I am not sure if you read Jim's letter in that he asks that you show or tell us how, by "acceptable engineering design practices", your boathouse meets the code's requirements. Your February 2 letter tells us it does but you don't show us how as was asked in Jim's letter. Item No. 2 indicates that the building or boat should be anchored to a permanent foundation or an approved alternate which is structurally equivalent. This does not seem too tough to do because you could pour some pads with anchors and things with proper calculations to show that it meets the wind load for a single -story building. This -does not seem to me to be a tough requirement. Item No. 3 asks that your electrical, plumbing and mechanical systems "essentially conform to code requirements"; it does not ask thatthzyconform but your letter does not even say thattheyessentially conform- I am sure that a little time would allow you to tell us the wiring size, ceiling heights and so forth as compared with code minimums. Items No. 4 and No. 5 speak to ceiling minimums and stairway rise, run and width. It is my observation that these would require you to do some substantial remodeling to be practical but I think it is for these reasons that we have our Building Code Appeals Committee and I would bet -that it might accept these items under this individual circum- stance. This provides a means -of acceptance without putting Jim in�the'position of making such allowances for other than "special circumstances." Item No. 6 indicates a requirement for conformance with your State Energy Requirements. This is something that Jim does not have latitude on. The Building Cede Appeals Committee could determine if this special circumstance warrants acceptance. I would bet that the _committee would make an acceptance but I don't believe that Jim has the latitude to waive code'requirements under such circumstances as yours. Robert E. At that time, I stated,that the construction features were sound and well engineered but that some of them would not and could not be altered to meet the California building code. Based on some encouragement at that time, I proceeded to purchase the lot and supplied drawings and calculatioris-requiied by the permit department: Now; I have received a letter (copy enclosed) which demands some thins that are not functionally necessary and others that I f had already stated that I could not meet. It app6ars that, after two and one-half years of needless prose- cution by the U.S. Army'Corps of Engineers for nothing more than bureaucratic demands that serve no' one, I may have fallen into the hands of another agency that deals only with rules without sensible reason. I assure you as an experienced engineer and former builder that the vessel is sound, safe, • energy efficient, and certainly better built than a mobile home. I wish you would discuss this with Clay Castleberry and try to find some way that this unit can be accepted. McDONALD Deputy Director MINUTES OF BUTTE COUNTY BUILDING CODE BOARD OF APPEALS - March 2 1981 Members present: Bowles, Chrysler, Franklin, Hershberger, and Honeycutt. Members absent: Cook and Graves. Others present: Glander, Anderson & son, and Mr. & Mrs. Boyden. The meeting was called to order by Chairman Chrysler at 3:45 PM. The first appeal was by Roy Anderson of the requirement for building paper underneath hardboard siding. Mr. Anderson proposed caulking of the joints and placing felt between the studs in the stud space rather than over the entire exterior of the studs. His request was supported by a letter from an engineer, Frank Tyukos. After much discussion, a motion by Hershberger, seconded by Franklin; to deny the appeal. Motion carried unanimously. Request denied. The second appeal by Bob Boyden concerning the placement of a.houseboat on a lot to be used as a residence without complying with the code. Specifically, the items outlined in a letter.to Mr. Boyden from the Department of Public Works dated January 29, 1981. Mr. Boyden explained his proposal and indicated, in his opinion, the structure was as safe as necessary and that compliance with the code items was unnecessary and not practical. Much discussion followed concerning the structural design, anchorage to a foundation, foam support systems, electrical, plumbing, and mechanical systems, ceiling heights, stairway construction, energy requirements, and other items. After about one (1) hour of discussion, the Board felt it did not have sufficient information to make a determination, The Board requested Mr. Boyden to .furnish further information to help answer the concerns in the Department of Public [storks letter. The Board also requested data on the polyethelene. foam concerning deterioration over time and the natural resistance to the weather elements and rodents, and wanted precise measurements on the width, rise, and run of the stairway. The Board indicated (but did not vote on) that ceiling heights and.insulation might not be majoriitems of concern. I had built a beautiful two.bedroom floating home (photo enclosed) for our occupancy which lasted four months. In a bureaucratic effort to remove such vessels from the delta, the U.S. Army Eng'r Corps has prosecuted us for over two and one half years. We have now lived. in Oroville for two years and we have purchased a mobile home zoned lot on Grand Ave near 20th street on to which we would like to move this vessel, landscape and.p.repare it for a single family dwelling: The unit has been built much lige a rouse but in order to withstand wave action, it is much stronger than.a house and has three forty foot steel angle girders at the roof peak and eave lines.with the rafter and studs bolted to them. All plywood sides are glued as well as nailed and screwed to the studs and to the deck. The rafters are double gus- seted to provide a rigid triany,le. Enclosed are Eng'r.dwgs.:showing floor and plot plans, elevations and construction details. Unfortunately some of the construction does not meet the California State Uniform Buildinz Code and some di -pensions are not alterable with- out destroying the structure. For example, ceiling heights are 7' in- stead of 7' 6Y; the stairway to the loft does not meet required tread dimensions; the studding, tho spaced the same is turned sideways to facilitate bolting and to reenforce the siding. The electric wiring is done with the code required wire but there are only three circuits :9 20 amps on each circuit breaker. It should be noticed that as a dockside vessel, reduced amperage is important and the circuits are well balanced and the hot water heater has a reduced amperage element. A master circuit breaker should be added outside. The insulation is about R-15 all around except in the ceiling which is about R-18. There are double pane windows throughout. The wood stove Is installed per code with the walls and floor well protected. The water lines are all heavy wal1P.V.C. The toilet is standard flush type. All drains have a standard 1 1/4" or 1 1/2" trap. All traps are close together and drain into a fiber �:lass holding tank which Is -vented to the outside.(On land this tank would drain.in to the sewer line and the vent would be extended upwards above the roof) The roof is fiberglass mineral shingle. One point difficult for the bldg. dept. to accept was the foundation. Secured to the deck are two 2'x4' x40' riolyethelene sealed .foam flotat- ion pontoons. I have -Wade calculations(enclosed) which show a safety factor of 20-1 on pressure.
