V Inter Departmental Memorandum, TO: Butte County Advisory Agency FROM4 Planning Director SLJBJECT Report on Tentative 'Parcel Map for Leroy hieler, AP No. 027480-022 PATE I-ebruary 18, 1992 This is a proposal too divide 20 + acres to create 4 five acre parcels. The present zoning is A46 (Agriculturaij S acre parcels). The Land Use Plan Map of the Butte County General. Plan designates this area as ,Agricultural .R.esidential: The area was zoned A- 5 on January 27, 1970• 'This was prior to the current General plan policies which were adopted in 1979. These policies require analysis of five "conditional criteria" factors prior to land being divided or zoned- for 20 acres or less. The five criterion and staffs responseate,as follows: 1: Compatible ;with neighboririg agricultural activities. Response: Flo agricultural activities occur. 2. Evidence of adequate water and selvage disposal capacity. - Response: County Environmental Health has given clearance: 3. Availability of adequate fire protection. facilities. Response: Poor actuoSs, but fire sprinklers will Help reduce impacts. 4. ,adequately maint,mn .a •approved road access with sufficient capacity to service area; Response: Road ticcess ,° quesfionable. 5 Reasonable accessibility to commercial services and schools. espy Ite3sonabl . access to these sere `kes are questionable, nse. Even though the General Plan Conformance Report does not identify any conflicts; after further detailed ;analysis, this project appears to corinia 'with conditions 3, 4, and, 5. In ad4ition, the property 1.0 the north and east consists. of 20 acre parcel sizes. A lteprne to .A20 has bef;n approVed for the property immediately east of this site. One final point of consiciera'tion i that the properties to the south, and Nest receivod 5 ,acre nitely in a transiition area mbclivision approvals in 1985 anal 1986. This land 'Is; defi between 5 and 20 acre parcel sizes, and arguments can be justified for either size. Since somewhat of a precedent has been established for S acre parcels, staff is recommending approval of the request subject to the attached condition of approval and mitigation measures; -Mit i ation Measures 1. Place a note on the additional map sheet that states, "Fire suppression sprinkler systems shall by installed in all residential structuresin accordance with the National Fire Protection. Association. Standard for the installlation of sprinkler systerYts in one and two family dweifings and mobile homes, WF`A Standard 13 D., The purpose of the installation of squrinkler systems is for 'additional safety and. Pror property protection otection in the event of residential fires. 'This imstlaliation will reduce the demand for structural fire protection services in those instances ,where they are installed". 2, The Final Map shall include a 1.00 foot "leo Development" setback zone from the high water line of Wyandotte Creek: conditions ]► developrne,t impact fee for Sheriff Facilities shall bt paid pnesant p Chapter 3 Article fI of the Butte County Code, prior to issuat;ce +5f ,building P 'Cha to provisions i i t home park. Three species are known from the: same geographic region of Butte County, *and an additional two gecirjs from. an adjacent geograpluc region of the county (see x, fable). Thus at least five dant species of concern coulld be expected to occur on this ,. site with a moderately high probability. f The Appendix contains a list of the vascular plant species identified on the site during the fall survey. Most of the species are found throughout the property, or occur Occasionally in the gt•asslandloak savannah habitat. 'Those species restricted to certain ,specialized habitats (e.g., drainages or other wet places) are so indicated. Non-native species are also specified. SURVEY METHOD The property was. searched on foot by Barbara Castro on Novermbe.r 22, 1991,L during the period when leaves were still present on the deciduous oaks in this vicinity; so that oak trees could be identified to species. (However, this was not the season where each of the plant species of concern in 'fable 7would be flowering or otherwise identifiable by distinctive vegetative or fruiting parts. This will be accomplished in late March or early April and again in early May; 1912:) This fall visit was chiefly for the purpose of identyin the lant communities on the property to see if there Pere substantial nttal oak I d g p a woo lands or riparian communities which would need s ectal managgement ti pTh s visit also served to deterrrdne whether. the habitats or any recommendations, plants of concern are present on the property and thus narrow down