The Commissioner waived the reading of the Staff Findings. The hearing was opened' to the public. Paul Parris said he had read the staff report. He asked that Condition & be eliminated. He said that Condition 8 would be a strong financial burden on the applicant as he is on a fixed income. Mr. Farris wanted to furnish the County with a letter stating he would be responsible to remove the mobile home when the time came In lieu of the County requiring a deposit or bond. Staff said it has been the Cormnission's policy to get financial ,assurance of removal of the mobile home. Robert Adams said that both he and his son are on limited incomes and could not afford the bored or deposit. The hearing was closed. Chairman Lambert said the Commission has been diligent about retaining this condition for a bond or deposit. She said the County needs to have assurance for removal of the mobile home when the use is no longer needed. Mr. Farris said he would give his business guarantee that the mobile would be removed when the need is over. Commissioner Lynch asked if a contractual agreement would be the equivalent of a bond. Staff said they would have to coInsul,t County Counselo staff was ooncerned with a long term guarantee should anything happen to the business. commissioner Lynch suggested they adjust Condition 8 for either the contract or the bond if the contract is acceptable with County Cour %,,el Chairman Lambert said the Commission could approve the permit as it is and allow t -he applicant to talk to County Counsel: She was reluctant to remove the condition altogether. Commissioner Lytach was concerned with the removal of the mobile home at the owners expense no matter how it is done, He said the commission has an offer, by a businessman, to enter into an agreement to remove the unit when the time comes. The application clearly meets the intent of the temporary mobile home ordinance. Temporary mobile homes also come under County Code Section 24-47 concerning the issuance of Use Permits. Butte County Code Section 24-304 provides for removal. of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to ensure that the taxpayers at large (via the General. Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this .mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home; then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant: A survey of several mobile home dealerships in 'Butte County has indicated a rather wide range of - estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks; awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative' costs and storage costs, it appears that a reasonable deposit would be $1,500 per. single -wide and $2,000 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers: The applicant proposes to place a double -wide mobile home on the property so a $2000.00 bond would be accessed This project is Categorically Exempt from environmental review and the requirements of the California Environmental Quality Act in accordance to Section 15303 Class 3 (a) of the Public Resources Code.
