Public Works conditions:
1. Indicate a 55 ft. building setback from the centerline of La Porte
Road and a 50 ft. building setback from the centerline of Upham Road.
2. Show all easements of record on the final map.
3: Obtain encroachment permit for all driveways, new or existing, and
construct to county standards.
4.. Pay any 'delinquent taxes or current taxes as required.
5. Provide letter from Cal -Vet that they approve of this division.
Health Department conditions:
6. Provide -a 100 ft. leachfield free setback around existing wells either
within the property or ~within 100 fti of the property boundaries on
parcel 2.

SUBJECT; Report on Tentative Parcel Map of John Halverson on AP#28-31-51
DATE: October 18, 1985
This is a proposal to divide 10.3 acres into two parcels of
5.15 acres each. The present zoning is A-5. The sand Use
Plan Map of the Butte County General Plan designates this
area as Agricultural -Residential. There are no specific or
community plans for the area.
Though the initial General Plan Conformance Repor'L indicated
that three of the five conditional criteria were not met,
the finding is now that the proposal does not substantially
conflict with County zoning nor any adopted or proposed
element of the Butte County General. Plan. The status of
fire protection will. change depending on the staffing level of
the two nearest fire stations in coming budget years. Nearby
roads are County maintained, though not to a level for high
traffic volumes. Access to commercial services and schools
is still a factor, but the number of 5 acre or smaller parcels
in the vicinity reduces the significance.
The following mitigation measures are recommended for
adoptions
1. Place notes on the final map as follows:
A. it is recommended that standard accepted construction
practices be utilized when site development occurs to
minimize erosion.
B. Homesites to be located in areas of less than 10
slope on. these parcels;
2. Show a. 1.00 -foot septic setback, building setback and
vegetation retention area along Robinson Ravine.

parcels is to be at the common access easement as shown.
NOTE: Since this report will not be received five days prior
to the hearing; a waiver of Seca '20-59 of the ,Sub-
division Ordinance is needed to allow Advisory Agency
action on October 21.
