proposed 6300 square foot building to be placed along the southerly property boundary. Both will be of steel construction and will be used to house material and equipment. The Planning Commission granted Mr. Kee a Use Permit to expand his use in November of 1989. The approval was for an addition to his workshop structure. The addition has been constructed and is in use and it appears that all the conditions of the previous Use Permit have been complied with May be #2. There still for #1 and except I ll is quite an accumulation of machine parts and material on site. Condition Ion 01 of the previous Use Permit required that all junk not associated with the biisiness be removed from the property. The food drums are gone but it is not known if all the junk on site is business related. Condition two required all materials to be kept a sight observing fence or shrubbery barrier; Mr, Kee has planted oleander bushes along.the Lincoln Boulevard frontage e on 9' to to' centers. The plants 0 .9 are approximately 2' high. it is doubtful that they will provide the desired effect duo to the distance between. the plants and the lack of a watering system, Additional shrubs should b I e planted between the existing plant8 to fill in the large gaps. BUTTE COUNTY PLANNING COMMISSIO]V STAFF FINDINGS - June 4, 1991 From a noise, traffic and general land use standpoint the proposal is not in conflict with the surrounding uses. However, the aesthetics of the property could be improved. All equipment and materials should be moved inside cf the new structures, In the interim, the materials; could be moved behind the main structure and kept in a more organized manner, RECOMMENDATIONS: A. Find that the requirements of CEQA have been completed. and considered in making this decision and adopt a Negative Declaration regarding environmental impacts; and B. Find that the proposed use of the property will not impair the integrity and, character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County, because and; C. Grant a Use Permit to all the expansion of a pre-existing, non -conforming use to allow the addition of 2 storage buildings on APN #026-050-038 (Howard Kee) subject to the following conditions: 1. All junk not associated with the business shall be removed from the property. 2. All equipment and materials not stored within a building shall be kept behind a 6' sight obscuring fence or shrubbery barrier made of evergreen plants spaced at no less than 5' intervals and watered by a drip irrigation system. 3. Upon +completion , of the Phase two building, no outside storage of equipment or materials shall be- allowed. 4. applicant must also comply with 11 other applicable State and local statutes, ordinances and,_ regulations._ n Howard Kee - proposed Negative -Declaration regarding environmental impact and> i Use Permit expansion of a pre-existing nonconforming use to allow two additional storage buildings, on property zoned AR -MH -1 (Agricultural -Residential -Mobile Home.4 acre parcels) located approximately 5 miles south of Oroville, on the west side of Lincoln Blvd. at 6810 Lincoln. Blvd., identified as AP No. 026-050-038, Oroville area. VIDEO TAKEN The Commission waived the reading of the Staff Findings. A video was shown of the project site. The hearing was opened to the public. Howard E. Kee stated he was the owner of the business: He said Condition No. 1 of the Staff Report says, "All junk not associated with the business shall be removed f om the property", and he would like to know who determines whether it is junk or not. He said there is some small junk on the property that is on gondolas in the back of the property which will be moved out of the way when the new storage building is put in. He said the items are not junk to him, but expensive equipment that is necessary to his business. He said when he planted his shrubbery, he contacted a nursery who recommended he place the shrubs 7 feet apart and they are planted exactly 7 feet, 8 inches apart. The nursery also recommended he water the shrubs bi-weekly and that is what he does. He does T _ not believe the drip irrigation system would be a good idea because there are two gates by the shrubs that would necessitate 'him to dig underground to place the system. Commissioner Lynch suggested they could solve the praMem Mr. Kee has with the drip irrigation system by changing the Condition to read, "All equipment and materials not stored within a building shall be kept behind a 6' sight obscuring fence or shrubbery barrier made of evergreen plants spaced at no less that 8' i intervals, and maintained in a living condition". Mr. Kee said that the Staff Report states that in Phase Two, a 6,300 square foot building will be used to house material and equipment.
