Dear Ms. Moreno:
Our office has been informed that you are living in an illegal
dwelling on your property, more properly known as AP# 27-14-18,
and are performing work on the property without having t e
proper permits.
Section 26-1 of the Butte County Code states that the County
has adopted the 1976 Edition of the Uniform Building Code.
The Uniform Building Code requires that all persons constructing
buildings within the County of Butte, except for agricultural
buildings, are required to obtain a permit from the County
Building Department. Section 26-6 of the Butte County Code
states that:
"It shall be unlawful for any person, firm,
or corporation to erect, construct, alter,
repair, move, remove, .improve, convert,
demolish or equip any building or structure
in the unincorporated areas of the County
or to cause the same to be done contrary to
or in violation of any of the provisions of
this chapter.
"The use or occupancy of any building in
violation of any of the provisions of this
chapter is hereby declared to be a public
nuisance and may be abated in a manner
provided by law."

Section 1-7 of the Butte County Code provides that a violation
of any provision of the Code constitutes a misdemeanor, or in
the discretion of the District Attorney, be charged as an .
infraction. The penalty for a misdemeanor is punishment by a
fine not exceeding $500.00 or imprisonment. The punishment
for an infraction shall be a fine not to exceed the sum of
$500.00.
You are in violation of Section 24-72(A)(5)(a) of the Butte
County Code as you are living in a travel trailer which is
less than 500 feet in floor area on the above-mentioned
property. Section'24-72(A)(5)(a) of the Butte County Code
reads as follows:
"(A)' Uses permitted:
(2) ...
(3) ...
(4) ...
(5) Mobile homes to house one family
when such mobile home is the only
housing facility located on the
premises, provided the following
conditions are conformed to:
(a) The floor area within the
mobile home shall not be less
than five hundred (500) square
feet."
You are also in violation of Butte County Code Sections 19-3
and 19-5 which read as follows:
Section 19-3:
"It shall be unlawful for any person to maintain,
occupy or use any building not provided with a
sewage disposal system which disposes of sewage` -
in a sanitary manner."
Section 19-5:
"(a) No person shall begin or cause to have begun
construction of any building or any other
sewage disposal system without first
submitting plans of the means of sewage
disposal to the health officer and obtaining
a permit therefor from the health officer.

(b) No person shall construct an auxiliary
sewage disposal system for a building
presently served by a sewage disposal
system.without first submitting plans
of the proposed means of sewage disposal
to the health officer and obtaining a
permit therefor from the health officer.
(c) No person shall extensively alter, repair,
relocate, add to.or replace any existing
sewage disposal system without first
.securing a permit therefor from the
health officer."
You have also violated California Administrative Code Title 25,
Chapter 1, Subchapter 1, Article 5, Sections 60-61, which state
that you must have a kitchen sink, bathtub or shower, lavatory,
water closet, hot and cold running water, and a connection to
an approved sewage disposal system (State Housing Law
Regulations) .
Therefore, you are to immediately cease occupying the travel
trailer, and cease construction or occupancy of any building
constructed without permits, until such time as you obtain the
proper permits.

Dear Board Members::
County policy should be to increase revenue, not to decrease revenue
as. is being done by present county policy. A condition exists which could
discourage law abiding citizens from moving into Butte County and encourage
lawless people to move in because they can circumvent the law by merely
ignoring it.
I moved to Oroville A years' ago to retire, bringing with me what
Butte County needs most, money. I invested $200,9000 in real estate, most
of . whish is in the 32 acres and custom built home where I live. Now,
I have my home up for sale and plan to move from Butte County. The en-
closed photo shows the view I get from my picture window --a two-story
shack built with no permit, which is being uaed as a permanent home and
a back house.
I have tried unsuccessfully for the past 1�g years to get the county
to do something about this. When I built my home in 1978, there was only
one house in a 3,000 acre area. Now people are living in old buses, tents,
illegally constructed shacks, and using back houses.
A similiar situation is still pend' g in the District Attorney's
office. Someone built six houses without permits. Information has-been
in the D. A.'s hands for one year with no action being taken. N
Numerous complaints have been made to the Health Department regarding
filthy conditions in local restaurants with no results.
Since some of these departments are ineffective in enforcing the
existing laws, why not require them to either enforce the laws, or eliminate
these bodies altogether.
The illegal trash that the County has allowed to accumulate in this
area has resulted in depreciating my property and may necessitate my filing
a law suit against the county. I am appalled at the lackadaisical
attitude towards law encorcement in Butte County. Before I decide to go
public on this matter, I would like to know what the County is going to do
about this situation and when?.

