Section 26-1 of the Butte County Code states that the County has adopted the 1976 Edition of the Uniform Building Code. The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from the County Building Department. Section 26-6 of the Butte County Code states that: "It shall be unlawful for any person, firm, or corporation to erect, construct, alter, repair, move, remove, .improve, convert, demolish or equip any building or structure in the unincorporated areas of the County or to cause the same to be done contrary to or in violation of any of the provisions of this chapter. "The use or occupancy of any building in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in a manner provided by law." p, - Caro_1 Jeanette Moreno Re: Building and Sanitation Violations October 14, 1981 Page "Two Section 1-7 of the Butte County Code provides that a violation of any provision of the Code constitutes a misdemeanor, or in the discretion of the District Attorney, be charged as an . infraction. The penalty for a misdemeanor is punishment by a fine not exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to exceed the sum of $500.00. You are in violation of Section 24-72(A)(5)(a) of the Butte County Code as you are living in a travel trailer which is less than 500 feet in floor area on the above-mentioned property. Section'24-72(A)(5)(a) of the Butte County Code reads as follows: "(A)' Uses permitted: (2) ... (3) ... (4) ... (5) Mobile homes to house one family when such mobile home is the only housing facility located on the premises, provided the following conditions are conformed to: (a) The floor area within the mobile home shall not be less than five hundred (500) square feet." You are also in violation of Butte County Code Sections 19-3 and 19-5 which read as follows: Section 19-3: "It shall be unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage` - in a sanitary manner." Section 19-5: "(a) No person shall begin or cause to have begun construction of any building or any other sewage disposal system without first submitting plans of the means of sewage disposal to the health officer and obtaining a permit therefor from the health officer. Carol Jeanette Moreno Re: Building and Sanitation Violations October 14, 1981 Page Three (b) No person shall construct an auxiliary sewage disposal system for a building presently served by a sewage disposal system.without first submitting plans of the proposed means of sewage disposal to the health officer and obtaining a permit therefor from the health officer. (c) No person shall extensively alter, repair, relocate, add to.or replace any existing sewage disposal system without first .securing a permit therefor from the health officer." You have also violated California Administrative Code Title 25, Chapter 1, Subchapter 1, Article 5, Sections 60-61, which state that you must have a kitchen sink, bathtub or shower, lavatory, water closet, hot and cold running water, and a connection to an approved sewage disposal system (State Housing Law Regulations) . Therefore, you are to immediately cease occupying the travel trailer, and cease construction or occupancy of any building constructed without permits, until such time as you obtain the proper permits. A condition exists which could discourage law abiding citizens from moving into Butte County and encourage lawless people to move in because they can circumvent the law by merely ignoring it. I moved to Oroville A years' ago to retire, bringing with me what Butte County needs most, money. I invested $200,9000 in real estate, most of . whish is in the 32 acres and custom built home where I live. Now, I have my home up for sale and plan to move from Butte County. The en- closed photo shows the view I get from my picture window --a two-story shack built with no permit, which is being uaed as a permanent home and a back house. I have tried unsuccessfully for the past 1�g years to get the county to do something about this. When I built my home in 1978, there was only one house in a 3,000 acre area. Now people are living in old buses, tents, illegally constructed shacks, and using back houses. A similiar situation is still pend' g in the District Attorney's office. Someone built six houses without permits. Information has-been in the D. A.'s hands for one year with no action being taken. N Numerous complaints have been made to the Health Department regarding filthy conditions in local restaurants with no results. Since some of these departments are ineffective in enforcing the existing laws, why not require them to either enforce the laws, or eliminate these bodies altogether. The illegal trash that the County has allowed to accumulate in this area has resulted in depreciating my property and may necessitate my filing a law suit against the county. I am appalled at the lackadaisical attitude towards law encorcement in Butte County. Before I decide to go public on this matter, I would like to know what the County is going to do about this situation and when?. Sincerely, Gene. H. The property was again inspected on April 16, 1981, and the two-story dwelling was "red tagged". The owner stated the building was an "Ag Building"; however, it was being occupied and the travel.trailer appeared to be occupied. Would you please send the usual correspondence advising of violations of the Building Code, Sanitation Code and zoning requirements. Should you have any questions concerning this, please contact me. None were found. The Butte County Code., Chapter 19 -.Sewage Disposal, Sections 19-3, and 19-5 PDunder requires .all buildings to be provided with a sewage disposal system, installed permit and inspection of the health officer. The State Housing Law Regula- tions, Title 25, Chapter 1, Subchapter 1, Article 5, Sections 60 and 61, require la kitchen sink, bathtub or shower, lavatory, watercloset, hot and cold running water, electrical lighting, and connection to an approved sewage disposal system in'all dwellings. The Butte County As'sessor's records indicate you are owner of the property. On July 31, 1980 and, August 6, 1980 visits were made by the undersigned to the property. During those visits it was deter- mined that a small travel trailer is being occupied'on your property with no evidence of an approved_se,vrag-e disp_o_sal system and in violation of zoning laws.
