Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Alvin Graham is hereby granted a Use Permit for the establishment
of two residential dwellings and related accessory structures in the C-1 (Light Commercial) zone
on APN 028-072-014 on the northwest corner of Palermo-Honcut Highway and Lower Honcut
Road, in Honcut.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Use Permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within two years of the date of
approval.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee. Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4. If any use for which a Use Permit has been granted is not established within two years of
the receipt of the Permit by the Permittee, the Permit shall become null and void and
reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to
establish the use -previously granted under the expired Permit unless, 30 days prior to the
expiration . date, a request for a one year extension is submitted to the Planning
Commission together with sufficient evidence that the time limits for processing
development permits under federal or state regulations require time limits which exceed
one year. Upori application, and for good cause by the Permittee, at a public hearing
pursuant to Section 24-45.25 above, the Planning Commission may extend any time
limitation previously made a part of any condition to a Use Permit.
5. The terms and conditions of this Permit shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development

Services to commence a revocation hearing, and, if proven to exist, shall constitute
sufficient grounds to revoke a Permit.
I. CONDITIONS OF APPROVAL:
Planning Division:
1. Applicant must apply for and have approved a Merger application to merge six
underlying lots into two lots prior to issuance of any building permit on the property.
2. The residential dwellings and accessory structures must meet standard building setback
requirements for the R-1 Single Family zone. This is 5 -feet on the side and 15 -feet on the
rear property lines. Setback from Lower Honcut Road is 25 feet.
3. Applicant must also comply with all other applicable State and local statutes, ordinances,
and regulations.
4. All outstanding application processing fees shall be paid prior to issuance of the Use
Permit.
Public Works
5. Prior to the issuance of use permit, obtain an encroachment permit and improve all new
and existing driveway approaches to publicly maintained roads as specified in the County
Improvement Standards and the terms of the encroachment permit.
6. Prior to the issuance of use permit, deed to Butte County in fee simple 50 feet of right-of-
way from the centerline of Palermo Honcut Highway and 40 feet from the centerline
Lower Honcut Road along the entire property frontage. The right-of-way centerline for
this dedication shall be the centerline as shown on the official map of the Town of
Honcut (7M85).
7. Prior to the issuance of use permit, submit road and drainage improvement plans for the
installation andconstruction of the street frontage improvements on Lower Honcut Road
and Palermo Honcut Highway to RS -3A County Improvement Standards. Improve
resultant 2 merged parcel frontages to a'/2+ 12' street section on Lower Honcut Road and
Palermo Honcut Highway to an RS -3A road standard including, 3" AC, and 12" AB,
prime coat, fog seal and 95 % relative compaction. Submit design to Land Development
Division for approval prior to construction. "R" value determination and other data may
be required to support the section design. Construct or install the required improvements.
8. Prior to the issuance of use permit, a plan for a permanent solution for drainage shall be
submitted to and approved by the Department of Public Works. The drainage plans shall
detail existing drainage conditions and shall specify how drainage waters shall be
detained or retained on- site and/ or conveyed to the nearest natural or publicly
maintained drainage channel or facility and shall provide that there shall be no increase in
the peak flow runoff to said channel or facility.

9. Fire suppression sprinkler systems shall be. installed in all new residential structures in
accordance with the National Fire Protection Association Standard for the installation of
sprinkler systems in one and two family dwellings and mobile homes, NFPA Standard
13D, unless a pressurized community water system, with hydrants that meet Fire
Department specifications, serves the parcels. This condition is to be added to all
building plans.

10. Any relocation or rearrangement of any existing PG&E facilities in the area to
accommodate this project will beat the expense of the developer.
11. There shall be no building of structures, or the storage of materials allowed over or under
any existing PG&E facilities, or inside any easements that exist which would infringe on
PG&E easement rights.
County Counsel
12. If this entire matter or any finding, action or condition of this matter is appealed to the
Board of Supervisors, the applicant or any other developer/operator other than the
applicant agrees to defend, indemnify and hold the County of Butte harmless from
liability or loss related to the approval of this project and agrees to sign an
indemnification agreement in a form approved by County Counsel before the Board's
appeal hearing. If the application is not appealed, this condition is deemed satisfied.
I hereby declare under penalty of perjury that I have read the foregoing conditions that

This department has completed our pre -application review to determine if it is possible to place a
dwelling on the above-mentioned property, which is in a commercial zone. There is adequate
area for a sewage disposal system and replacement area as shown in the plot plan submitted with
the application.
Provided that the application and map presented to the Development Services Department
conforms to the map submitted to our office we are prepared to approve the Use Permit.
You should be aware that other agencies will review this proposal when it is submitted to
Developmental Services. These other agencies may have conditions that would significantly alter
your project to the extent that we may need to change our conditions. Our tentative approval of
this pre -application must not be interpreted as approval by the County for this proposal. The
entire formal review procedure must still be completed through the Developmental Services
Department.

1. De -energize electrical wiring system of the mobilehome at the pedestal.
2. Make sure. that the power supply cord or feeder assembly conductors, including neutral
conductor, have been disconnected,
3. Switch all breakers and switches in.th.e'mobilehome to the "on" position.
4. Connect one lead of a test instrument to the mobilehome grounding conductor and
apply the other lead to each mobilehome supply conductor, including neutral.
5. All non-current, carrying metal parts of the mobilehome (aluminum siding, gas line,
water line); including fixtures and appliances, shall be tested for continui.ty,from
such equipment and the grounding conductor.
6. Upon completion of the above procedure., the power supply cord or feeder assembly
conductors shall be connected to the site service equipment. A further continuity
test,shall then be made between the grounding electrode and the chassis of the
mobilehome. Upon satisfactory completion of the electrical tests, the lot or site
service equipment may be approved for energizing.
