Defendant Halsted has never paid taxes on said property. Defendant did build a building on the property described in paragraph 4. 8.Plaintiff is ignorant of the true names of Defendants Does I through 10 and therefore sues these defendants by fictitious names under Section 474 of the Code of Civil Procedure. Plaintiff' believes Defendant Does 110 are in some manner responsible for the events alleged in the complaint. 9.Plaintiff alleges on information and belief that at all times referred to in this complaint all defendants were the agents of each other and during all times they acted within the scope of their agency, with the named defendant's knowledge and consent. 1a 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 10.On or about May 29,1991, approximately 28 days after recording their deed, Defendant Halsted and his wife applied for an Agricultural Building Exemption permit from the County of Butte to construct a barn 30 feet by 30 feet framed in steel .with plywood siding, metal roof, concrete floor at an estimated cost of $8,000, for storage of tractors and hay. I l.On or about May 29,1991 Defendants Halsteds began construction or caused to have constructed a building approximately 40 feet by 60 feet framed in wood, with plywood siding, wood roof, and concrete floor on the Easterly boundary of Defendant Halsteds' parcel and adjoining the Westerly boundary of Parcel 2 of Plaintiffs property. 12.On or about September 1,1991, Defendant Halsted transferred his existing automobile repair business from 1944 Roibnson NO Road, Bangor to the newly constructed building described in paragraph 11. 13. On or about September 1,1993, Plaintiff and her husband hired Ron Graves, a licensed surveyor, to mark the Westerly property line of Parcel 2 of their property and described in paragraph 4.; K. On or about September 1, 1993 Ron Graves informed Plaintiff and her husband that approximately 2/3 of the Defendants Halsted's building was located on their property. Defendant Halsted was notified the following day of the surveyor's findings. 15.Plaintiff, her husband and Defendant Halsted decided to resolve the problem by agreei to exchange equal amounts of land. 16. Defendant hired surveyor, Ron Graves to draw. up a modification to the property lines whereby both parties could exchange equal amounts of land, and based upon the agreement cited ii paragraph 15. 17. On or about October 1, 1993 after the modification was completed Defendant Halsted ref ised.to complete the agreement, He told Plaintiff and her husband he believed he owned that portion of their land running in a North and South direction along the Westerly side of the old fence located on their property, and adjoining his Easterly boundary. 18.On or about March 23,1994, Plaintiff and her husband became aware the building Defendant Halsted had contracted or caused to have constructed was not the type of building for 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 which he received a permit for from the County of Butte, nor did the permit allow Defendant Halsted to operate an automobile repair business because the property is zoned for agriculture. FIRST CAUSE OF ACTION Quiet Title Action (Against all Defendants) 19. Plaintiffs re -allege paragraphs 1-18, above and incorporate them by reference. 20.Plaintifi's husband died April 22,1994, and Plaintiff filed an Affidavit of Death of Joint Tenant putting property described in paragragh 4 in her name alone. 21 -Defendant Halsted's building is situated on a portion of Plaintiffs property described in paragraph 4 above. 22. Defendant Halsted's claim and the claim of all defendants are unfounded. Defendants have no valid interest of any kind in the property. 23. Plaintiff seeks to quiet title as of the date of this complaint. The foregoing facts entitle Plaintiff to title to the property in fee simple. 24. Plaintiff seeks a declaration as of the date of the Tiling of this complaint, that she holds title to the property described in paragraph 4 free and clear of all other claims of all other persons or entities , known or unknown ; that Plaintiff is entitled to possession of the entire properly described in paragraph 4 ; that defendants and each of them have no interest in the property and that defendants and each of them be forever enjoined from asserting any interest in the property. 25. Defendants' claim of ownership has injured Plaintiff and if left outstanding will continue to injure Plaintiff by preventing her peaceful enjoyment and use of her property, by subjecting her to the useless adverse claims of third parties, to emotional distress, the burden and expense of protecting her lawful title to the property and to possible lawsuits resulting from Defendant Halsted's automobile repair business and from possible suits by the County of Butte for operating a automobile repair business on agricultural property. Plaintiff re -alleges paragraphs 1-18 and and incorporate them by reference. 