AGRICULTURAL BUILDING EXEMPTION PERMIT

Agricultural building is defined as follows: Agricultural building is a structure designed and constructed to
house farm implements, hay, grain, poultry, livestock, or other horticulutral products. This structure shall not
be a place of human habitation or a place of employment where agricultural products are processed, treated,
or packaged, nor shall it be a place used by the public.

AG Buildings shall be a minimum of five (5) feet from any septic tank or leach fields.
AG Buildings less than 1000 sq. ft. in floor area shall be located a minimum of 6 feet from a residence, 10 feet
from a mobilehome, and 23 feet from a commercial building.
AG Buildings greater than 1000 sq. ft. in floor area shall be located am in imum of 23 feet from a residence and
a mobilehome, and 40 feet from a commercial building.
I declare under penalty of perjury that the building will be used as stated above and the proposed use
conforms with the AG Building definition. If any change in use or occupancy of the building is made, I will
contact the Department of Public Works and will obtain any necessary permits, inspections, and approvals to
comply with the requirements in effect at that time and befo upancy.

Re: Installation of Steel Storage Bins
Dear Mr. Glander
This letter is in furtherance of the discussion which took place
between you, Ernest E. Hatch, and me in your office on Tuesday
morning, April 27, 1982, relative to whether a permit would be
required for the installation of two (2) steel bins and related
equipment for the storage of rice on property south of our drier
in 'Richvale .
Members of the drier are Ralph Carlson, Donald Rystrom, Ronald R.
Harrington, Ernest E. Hatch, and myself -.all independent farming
operators and rice growers who have been drying and storing their
own individually -produced rice at the Richvale site for some 25-30
years. The sluggish movement of rice during the past marketing
year and the dim prospects for the shipment of very much rice in
the near future have necessitated that we erect additional storage.
Two (2) steel bins, 481-0" in diameter with an eave height of 36'-
0", and with an aggregate approximate capacity of 52,000 cwt., are
planned for erection at the south end of the existing drier.
In your consideration of whether the erection of these two (2y
new bins as additions to our present facilities will require a,
permit, your attention is invited to the following:
1. No outside drying and storage business is conducted by the
partnership. Only the rice of the members of the partnership is
handled at the Richvale site. Thus, the operation is 5 -farmer
oriented and not commercial in any sense. Instead of.having drying
and storage on 5 farms,- we have consolidated the 5 -farmer efforts
in this regard at the one Richvale site.
2. In regard to the foregoing point, it is understood that each
one of the partners would not be subject to the need for a permit,
if he individually erected a storage bin on his own individually
held property.
3. The bins will.be erected on property held by the•partnership,
on a site immediately adjacent to the facilities of these same 5
farmers who comprise the partnership.

4. Within the very recent past, it is common knowledge that four
(4) steel bin storage installations similar or almost the same as
that which we have under consideration have been erected in.the
immediate area, without need for permit. The conditions of owner-
ship in these same four (4) cases have either involved partnerships
or family -related enterprises with many similarities to those in
the case which is the subject of this letter.
5. Construction will be performed by B & K Industries, Orland,
California - a reputable firm with considerable experience and a
leader in the field of his construction.
6. A soil sampling of the site for the bins has already been per-
formed by Terrasearch, Inc., Sacramento, California. Thus, the
construction - from below -the -ground up, is being performed in
keeping with sound engineering and the best businesslike procedures.
In light ofithe foregoing,, we ask that our proposed bin construction
and erection of equipment related be deemed to be exempt from permit
procedure.
