The property is located on the southwest corner of La Porte Road and Los Verjeles Road, at 5690 La Porte, Bangor. APN 028-260-062 (MM) (UP 03-14) Mr. Michelena gave a brief summary of the project. The hearing was opened to the public. No one was present to speak on this item. The hearing was.closed. It was moved by Commissioner Evans, seconded by Commissioner Marin, and unanimously carried to approve the Use Permit for Rudolf U. Silvius subject to the findings and conditions listed below: I. Find that the application is Categorically Exempt from environmental review under Section 15303(c), as defined by CEQA. II. Approve the Use Permit for Rudolf U. Silvius for a feed store, UP 03-14, on APN 028-260- 062, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not .adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources,_ with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the feed store will be located in an existing structure in area that has a Commercial General Plan designation. Density is not an issue since no residential use is proposed. There is more than adequate parking area for the proposed use. The structure to be used for the feed store is not out of character for the area agricultural area. 2. The availability of public facilities, services, and utilities: The feed store will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and will be serviced by a septic system. 3. The harmful effect, if any, upon desirable neighborhood character: The proposed use would not have deleterious impacts on the surrounding ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 12, 2003 ■ PAGE 13■ 1� neighborhood character due to the wide range of parcel sizes, mostly agricultural use in the surrounding area. The proposed use is in keeping with the surrounding commercial area. 4. The generation of traffic and the capacity and physical character of surrounding streets: The development offeed store will not significantly increase vehicle traffic in the area. There is no listing in the Trip Generation Manual of the Institute of Traffic Engineers for feed store use in non -urban areas. Traffic was determined by averaging the commercial use of a hardware/paint store and building materials and lumber store. An increase of 85.31 weekday vehicle trips/day and 101.64 weekend vehicle trips/day for the feed store is possible. But being in such a rural area, the anticipated average daily trips are expected to be much lower. 5. The suitability of the site for the type and intensity of use or development, which is proposed: The site is suited, for the proposed feed store. Adequate access and parking is available. The site is located in the Butte County General Plan designation Commercial. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed Use Permit application to County Agencies and other interested parties and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. B. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. III. Approve Use Permit 03-14 subject to the conditions listed in Exhibit "A" with the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies,'and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare, and safety of the County as supported by the following: 1. The feed store as approved complies with the definition of a feed store contained in Butte County Code Section 24-305.148. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 12, 2003 ■ PAGE 14■ 2. Adoption of Conditions #1 — 11 will further protect the integrity and character of the zone in which the land lies, and ensures that the use will not be unreasonably incompatible with, or injurious to, surrounding properties. Conditions of Approval: 1. Outdoor storage of products other than feed or grain is prohibited. 2. Animal maintenance products including medicines, vaccines and grooming supplies may also be sold provided that the sale of these products is ancillary to the sale of feed products. 3. A single ground sign or building sign shall be permitted for the feed store. No off-site advertising shall be allowed on the sign. 4. The applicant shall provide an all-weather access designed to accommodate a 40,000 -pound fire apparatus with a minimum of 10 -feet of width and 15 -feet of vertical clearance. 5. All new exterior lighting associated with the feed store shall be shielded and directed downwards so that is does not spill off-site or cause glare onto adjacent properties and roads. 6. Provide adequate off-street parking area/spaces (a minimum of nine) and sufficient turn- around area for trucks and horse trailers on-site. 7. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. 8. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Public Works 9. Prior to the issuance of the use permit, obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. Building Division 10. Remodel or repairs to existing building will require permits, inspections, and approvals. California Department of Forestry 11. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 12. A single ground sign or building sign shall be permitted for the feed store. No off-site advertising shall be allowed on the sign. 4. The applicant shall provide an all-weather access designed to accommodate a 40,000 -pound fire apparatus with a minimum of 10 -feet of width and 15 -feet of vertical clearance. 5. All new exterior lighting associated with the feed store shall be shielded and directed downwards so that is does not spill off-site onto adjacent parcels or create glare on adjacent roads or surrounding parcels. 6. Provide adequate off-street parking area/spaces (a minimum of nine) and sufficient turn- around area for trucks and horse trailers on-site. 7. The hours of operation are 9:00 am to 6:00 pm (Monday through Friday) and 10:00 am to 5:00 pm (Saturday ) and 12:00 pm to 5:00 pm (Sunday). 8. