I discussed your memo with Bettye. This same issue has
come to our attention -through conversations with Public E
Works and a letter from the City Administrator. We
cannot, at this time, speak to the_ specific proposals
outlined'in your memo of December 22, 1980.
It is the Department's view that such issues require a
more comprehensive, long range exAmination before spe- i
cific zoning, easements and other requirements are imp.
posed. In particular, the City of Oroville should be
involved to more fully articulate; their future plans
for their airport, much like the City of Chico and ,the
Chico Airport. Without the Cityof Oroville's parti-
cipation. in such a study; Butte County will be forced
to address these issiies on a piece meal basis, never
quite certain that these measures will in the long run
be effective. As a resu"l.t, the Planning Department is
initiating a proposal for a study of the Oroville Air-
port jointly with the City of Oroville. This study
should provide both jurisdictions with sufficient infer-
mation to minimize the land use conflicts and protect
the public health and safety• it may also require a
moratoriuh or interim regulations to,preserve the status

This is to confirm our telephone conversation regarding the above -
referenced matter.
As I indicated over _.z phone, this office required an EIR for
Dor. Rauch's original application for AR -MH -1 zoning for. Afterbay
Estates, located just south of Oroville Airport. Our determination'
was based primarily on objections from the City of Oroville and
pilots regarding airport compatibility of dense development in the
airport vicinity, specifically the direct flight
path of the only
local runway that will accommodate corporate jets. In our opinion,,
one>aare parcels are extremely dense given potential problems with
take-ofnd safety (if planes miss the airsttip or have to abort on '.
)•
On Thursday, December 18, 1980, 1 met with Mr. Rauch'.s representative,.
Mike Glaze of Cook Associates, and officials from the City or 4,
Oroville including Dave Jinkens, the City Administrator, Chars
Lueder, the City Attorney, and Clif Sellers, the City's. EnviYon-
mental Coordinator. The City's representatives indicated thei,,,7
objections would be satisfied if they received from Mr. Rauch
(or his successors in interest) the following:
1 Noise easemoAts
2. Avigational easements limiting the heights of obstructions
in the flight path.
3. A committinent to underground utilities: - -
4. Establishment of an open strip 1S0 -feet wide crossing
Afterbay Estates in line with the center of the runway
as shown on the attached map, zoned to preclude development
ofof structures, although uses such as farming; would be til,
permitted.

Speaking for the Environmental Review Department, are indicated to
Mr, Glaio that if items 4 and 5 could be accomplished, we would
recommend a Negative Declaration on the Rezone application. Items
1 thrijugh 3 seem to be more applicable to subsequent parcel maps
than a tdt6ftei There are a number of parcel maps pending which
probably should be processed subseeluent to resolution Of the zoning

issue, since the Planning Commission or Board may Nish (through
zoning) to establish larger parcel sizes this close to an airport.

Dear Ms. Blair:
The City of Oroville is greatly concerned about the further
division of lands at the referenced site: The site is
immediately adj'acen't to the Oroville Municipal Airport
south boundary and beneath the flight approach pattern for
runway 1-19 (northeast/southwest)
This runway has a length of 5,925 feet and is suitable f6k
utilization by jet and transport aircraft. The runway is
structurally sound and was inspected by. the FAA within the
past six months.
Improvements to the runway,, including asphalt overlay and
VAsI 'lighting, are included o-4 Cal Trans and.BCAG trans-
portation improvement plans. Application to the FAA has
keen made to fund a portion of these improvements;,
Clear zones for this runway are delineated airport maps
including master plan, improvement and layout maps. Aviga
tion easements sir a portion of the clear zone on the
northerly, end of runway 1-19 have already been obtained
(copy of deed enclosed).
r The City is concerned that land divisions in After Bay
Estates could lead to levels and types of development
which would severl.y jepordize future airport utilization
and possible expansion.
Decisions involving land 'divisions and zoning in this area
should include consideration of the immediate and eventual
