Dear Mr. Swanson, On April 27, 1976 Montgomery Ward was informed,of the complaint Mrs. Warren filed with this Agency pertaining to the shower installation at her parents residence at,2487•South Villa, Palermo, CA. I received your letter -in reply dated May 6.-1976 addressed to Mr. D.;Beisel as I hav##been assigned to investigate the matter. Montgomery Ward agreed, utn4 er the terms of the written contract dated January 14, 1976, to remove the existing bathtub -and install a shower unit including the door with 6171'required plumbing needed.•. Work'.commenced on or about January 14, 1976 and the job.was represented as com- plete on or about January 16,•1976. Payment of the $363.67 contract price was made in full. The work was undertaken without the benefit of a k11 :d ag permit: which was not obtained'untii August 23 1976. The building department has not been able to in- spect the work performed since this requires removal of'the shower,unit and ac- cess provided to,the sub -floor area. y The,complaints are as follows: 10. The shower.unit is'3/4" out of plumb. ,2. The shower door does not contain the water in the enc1dalire.. 3. Openings exist at the junction points of the metal at the base portion of the unit. 4. The waste line, where v sable, appears to be 112" in diam Liar whereas, the plumbing code requires 2". '�" 5. No waste vent has been provided. 6. Mrs. Warrenwas informed, prior to the installation, that grab rails could readily be installed on this unit. Unless some form of reinforce-. ment is provided, this does not appear, practical. , At this time, I have no alternative but to'consider the project abandoned and proceed accordingly.