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, Rudolf U. Silvius is hereby granted a Use Permit for a feed store in an existing 1,875 square foot building on Assessor Parcel Number 028-260-062 at 5690 La Porte Road, in accordance with application filed to operate a feed store as defined under Butte County Code Section 24-305.148. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of the use permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, prior to such approval, verification shall be -made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required; to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval:' Outdoor storage of products other than feed or grain is prohibited. 2. Animal maintenance products including medicines, vaccines and grooming supplies may . also be sold provided that the sale of these products is ancillary to the sale of feed products. 3. A single ground sign or building sign shall be permitted for the feed store. No off-site advertising shall be allowed on the sign. 4. The applicant shall provide an all-weather access designed to accommodate a 40,000 -pound - fire apparatus with a minimum of 10 -feet of width and 15 -feet of vertical clearance. 5. All new exterior lighting associated with the feed store shall be shielded and directed downwards so that is does not spill off-site onto adjacent parcels or create glare on adjacent roads or surrounding parcels. 6. Provide adequate off-street parking area/spaces (a minimum of nine) and sufficient turn- around area for trucks and horse trailers on-site. 7. The hours of operation are 9:00 am to 6:00 pm (Monday through Friday) and 10:00 am to 5:00 pm (Saturday ) and 12:00 pm to *5:00 pm (Sunday). 8. - All outstanding application processing fees shall be paid prior to issuance of the Use Permit. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Public Works 10. Prior to the issuance of the Use Permit obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. PROJECT DESCRIPTION This request is for a Use Permit to allow an animal feed store in an existing 1,875 square foot structure on a 0.43 acre parcel. The property is currently zoned U (Unclassified) and the Butte County General Plan designation is Commercial. The hours of operation are 9:00 am to 6:00 pm (Monday through Friday) and 10:00 am to 5:00 pm (Saturday) and 12:00 pm to 5:00 pm (Sunday). Sewage disposal will be handled by an existing septic system and domestic water will be supplied by the Oroville Wyandotte Irrigation District (OWID). Access to the animal feed store will be from either La Porte Road or Los Vejeles Road. The project site is fairly level and only a limited amount of grading may be required to meet the condition for driveway improvements. No trees of any type are proposed to be removed due to this project. ANALYSIS The applicant requests a Use Permit to operate an animal feed store in the U Zone (Unclassified). This will involve an existing building, approximately 1,875 square feet. The storage of feed will be located within the existing building and storage shed. Retail sale of feed will take place within the existing building. 0 Butte County Planning Commission Agenda Report 0 Page 1 ■ • 0 Section 24-305.148 of the Butte County Code defines a feed store as a retail establishment limited to the sale of hay, grain, and other food supplies for farm and domestic animals. Animal maintenance products including medicines, vaccines and grooming supplies may also be sold provided that the sale of these products is ancillary to the sale of feed products. Outdoor storage of products other than feed or grain is prohibited. Section 24-230(c)(2) of the Butte County Code allows by Use Permit commercial uses of land or buildings. The proposed feed store is a commercial retail operation. General Plan and Zoning: The proposal will not conflict with the General.Plan designation or zoning classification. The Unclassified Zone District, applicable to this property, allows for commercial uses, such as retail feed store, upon securing a Use Permit. The use is consistent with the Commercial General Plan designation which primary uses are structures and activities providing a full range of merchandise and services to the general public. The use is also supported by Land Use Element Policies 4.1, Economic Growth and 4.3a, Commercial Services. As a part of the Use Permit request, the applicant is required to present information, including plans or other information that is substantial enough to enable decision makers to make an informed decision regarding the compatibility of the proposed project with existing zoning, General Plan designation, and surrounding properties. The following finding is necessary for the Planning Commission to grant a Use Permit: "the proposed uses of property will not impair the integrity and character of the zone in' which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county." (Butte County Code, Section 24-45.10). To make the findings that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, the Commission should examine the existing uses in the surrounding area. 0 Butte County Planning Commission Agenda Report 0 Page 2 0 Surrounding Uses and Compatibility The character of the surrounding area is rural with predominate parcel sizes in the general proximity of the subject property ranging from 0.2 acres to over 40 acres. The uses in the area are commercial, residential and agricultural. The proposed feed store is complimentary to the rural/agricultural area. The existing 1,875 structure, which will house the commercial operation, and an approximate 180 square foot shed, are compatible with the surrounding structures in the area. Pursuant to Butte County Code section 24-45.15 the Planning Commission may impose conditions upon the issuance of the Use Permit which are reasonably related to the use of the property for which the Use Permit is requested. In addition the