(LPW) (VIDEO) The Commission waived the reading of the Staff Findings. A video of the site was shown. Commissioner Ferguson said on the bottom of Page 2 of the report it states "the CalTrans ,right-of-way 80` ft from the centerline"; but on Condition 10 on Page 4 of the Staff Findings it states "there will be a setback of 80 feet". He asked what the difference was? Staff said the tavern is very close to and possibly in theright-of-way area. Staff, said they Would have to investigate what the required right-of-way would be for setbacks of this width. Commissioner Ferguson said an 80 ft. right-of-way and 80 ft. setback does not seem consistent to him. He said the 80 ft. right-of-way allows for a 25 ft. buffer in the letter from CalTrans. Chairman Lynch asked about the time lines for the widen of 162 and the installation of a bridge? Staff said this might not occur in the near future because of fiscal. constraints. Commissioner Ferguson asked if CalTrans recommended the curb, gutter and sidewalk or is it a County recommendation? Staff said it was both, Cominissioner Ferguson asked if there was established line and grade for the curb, gutter & sidewalk? Staff said this is typically why the cond'tion reads for the applicant to submit the plans to the County and CalTrans for the'. approval: The hearing was opened to the public, Judy Mayhew, slaughter of the applicant; asked for a waiver of Condition 1 which states they will eventually widen the road: She said the expense would be prohibited. Staff said the 80 ft. setback does not mean the applicant would have to tear down any existing buildings, it means they can not build any new structures within the setback. Mrs. Mayhew asked if CalTrans had a right-of-way or would they have to deed property to them? Staff said she would have to ;check with CalTrans. Staff said when talking about a setback they were talking about new construction. The hearing was closed, Chairman Lynch said in lieu of the possibility of reconstructing of Uro Dam Blvd., he suggested a condition be added to tie -,he installation of curbs; gutters, and sidewalks to that construction. Chairman Lynch said he has no quarrel with Condition 9. He said he is concerned with installing curbs, gutters, ane, sidewalk On a short area of the highway where there are no improvements on the south side of the highway, west of the bridge. He said. he was concerted with sidewalks chat lead nowhere. He suggested the improvements be put iff to such time when or if Cai oLhs improves the highway. He suggested the applicant pay a pro rata, share of the improvements within one year of the time that CalTrans does the work, Commissioner Lambert said the Commission should be consistent with the language used for this type of condition: Staff said the condition needs to be tracked by staff and raviewc d in S years. Commissioner Ferguson discussed deferring Condition I and 2, He asked about deferring Condition 3 regardhig drainage? Staff said the condition for a permanent solution to drainage includes the on-site drainage as well as the off-site drainage: Chairman Lynch suggested a motion of intent to allow time to get consistent wording together for the condition; Commissioner Lambert agreed, Staff said the Commission may want to allow staff time to report back on the condition; Chairman Lynch suggested a condition that the applicant should pay a pro rata share of the curbs, gutters, and sidewalks within one year of the time CalTrans widens Highway 160 and a review of the conditions within 5 years. Commissioner Ferguson said CalTrans' policy is not to build sidewalks unless they are a replacement. Staff asked for a provision for staff to review the condition in 5 years and report hack to the Commission. Commissioner Sessions asked Mrs. Mayhew if, the design for the mobile home park was for mobile homes that were considered permanent or were they recreational vehicles that would be moving in and out on a regular basis? Mrs. Mayhew said the ;plan is to have permanent mobile home spaces, not overnight camping: She said "there might be one space available for overnighters, Commissioner Lambert asked if there was a sewage pump station to allow for recreational dumping Mrs, Mayhew said no Chairman Lynch suggested a condition worded "Install curb, gutter, sidewalk within one year of CalTrans widening Highway 162, this condition to be reviewed by staff in 5 years and all improvements must be approved by CalTrans.