the number of species and. parts of the property necessary to address in the spring survey. RESULTS An open to somewhat dense savannah of Blue oaks (Queectts douglasii) was found on almost the entire property exccpt for two areas of open annual grassland (see Fmare 2). While not raze in California, this community shares a status 'of concern with I oCr oak woodlands in California, none of which are repproducing themselves. ,Indeed, on this property there were virtually no juvenile or seedling oaks. iThis lack of c udm livestock • t nl. e ens of human activity, F _ > as caused concern far inane m yr . including livestock regeneration h g . y _ grazing, within oak communities, and has given rise to research and advisory groups such, as the Integrated Hardwood Range Mana ement Program of the University d. This will be possible after completion of the Spring 1992 survey= As rioted in the introductory description of the project site, the oak savannah ureas have already been somewhat impacted by vehicle travel mons the these slopes. oPast grazing may have also contributed to the lack of regeneration among lowee r, m most of the values of the oak woodland and its as, vegetation (grassy iinderstary) retnahns, potential impacts frarn ment of the site could continue the a—'elop degradation of this resource. This would represent an incremental depletion of the already struggling oak in California. Since the perennial Wyandotte Creek traverses a substantial portion of the _ tele ment and subsequent intensified human activity could ion ege the property, dei values of the creek by erosion oft e banks (that is, in areas where rocks ddorea not Y or down to the water's edge), b dumping of pollutants, `by filling in, t erwhse alterin the creek bed, and by rerrt, vtng vegetation necessary for stabilizing otti g the islands and stream edges. Butte County Planning Department has reviewed the second submittal for the above mentiotied application. This department has detenrined that the application is still incomplete due to the following reasons 1> The second, map submitted does not contain appropriate contour, Alevat`nons. Only the 300' contour is labeled: ?. The State .Department of Fish and Ga.n,e has requested that "a botanical, survey be provided to adequately assess the impacts of this prgject. This department also requests that a 50 foot no-disturbance setbd4r. be provided along"both sides of stream chancels. They also express extreme concern with the preservation o£ Oak woodland habitats and request protection measures A response to these two' issues will be required and should be addressed in the botanical. survey. t `} As' ,teque3ted in the previous letter, this proposal appears not to comply with several policies tf the General Flan. Therefore, staff does not hilly support the division of the parcel into .five (5) acre lots,, I trtr John Mendonsa Department of Public Works, 7 County Center Drive broville, California 95965 Debar Mr. Mendonsas The Department of Fish and Game (DFG) has reviewed the Leroy Schieler Tentative Parcel Map (TPM), a proposal to divide A.P' 27-18-22` of 20+ acres into four, 5+ acre parcels. Located east of Palermo, the parcel 1.8 covered by an oak woodland habitat, To protect the oak woodland habitat; the DFG recommends that the following be made conditions of TPM approval: 1 Establish a no disturbance buffer zone, commencing from..the outer edge of the canopy, outward one-half of the canopy radius, aroutd each oak. No disturbance includes irrigation. and root damaging acti vities k Retain all snags except those which pose a direct safety hazard. F 3 No pruning or cutting of oaks except for safety purposes. Deciduous oaks should be pruned during the winter dormant season only and ;evergreen oaks during July - August only. The other vegetAtion types on-site provide biodiversity elements necessary to support local wildlife: The DIFG recommends the maximum feasible retention of all, native vegetation This project will have an impact to fish and/or wildlife habitat. Assessment of fees under Public. ResourcesCode Section, .21089 and as defined by Fish and Game Code aSection 71'1,4 is necessary. Fees are payable by the project applicant upon filing of the Notice of Determination by the lead agency'. We have found that this incl ease in population is severly affecting our ability to provide a sufficient level of services to our constituency. This partictilar Subdivision is of small size, being four parcels* and we feel there is an impact to our District from this project . We need to do something abort this increasing probls:n before it becomes a crisis environment.