27 Defendant Halsted is, and all times herein mentioned was the owner in fee simple and possession and control of that real property described in paragraph 5. 28.Plaintiffs property described in paragraph 4 and Defendants' property ,described in paragraph 5 adjoin one another on the Westerly line of parcel 2 of Plaintiff's property and [lie Easterly line of Defendant's property. 29. Defendant claims some right, title, estate, lien or interest in and to the lands of Plai described in paragraph 4, or a portion thereof, and dispute and deny the true and correct boundary line between their respective properties and claim ownership of an unspecified portion o. Plaintiffs property. Defendants' claim or claims are without any right, title , estate, lien or interest whatever in the real property described in paragraph 4 or any part thereof. 30.Defendants' claim to own some unspecified portion of Plaintiff's property has injured Plaintiff and if left outstanding will continue to injure her by preventing her ftorn peacefully enjoying and using her property, and by subjecting her the burden of protecting her lawful title to the property. 31. Plaintiff prays the boundary line between the property described in paragraph 4 and Defendants' property be determined to be that set forth by the surveyor on or about September 1, 1993. THIRD CAUSE OF ACTION (Negligent Infliction .of Emotional Distress) (Against Michael Halsted) 32.Plaintiff re -alleges paragraphs 1-18, 21,25 and 29and incorporates them by reference. 33. Plaintiff is informed and believes and thereon allege Defendant Halsted carelessly, recklessly and unlawfully interfered with Plaintiffs title by constructing or causing to be a building upon Plaintiffs land without Plaintiffs consent or approval.. 34. Defendant Halsted could have readily located his property corners by requesting a surveyor to mark the corners prior to construction. Defendant Halsted continues to allege ownership of Plaintiffs property despite being advised of the correct location of the corners by the licensed surveyor hired by Plaintiff: 36. Defendant Halsted continues to operate an automobile repair shop on Plai in total disregard of Plaintiffs claim and continues to use Plaintiffs property against her wishes. 37. As a direct and proximate result of the acts of Defendant Halsted ,Plaintiff has sufff emotional emotional distress in that Plaintiff has suffered from loss of sleep, anxiety over the possibility of losing her property, worry over the health of her husband who was hospitalized.for hi heart condition during the course of this dispute and later died, and apprehension anis distress over the continuing emotional and financial drain of suing to quiet title to her property and she remains anxious and troubled..By reason thereof, the Plaintiff has suffered injuries in an amount to be proven at trial. FOURTH CAUSE OF ACTION (Intentional Infliction of Emotional Distress) (Against MICHAEL HALSTED) 38. Plaintiffs re -allege paragraphs 148,20-21,25,and 29,33-37 above and incorporate them by reference. 39.On or about November 1993, Defendant HALSTED told Plaintiff lie would not exchange property 'as previously agreed, claiming he owned the entire strip of land, approximately 100 feet wide and 700 feet long, the upper part of which consists of road frontage, and upon which he had built or caused to be built a building to operate his automobile repair business. Since that date the Defendant Halsted has used Plaintiffs property against her wishes. 40. Since Plaintiffs property is zoned agricultural, Defendant Halsted's business is in direct violation of Butte County Zoning Code. Because Defendant Halsted is operating his business on Plaintiffs property, Plaintiff through no fault of her own, has a business operating on their properti in direct violation of code.Plaintiff' is subject to all fines, penalties, etc, which the County of Butte could impose.for such violations:; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 41 Defendant Halsted is or should be aware he built upon Plauitiff% land without her permission and without permission from the County of Butte. 42 -Since Defendant Halsted's building ,is constructed on Plaintiffs property, Plaintiff cou be liable should Defendant Halsted be sued in the event of an injury in or about his automobile shop. 43. Plaintiff is informed and believes and thereon alleges that Defendant I IALSTED was aware at the time he committed the above acts that Plaintiffs husband,' Jamcs Philpott had heart and lung problems, and that Plaintiff would suffer anxiety over her husband , of not being able to use her property as intended and the possibility of losing it, loss of sleep, and apprehension and distress at having to file suit to quiet title to the property. 