The County Planning Department and Public Works Department have
no record of compliance by the applicant with the amended con-
dition) approved .lune 11, 1980, that required the applicant to
enter into a covenant with Butte County, approved by the Depart-
ment of Public Works and County Counsel, "to ensure that Con-
ditions 2 and 3 of the use permit be accomplished at the time
Highway 162 is widened and the Thermalito Tlastex Drainage Plan
is implemented." Furthermore as noted in the minutes from the
meeting of the Planning Commission on January 2, 1980, the appy --
cant must submit a new application for a use permit to expand
the existing body repair shop.
Based upon the foregoing facts, the applicant ,('Anthony Marks)
who wishes to expand an existing body repair shop on AP 30-195-14,'_
shouldi (1) submit evidence to the County Planning Department
and/or Public Works Department that all, conditions of approval;'
in use permit 74-46 have been accomplished, and (2) submit a
new application for a use permit to the Planning Department to
expand the existing body repair shop on AP 30-1.95-14,

Thank you for your letter of February 16, 1982.
Mr. Marks tells me that he signed all of the documents
he was requested to sign, paid the necessary fees, and,
Submitted plans which wore approved. However, he was re-
fused a building OtMit.. He was told that County Counsel.
Was of the opinion that the required "covenant” would be
unenforceable.
in other words, Mr. Marks was willing to do everything
required, and in fact did everything that Lhe County would
let him do. However, because the covenant "to be drawn and
approved by the bepartment of Public Works and County Counsel"
never materiali2ed, he .was unablo to
comply with all of the
conditions._
Perhaps Chore has been a fa .lite of communication. 3:;t'
County Counsel approves the covenant, and one is available
for Mr. Marks' signature, he Will gladly sign it. If n'ot,
we would request that this matter ke put on the Planning
Commission agenda for a hearing without the necessity of a
new appliga-hion.
