This'same issue has bl come to our attention. through conversations with Public Works and a letter from the City Administrator. We . cannot, at this time, speak to the specific proposals j outlined in our memo 'of December 22 1980. !. y f , It is the Department's view that such issues require a ' more comprehensive, long range examination before spe- f cifc zoning, easement's and other requirements are im- posed. In particular, the Citg of 0,rovi J le should be involved to more fully articulate their future plans for their airport, much like the City of Chico and ;the !` Chico Airport.. Without the. City of Oroville's parti cipation in such -a study, Butte County will be forced, to. address these issues on a piece meal basis, never quite certain that these measures wi11 in the '`long run be effective. As a result, the Planning Depart -Mont is initiating a proposal for a study of the Oroville Air port jointly with the City of o-ovil.le. , This study should provide both jurisdictions with sufficient infor- mation to minimize the land use conflicts and protect the public health and Safety4 it maiy also require a ux moratori',, or interim regulations t6 prpe live the status quo durid the hiatus. December 22, 1980 This is to confirm our telephone conversation regq.rding the above referenced matter. As I indicated over the phone, this office reouired an EI_R for Mr. Rauch's original application.for AR -MH -1 zoning for Afterbay Estates, located just south of Oroville Airport. Our determination Was based primarily on objections from the City of Otovil.le and pilots regarding airport compatibility of dense development in the airport vicinity, specifically the direct flight path of the only local runway, that will, accommodate corporate jets. In our opiniona: one -acre parcels are extremely dense given potential problems with noise and safety (if planes miss the airstrip or have to abort on take -off). On Thursday, Decpmber 18, 1980, I met with Mr. Rauch 's representative;, Mike Glaze riff. Ccck Associates, and officials from the City of Oroville inc ,,3ing Dave Jinkens, the City Administrator, Charles Lueder, the City :A-ttorney, and Clip Sellers, the City's Environ: mental Coordinator: The City's representatives indicated their objections would be satisfied if they, received from Mr. Rauch (or his successors in interest) the following; 1 Noise easements. 2. Avi.gational easements lrniting the heights of obstructions in the flight path: 3. A committment"to underground utilities. 4i Establishment of an opeii strip 150 -feet wide crossing Afterbay Estates in line with the center of the runway As shown on the attached map, zoned to preclude development of structures, although uses such as farming would be permitted. S. r};isity limitation on the balance of the development: As long as item 4 above is taken dare of, 24 acres seemed to be an acceptable density to thr 8 present. Speaking; for the Environmental. Review Department, we inti sated to Air. Glaze that if items 4 and 5 could be acco!in pIished, we would reroiitmend a Negative Declaration on the Rezone application. Items 1 through 3 seem to be more applicable to subsequent parcel map's than a rezone, There are a number of parcel maps pending which probably should be processed subsequent to resolution of the zoning "t . . 1 1 JI Charlie Woods 1 Page 2 December 22, 1980 rdugh issue, since the Planning Co'mmissios1zesBthis closeoard may lto ansh hairport:- zoning) to establish larger' parcel Z see no prob- Once the dens: issue is resolved through zoning, but until lem with a negative declarationed we do f Krutliel7etlerla or not the parcel S, that issue isreavwould be considered a "significant adverse t sines being the Planning; Commission and BoWtdl of environments yf£,ect" by Supervisors j contacted by Mike Glaze, who intends tlo ryubmt a You will, be co _ h. The site is immediately adjacent to the Oroville Municipal Airport south, houndary and beneath the flight approach pattern for runway 1-19 (northeast/muthwest). This runway has a length of 5,925 feet and is suitable for utiliza.t;lon by jet and transport aircraft. The runway is, structurally sound and was inspected by the FAA within the past six months. Improvements t-- the runway, including asphalt overlay and VASI lighting, are included on Ca) 'Trans and BCAG trans— portation improvement plans: Aprl dation to the FAA has " sheen made to. fund a portion of these improvements. Clear zones for this runway are delineated on airport maps including master plan, improvement and layout maps.Aviga- tion easements for 'a portion of thF clear zone on the northerly end of runway 1-19 have already been obtulned (copy of deed enclosed).
