III. DISCUSSION OF ENVIRONMENTAL EVALUATION
The applicant proposes to divide + 96.5 acres of land into three
separate parcels, 50+ acres, 40+ acres and 1.5 acres in size. The
project site is located approximately one mile north of Riciivale
extending westerly .frown Midway Highway, and 10 miles west of Oros►ille
The site presently consists of one single family dwelling and open.
rice :fields. Most Of the surrounding land is devoted to ri.ce farming.
The site is designated Orchard and Field Crops in the County General
Plan, and zoned A-40 Cminirit,um 40 acres per Parc .:a) . Surrounding lend
:is designated Orchard ane. Field Crops and zoned A-40 and A-5. Parcel
sizes vary from 20 to 500 acres.
The purpose of the use permit anti subsequent parcol map is to accomplish
an agricultural segregation of crop Land from an existing residence and
associated structures.
A review of pertinent checklist items is presented below:

ANALYSIS:
This is a request to segreaate a 1.5 acre homesite f'rolft the surrounding
agricultural land zoned A-40, north of Riclivale. The homesite contains
an existing residential use and associated buildings and is proposed,
, to
be sold by the Applicant, while the surrounding property is to be ro-
tained and farmed. The property consists of part of an old underlying
subdivision of 5, 10 and 20 acre parcels. (Lots 855 through 846 of Rich -
vale Colony No. 2) The site plan provided by the applicant indicates
the proposed creation of a 40 -acre parcel and a So acre parcel along
the boundary lines of the old subdivision lots. 'The Purpose of thi's
proposed division is not discussed in the use permit application, but it
should be rioted that the segregation allowed by Sec, 24-94 of the Butte
County Code requires recordation of a covenant prohibiting any additional
dwellings oA any of the involved property. Deponding on. the applicant's
intentions, and 1— order to preserve the agricultural land, the Com-
missiou may wish tu Condition the use permit to allow only one remalning
parcel of 90 acres. The Commission may also wish to add an additional
condition to cause a reversion to acreage of the underlying subdivision
lots. Thesvc- conditions are included below) but may be deleted, if -
