Dear Mike:
The Ott Parcel Map was approved with the condition to
deer herd mitigation fees at the time of final map pY
recordation and future building permits, Deer herd fees
were recommended by the Department of Fish and Gdwe to
Off -set habitat losses through habitat enhancement
practices on large parcels. The doer hord issue is a
complicated one, which nee6s to be resolved jointly between
the Department of Fish and. Game and Butte County Board of
Supervisors. Until a mutually agreeable solution has been
reached, and the Board of Supervisors adopts necessary
resolutions and ordinances, the staff is unable to accept
deer nerd fees
The Ott Parcel Map was one of the first to be approved with
a condition for foes, Subsequent maps required the fees, to
be paid only if the Board of Supervisors had ariopI rare a
appropriate Ordinance. As the conditioiz is nOW written, you
are unable to meet it, As such, the Condition is invalid
and 'Will be removed from the map. Recirculation to Advisory
Agency will not be nece88ary
Concerning Note 100 Door herd fees may or may not be adopted
prior to issuance of building permit: on this maps It
is

The project was formerly a subdivision but has been revised
to a parcel map of approximately 20 acre parcels. Mr. Ott has

A letter has been received from Fish & Game which warrants
reconsideration of the Planning Director's Report of 2/10/6.
Fish & Game states, "This proposal is an example of residential
encroachment into critical winter range which is causing serious
direct and indirect adverse impacts on the Mooretown herd, Such
adverse impacts are especially pronounced in the Swe.es Flat
area." They also indicate that the TPM would block a_deer
migration window. Blockage of a window is considered a cumu-
lative impact under CEQA. Cumulative impacts are significant
[15065(c)]. Interference with the movement of resident or
migratory wildlife is a significant impact (CEQA Guidelines,
Appendix G). Significant impacts require preparation of an 8IR
(15065).
Recommendation:

The Department of Fish and Game has reviewed the, Tentative Subdivison Map
(TSM) for Terry Ott, a proposal to subdivide 82± acres, into 10 lots ranging
from 5 to 13.5 acres in size. The TSM site is located approximately 2 miles
east of Swede's Flat and is designated in the General Plan as "Agricultural -
Residential" and is zoned A-5 (5 acre minimum), it is within an area designated
os critical winter range for the Mooretown deer herd.
The proposed subdivision is on example of encroachment into critical deer
hinter range which Will cause Substantial and avoidable adverseimpacts on
migratory deer in Butte County: 7n addition to loss of critical habitat, the
project along with other land divisions nearby would pose a barrier to deer
migration: In the opinion of this department, the project should be .denied,