Planning Commission may at its own discretion establish a date for either the termination of the use or review of the Use Permit. Implementation of Project Conditions imposed by the Planning Commission will ensure compliance with all land use plans and policies and that the proposed project would not impair the health, welfare, or safety of Butte County residents. Local Agency. Review: The project was reviewed and conditions applied by local agencies. The Butte County Department of Public Works requires an encroachment permit for all new or existing driveway approaches and constructs them to County standards, as specified in the County Improvement Standards. The Butte County Development Services Building Division requires that any remodel or repairs to the existing building will require permits, inspections and approvals. The California Department of Forestry requires building identification and/or addresses be installed in conformance with Public Resources Code 4290 and be posted and maintained continuously thereafter. They also require that two 2AIOBC fire extinguishers in building at opposite ends of buildings near exits. The Local Agency Formation Commission (LAFCo) required that annexation into the Oroville Wyandotte Irrigation District would be necessary to meet the need for public water. After conversation with OWID, the site currently received water from OWID. Butte County Department of Environmental Health has reviewed the project and determined that the existing septic system is adequate for the proposed use. CEQA ISSUES: This application for a Use Permit to allow a feed store in an existing structure is determined to be Categorically Exempt from environmental review under Section 15303 — New Construction or Conversion of Small Structures, which states, "the conversion of existing small structures from one use to another where only minor modifications. are made in the exterior of the structure", and subsection (c), "A store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances, and not exceeding 2,500 square feet in floor area." 0 Butte County Planning Commission Agenda Report 0 Page 3 ■ ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: Find that the application is Categorically Exempt from environmental review under Section 15303(c), as defined by CEQA. II. Adopt a "de minimis" exemption regarding impact to fish and wildlife or their habitat. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. The project site is not known to contain any species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Game or U. S. Fish and Wildlife Service. The project will not have a substantial adverse effect on any riparian habitat; have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean Water Act; interfere substantially with the movement of any native resident or migratory fish or wildlife species; conflict with any local policies or ordinances protecting biological resources; or conflict with the provisions of an adopted Habitat Conservation Plan. III. Approve the Use Permit for Rudolf U. Silvius for a feed store, UP 03-14, on APN 028-260- 062, based on the following findings and the conditions found in Exhibit "A": A. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: Harmony in scale, bulk, coverage, and density: The project is in harmony with scale, bulk, coverage, and density because the feed store will be located in an existing structure in area that has a Commercial General Plan designation. Density is not an issue since no residential use is proposed. There is more than adequate parking area for the proposed use. The structure to be used for the feed store is not out of character for the agricultural area. 2. The availability of public facilities, services, and utilities: The feed store will not create a need for new public facilities, services, and utilities because water, telephone, gas, and electrical services already extend to the project parcel. The project site is provided with municipal water and will be serviced by aseptic system. The harmful effect, if any, upon desirable neighborhood character: 0 Butte County Planning Commission Agenda Report 0 Page 4 0 • . 0 The proposed use would not have deleterious impacts on the surrounding neighborhood character due to the wide range of parcel sizes, mostly agricultural use in -the surrounding area. The proposed use is in keeping with the surrounding commercial area. 4. The generation of traffic and the capacity and physical character of surrounding streets: The development of feed store will not significantly increase vehicle traffic in the area. There is no listing in the Trip Generation Manual of the Institute of Traffic Engineers for feed store use in non -urban areas. Traffic was determined by averaging the commercial use of a hardware/paint store and building materials and lumber store. An increase of 85.31 weekday vehicle trips/day and 101.64 weekend vehicle trips/day for the feed store is possible. But being in such a rural area, the anticipated average daily trips are expected to be much lower. 5. A single ground sign or building sign shall be permitted for the feed store. No off-site advertising shall be allowed on the sign. 4. The applicant shall provide an all-weather access designed to accommodate a 40,000 -pound fire apparatus witha minimum of 10 -feet of width and 15 -feet of vertical clearance. 5. All new exterior lighting associated with the feed store shall be shielded and directed downwards so that is does not spill off-site onto adjacent parcels or create glare on adjacent roads or surrounding parcels. 6. Provide adequate off-street parking area/spaces (a minimum of nine) and sufficient turn- around area for trucks and horse trailers on-site. 7. The hours of operation are 9:00 am to 6:00 pm (Monday through Friday) and 10:00 am to 5:00 pm (Saturday) and 12:00 pm to 5:00 pm (Sunday). 8.
