According to our records, the courtesy notice has not resulted in abatement . or correction of the following specific violations: 1. The accumulation of junk in public view. 2. The keeping of inoperable vehicles in public view. Your failure to eliminate the stated violations is cause for the issuance of this formal warning notice. This is notice that as of this date, our records indicate that the following violations to the Butte County Code still exist: • Butte County Code, Chapter 24, Section 24-65 - Applicability of zoning regulations. All uses of land within a zoned district not specifically authorized or permitted by regulations are prohibited. • Butte County Code, Chapter 24, Section 24-95 - The AR (Agricultural -Residential) zone does not "specifically authorize" large accumulations of junk. The storing of more than 100 square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A "junkyard" is not an allowed use in the AR zone without a Use Permit. "Automobiles and other vehicles, dismantled, in whole or in part" are considered to be "junk." Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or not, from storing junk in public view. Any worn-out and discarded material in general that may be turned to some use including, but not limited to, any old iron, wire, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of bicycles, tricycles, baby carriages, automobiles, and other vehicles, dismantled, in whole or in part, kept, stored, located, situated or piled in public view, and all other similar personal property ordinarily defined and classified as "junk" kept, stored, located, situated or piled in public view and not screened from public view by a fence. Butte County Code, Chapter 24, Section 24-305.370 -Rubbish. "Rubbish" shall mean all nonputrescible solid wastes, combustible, or noncombustible, including, but not limited to, paper, cardboard, yard clippings, grass, ashes, wood, bedding, crockery, glass, metal and other similar materials, excepting compost boxes. • Butte County Code, Chapter 24, Section 24-305.451 - Violator. An adult owner, tenant, occupant, resident or other person having possession, control or any other ownership interest in or the right of access to the premises, who is suspected or alleged to have violated or to be in violation of any Butte County Code provisions of the Chapters specified in Butte County Code Section 24-305.451. In order to bring the property into compliance with the Butte County Code and avoid further enforcement actions, you are hereby requested to take the following abatement or correction actions: 1. Remove all "junk" in accordance with the Butte County Code, Chapter 24, Section 24- 305.240. 2. Remove all inoperable/junk vehicles from the property. This is your final warning. Bear Ms. Seaton: On January 8, 1985, this department received a complaint from.a Ms. Jo Maker, tenant of the above listed rental unit alleging.health. and safety hazards in the dwelling.' The Butte Co.unty Assessor's rec.ords indicate you are the owner of the property'. On January 14, 1985, I visited the property, and M.s. Maker.allowed me to inspect the dwelling., The following conditions were observed which are in violation of the Health and Safety Cod.e'of.' the State of California, Section 17920.3,: (a), (b), (e), (f), (g), and (j); and.which pose health or safety hazards to the tenants. 1. The enti.r.e.bui.lding shows evidence of excessive dampness including mildew on wall.s'in bedrooms, and bathroom.. Crawl space appears flooded. 2. Living room wall heater is inoperative.. 3. Floor is weak and sagging in living room by rear laundry room. door. Walls -are broken in laundry room, and,in bedroom in south/east corner, and in that bedroom Is closet. Walls also show rot from dampness near.the.floor juncture. Interior.dours are damaged. 5. Water heater laL.temperature-pressure..relief.valve and dis- charge line. Vent pipe is'. missing on laundry wastewater drain.. 7. The dwelling lacks adequate weatherproofing-with'holes-in-walls around swamp., cooler,. in laundry room, in bed''ooms where air conditioners and other equipm;ent.has been removed.. Wzndows are broken in the broken in the dining. room, rear bedrooms, and bathroom. There is a bee swarm.in the wall of the south,/ east bedroom (in an.old air conditioner hole). 8: Both front doors are damaged and not.weatherproof. 9. There is an accumulation of refuse in the:yard. These conditions shall be corrected as -follows-,. and within THIRTY (30) DAYS from receipt of th.is notice. Obtain all required.p.ermit-s from the.Butte County Department of Public .Works,.7. County Center Drive, Oroville, CA, prior to making repairs. 1. Eliminate..excessi.ve dampness from the dwelling. Drain the crawl space under the house. Repair mildewed and rotted walls_. 2. Repair or replace defective living room wallheater_ 3 Repair deteriorated floor in living room, replacing all damaged - or rotted materials. 4. Repair all broken walls in the laundry room, bed.ro.oms, and closet, including holes hidden by panelling.. Replace damaged interior doors. 5. Provide a temperatu.re-pressure relief valve and dis-charge line on the water heater. Do not permit laundry room to be used�for bedroom. 6. Repair or replace.defective kitchen sink and bathtub waste drain plumbing so both will drain.properly and not backup. .7. Make the building weathertight. Eliminate all holes in the walls, and around the swamp cooler.. Replace all broken windows. and make windows weathe.rtight. Eliminate bee swarm.from wall... 8. Replace both damaged front doors, make doors weath.ertight.: 9. Remove all accumulated refuse from the yard area_ Provide covered.fly-tight containers for garbage.and.ru.bbish_ A reinspection will be' made. Failure to comply with this notice will result in the Franchise Tax Board being adivsed of your ron= compliance.
