Since the TPM is within a Designated Development Zone, the .DFG does not object to the land division provided that the following mitigation measures are imposed as conditions of approval on the Final parcel Map: 1. Assessment of deer habitat improvement fees 2. Fencing to meet approved standards. Oak woodlands are a particularly impotant habitat because they provide most of the essential life sustaining requirements food,' shelter, nesting and roosting sites) needed by .numerous animal species.- There has been significant cumulative? losses of oak woodlands in California due to residential, commercial, and other development projects. To mitigate the project impacts on oak woodlands; these.restrictions are needed; 1: No oak tree removal except for that required to i provide space for buildings and associated accessories and to meet health and safety standards. 26 Fstablisk a no distutbanee setbackl commencing from the outer edge of the oa}. tree canopy and extending outward a distance equal to one-half of the canopy radius, around each tree. Pursuant to Public Resources Code Sections 21052 and 21092.2, the DDG :requests written notification of ,proposed ' actions and_ pending decisions regarding this project. Mitten notifications should be directed to this office. This project will have an impact to fish and/or, Wildlife habitat. Assessment of fees under Public Resources Code Section 21080 and as defined by Fish and Game Code Section 711.4 is necessary. This particular subdivision is of a small size, being two parcels, and we feel there is an impact to Our District from this project. We need to do something about this increasing problem before it becomes a crisis environment. We believe-that this steady increase is good for the area and that; Ni,- can alleviate the impact on the District through de odopor fees and for the larger subdivision:, the creUion of Lighting and Landscape Districts. Svc, believe that the Planning Department _should recommend to the Planning Commission and. the Planning Commission should recommend to .the Board of Supervisors that deveioper fees be established for the Feather River .Recreation and Park District and the other ?special districts which are affected by this increased population growth. For the present and th < Richard Mattingly project, we feel that an Pvuitable settlement should be made to the Feather River Recreation and Park District for the it %ttse in population which this will 'bring, Thank, .you: 8hicerely,, od. eyandSecretaryto the Board of Directors RW/js COUNTY OF BUTTE DEPARTi"i[ VT OF PUBLIC WORKB 9; 7 County Center Drive Ck 95565 1916) 538•-7266 October 22, 1991 RE: AP 28-12-25 Richard Mattingly Tentative parcel Map P.O.
