AP 024-080-079 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Jim Sanderson is hereby granted a Use Permit in accordance with application filed: January 30, 1992, to allow a 1.10 acre homesite segregation and a 4.0 acre agricultural processing plant segregation on property zoned = A-40 located on the -east side -of Larkin Road, Gridley. 1. Failure to comply . with the conditions specified . herein as the basis_ for approval of application and issuance of Permit, -constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 12 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and- shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. SPECIAL CONDITIONS: 1. Deed to the County of Butte 40 feet of right-of-way from the centerline of Larkin Road, 30 feet of right-of-way from the centerline of Fagan Street and a 20 foot radius return at the intersection of Larkin Road and Fagan Street. 2. Construct standard S-18 public road approach at access to property. 3. Create the parcel in accordance with the requirements of the State Subdivision Map Act and Chapter 20 of the Butte County Code. 4. Prior to the division being effective, the owner or owners of the property included in the approved development plan shall execute and cause to be recorded in the 's office of the recorder of Butte County, in a form approved by County Counsel, a restriction binding upon the original owners and their heirs, successors and assigns, which disallows additional dwellings from being located on the property until either of the following conditions occur: a. The property is rezoned to a higher density agricultural zone or a residential zone; or b. At least ten (10) years has elapsed from date of recordation, and the Commission finds circumstances regarding 'said property and other properties in the area have changed sufficiently to reconsider the restriction. (Ord. No. 2167 Section 6, 11/25/80). 5.. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. I- hereby -'-declare under- penalty of perjury that I have read -the foregoing conditions, that they are. in fact the conditions which were imposed upon the granting of 'this use permit, -and ..that I agree to abide fully by said ' conditions. Pursuant to the provisions of the- Zoning Ordinance of the County of Butte and the special conditions set forth. below: Jim Sanderson is hereby granted a Variance in accordance with application filed: January 30, 1992 to the requirements of Section 24- 54 (c2) of the Butte County Code on property zoned A-40 located on the east side of - Larldir -Road, south of Fagan Street, north of Kiefer Road, - Gridley. SPECIAL CONDITIONS: 1. The conditions for this Variance are the same as the Conditions listed on Use Permit No. 92-21. Dated: I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in fact the conditions which were imposed upon the granting of this variance, and that I agree to abide fully by said conditions.