Building and Sanitation Violations (AP 27-14-18)
April 22, 1981
Attached are copies of correspondence from the Health Department to
Grant Potter and then to Carol Moreno (Potter sold to Moreno) advising
them of a building constructed without permits and a mobilehome installa
tion without permits on the property on Spur Avenue in Palermo.
The property was again inspected on April 16, 1981, and the two-story
dwelling was "red tagged". The owner stated the building was an "Ag
Building"; however, it was being occupied and the travel.trailer appeared
to be occupied.
Would you please send the usual correspondence advising of violations of
the Building Code, Sanitation Code and zoning requirements.

On February 4, 1981, I contacted you at the above location and advised you that
you were occupying a structure on.the property in violation of the Butte County
Code and -the State -Housing Law Regulations.

1 researched the Butte County Department of Public Works records, and this depart-
ment's records on Fehruary 13, 1981 for any permits issued for construction of the
structure you are occupying, and for a sewage disposal system. None were found.
The Butte County Code., Chapter 19 -.Sewage Disposal, Sections 19-3, and 19-5
PDunder
requires .all buildings to be provided with a sewage disposal system, installed
permit and inspection of the health officer. The State Housing Law Regula-
tions, Title 25, Chapter 1, Subchapter 1, Article 5, Sections 60 and 61, require
la kitchen sink, bathtub or shower, lavatory, watercloset, hot and cold running
water, electrical lighting, and connection to an approved sewage disposal system
in'all dwellings. Since your dwelling unit lacks these facilities., itis con-
sidered substandard and unsafe for human. habitation.
You are hereby ordered to vacate the structure and property within TWENTY. FOUR
(24) HOURS from receipt of this notice and not reoccupy the structure or property
till you comply with the following:
<1-1 Provide two copies of the plans 'for the structure being constructed or re-
modeled on this property to the Butte County Department of Public Works, 7 County
Center Drive, Oroville, California and make application for all required permits.
Obtain a septic tank permit, and a well permit'from this department, or provide
proof of an approved water supply in lieu of the well permit.
Complete construction of t he dwelling unit under permit and inspection of the
•Butte County Department of Public Idorks, and install a sewage disposal system
under permit and inspection. of this department.

Please be advised the travel trailer on the property cannot legally be occupied.
A-5 zoning permits only one dwelling unit per parcel. If.a mobilehome is to be
occupied, it shall not have a floor area of less than five hundred (500) square
feet, and be provided with all required utilities, including sewase disposal
system and domestic water service.
Areinspection will be made for compliance with this notice. If you have any

Dear Mr. & Mrs. Potter:
This department has received compl.aint_s concerning an illegal
privy and occupancy of an.01legal travel trail on property on
Spur Road, Palermo area. The Butte County As'sessor's records
indicate you are owner of the property.
On July 31, 1980 and, August 6, 1980 visits were made by the
undersigned to the property. During those visits it was deter-
mined that a small travel trailer is being occupied'on your
property with no evidence of an approved_se,vrag-e disp_o_sal system
and in violation of zoning laws. PE' -illegal pit prix --1, was al -al -sols
ob_s_esved on the property as well a -s construction of a two story
structu , with no evidence of building permits.
The above'cond'itions are in violation of the Butte County Code,
Chapter 19, Section 19-4, 19-13, Chapter 24, Section 24-72, and
ordinances concerning structures built without permits.
To comply with Sections 19-4, and 19-13, 'remove the illegal pit
privy at once and backfill -the pit. Within FIVE (5) DAYS from
receipt of this notice obtain a septic tank.permit and begin
work on a properly installed sewage disposal system installed
under permit. and inspection of this department. Complete the
irist'allation within THIRTY (30) DAYS from receipt of this notice.
Obtain permits from the Butte County Department of Public Works
for utility connections for a mobilehome, and for the two-story
structure being built on your property.
Section 24=72 required rr:obilehomes installed in A5 zones to have
a. minimum floor area of five -hundred (500) square feet., The
travel trailer now in use does not meet' this requirement. Provide
a proper sized mobilehome.

in addition to the above, you will be required to provide a
potable water supply. This may be from the Oroville-Wyandotte
Irrigation District if the water is properly treated, or from a
private well properly installed on your property under permit
and inspection of this department.
