The structure destroyed by fire was located on a parcel zoned A-5 Agricultural 5 -acre minimum. The A-5 zoning code Section 24-90(c) (1) requires that quasi -public uses such as the Bangor Hall'are allowed by approval of a use permit. The Bangor Hall use is therefore considered a "non- conforming use". Within the limits established by -the zoning code, pre-existing non- conforming uses are allowed to continue, as long as they are not "abandoned". Butte County zoning code I Section 24-35.45 (a) states the following: 24-35.45 Abandonment of Nonconforming Use. (a) Abandonment; consequences. A nonconforming use shall be abandoned when it is voluntarily discontinued with the intent not to resume it.. There shall be a presumption that a nonconforming use which has been discontinued for a period of twelve (12) consecutive months has been abandoned; however, the property owner, occupant or other part asserting the right to said use may submit evidence to rebut Bangor Hall Use Permit Determination, September 7, 2006 the presumption including evidence that the discontinuance was not voluntary. The property . owner, . occupant or other party asserting the right to a legal nonconforming use has the burden of proving the.legal and continuing existence of the use. Based on the =information provided in your December 5, 2006 letter, we have determined that the Bangor Hall facility/building use was not voluntarily discontinued, as the interruption in use and loss of the building was due to arson. Based on the various community activities that raised funds to replace the building and the ongoing community activities that occur. on the site, we have further, determined that the Bangor Community Park Association and'the Trustees of Bangor Park (owners) have shown clear intent to resume -the use of this building/facility. Although under County zoning code Section 24-35.45 (a) there is a presumption that a nonconforming use that has been discontinued for a period of twelve (12) consecutive months -has been abandoned, we have determined that your September 5, 2006 petition adequately proves the,legal and continuing existence of this non -conforming use. No use permit will be required by Butte County for the replacement of the Bangor Hall building. It is our understanding from the Building Department that your building permit, submittal of August 17 2006 (BP#06-1966), for the replacement building is likely 6 to 8 weeks from being plan -checked. 'The property, which is 8.14 acres, was given to the citizens of Bangor in 19.16 for use as a park with the Bangor Park Trustees listed as the owners. In 1946 with the help of the Bangor School and the hard work of the citizens of Bangor to raise the funds, barracks from Beale Air Force Base were purchased and brought out to Bangor. The Bangor School held classes in the hall for numerous years. The people of Bangor have used the park for picnics and family gatherings and have continued to use the picnic grounds even after the loss of our building. The Hall was used by the people of Bangor for memorials, wedding receptions, family reunions, and places to hold fundraisers to pay for the taxes and insurance for the park and Hall along with the maintenance and upkeep of the property. Other groups such as the Bangor Women's Improvement Club, the Bangor School, and (when we have one) the Bangor 4-H Club use the Hall to hold their meetings and other functions. The School uses the hall to have their Christmas program, Halloween Carnival, fundraising functions, graduations, as well as the small room of the hall for their weekly relief program, etc. The Bangor Women's Improvement Club uses the hall for their monthly meetings, fundraising functions, etc. The Bangor 4-H Club (when they are active) holds their meetings and other gatherings in the hall. Unfortunately on November 24, 2004 we lost our building to an arsonist and we were determined to rebuild as soon as possible. Then we found out from our insurance that we did not have replacement insurance and when we started getting quotes we were shocked to see that we didn't have enough money to replace our building. We found out how expensive it was to replace what we had in March of 2005 when the first bids came in and we have been having fundraisers to raise enough money to build ever since. The Bangor Fire Department, the Bangor Church, the Bangor Women's Improvement Club, and the Bangor School have been very supportive and have helped us to raise the funds we needed to rebuild. Some of our fundraisers such as the Bangor BBQ take place at the Bangor Park (even without the building the Bangor BBQ has continued to be at the Bangor Park and this past May was our 63`d Annual BBQ) and the others.we have been able to have in the apparatus room (where the engine, tender, and squad park) at the Bangor Fire Station. They have been very supportive and kind enough to move, their equipment out in order for us to have a building to use in bad weather. The Bangor Church had a Chili Cook off last year with all the proceeds going towards the rebuilding of the Bangor Hall. The Bangor School and Bangor Women's Club have also helped to raise funds so that we will be able to rebuild. We are building the new building in the. same spot that our bld building was the only difference is. the new building is rectangle instead of the "L" shape that it use to be. The -reason is the "L" shape was more expensive and we just didn't have enough funds. It has taken us 1-%i years to`raise enough funds to build as it is.