44.'The acts of Defendant HALSTED were outrageous and were done with the intent of causing ,and in conscious and reckless disregard of causing ,Plaintiff to suffer severe mental and emotional distress 45. As a direct and proximate result of the acts of Defendant Halsted, Plaintiff has sufferc, and will continue to suf er,extreme emotional distress, severe mental anguish, embarrassment, worry and anxiety all to her damage in an amount to be proven at trial. 46. The acts of Defendant HALSTED were intentional, malicious, oppressive and in conscious disregard of the rights and safety of Plaintiff and were done with the intent to vex, injur and worry Plaintiff, thereby justifying an award of punitive damages in an amount to be ascertains at time of trial. FIFTH CAUSE OFA TION (Negligent Interference with Title to Property) (Against Defendant HALSTED) 47. Plaintiffrealleges paragraphs 1-18,29,30,33,34, and 35 above and incorporates them by reference. 48. As direct and proximate result of the acts of Defendant HAI.STED, Plaintiff was and i� hindered and impaired in the peaceful enjoyment of her property, the marketability of Plaintiff's tiff has been damaged, and Plaintiffs has been forced to engage attorneys and institute litigati6n so as to recover her property and protect her tide. Plaintiff has as a direct and proximate result therefrom, suffered and continue to suffer, extreme and severe anguish, embarrassment, humiliation, anxiety, and emotional and mental distress and she has been rendered ill, disordered and troubled by reason thereof„ in an amount to be proven at trial. 50. As a further direct and proximate result of the acts of Defendant IIALSTED, Plaintiff has been deprived of right title to her property,and of the quiet enjoyment of her property all to he damage in an amount according to proof at trial. 51.Plaintiff has been damaged in an amount within the jurisdictional limits of this court. SIXTH CAUSE OF ACTION (Intentional Interference with Title to Property) (Against Defendant HALSTED) 52. Plaintiff realleges paragraphs 1-18,29,30,33-35,49and50 above and incorporates -them reference. 53. Plaintiff is informed and believes and thereon alleges that Defendant HALSTED intentionally interfered with Plaintiffs title to her property so as to cause Plaintiff to suffer injuries and damages by among other things, claiming to own a portion of Plaintiffs property despite being made aware by the. surveyer that the property in question was owned by Plaintiff's„ by continuing to use the property against Plaintiffs wishes, and otherwise conducting himself so as to interfere with Plaintiffs peaceful and quiet enjoyment of her property, and from using Plaintiffsproperty as she had desired. 54. Defendants are now in possession of a portion of that real property described in paragraph 4 above without Plaintiffs permission and against her will since on or about May 29,1991. 58. On or about September 1,1993, Defendant HALSTED was informed by Plaintiff and h; Ron Craves, a licensed surveyor ,that his building encroached upon Plaintiff's land. 59. On or about September 1993, Plaintiff', her husband and Defendant Halsted agreed to exchange equal amounts of land, thus giving Defendant Halsted road frontage property in exchange for some.property of a lesser value. Defendant Halsted later refused to perform the agreement. 60. Plaintiff has been damaged and will continue to be damaged as long as the business and the building remain on her property in an amount to be determined at trial. EIGHTH CAUSE OF ACTION (For Injunctive Relief Against Trespass) Against all Defendants) 64. At all times mentioned herein, and at the commencement of this action, Plaintiff has been, and now is, in possession of that certain real property described in paragraph 4.PlaintifPs residence is located on parcel 1. 66..On or about July 23,1986 Plaintiff, and her husband obtained a building permit from the County of Butte to install a mobile home on parcel 2 and located at 7158 LaPorte Road.Since that time Plaintiff and her husband have paid all additional fees and taxes as a result of said improvements to parcel 2. 67.On or. about March 23,1994, Plaintiff obtained a copy of defendant ffalsted's building permit and learned the permit issued was to construct a building to house hay and store tractors, r to operate a automobile repair shop. 68.Defendants' building, if not removed within three years, will create a permanent trespas, on Plaintiffs property, thus permanently depriving Plaintiff of the use and enjoyment o.f her property. As a proximate result of the conduct of defendants, and each of them, as alledged, Plaintiffs husband, James T. As a proximate result of the conduct of defendants, and each of them, Plaintiff is now idenied all support, sompanionship, guidance, advice, love and affection, financial support of her husban d which Plaintiff previously enjoyed. 74.
