Dear Scott Rutherford:
This is in regards to the warning notice you sent dated September 24, 2002. We have
tried to reach you several times to no avail. Your letter is a demand to cease and desist
occupying a recreationalra`n't`o- submit plans for the construction of a shop/ag building, to
apply. for required permits and to pay appropriate fees. We are confused as to how these
accusations have come to be. We left the Oroville area and moved to Tombstone,
Arizona more than nine (9) months ago. Prior to moving to Arizona, we lived in a
mobile home on Bonnie Lane in Oroville. This can be verified by our landlord, Cary
Shwartz. There has been no one camping on our property nor living in the shop/ag.
building at any time. The only person to have physical access to the property is our real
estate agent and any prospective buyers she has shown the property to. We feel confident
that had there been any one camping on the property, she would have notified us
immediately. The existing recreational vehicle on the property is not habitable by
humans and has been used for nothing more than storage.
In regards to the permits required to build said shop/ag. building, they were both applied
for and issued to my licensed contractor, John Corp of Economy Builders. Not only were
any necessary inspections conducted, the County also came out at the time of completion
and reassessed the value of the property. This is all public record and should be easily
verified by you. Incidentally, the address on the deed is not Wild Game Place but 2 Rabe
Rd.
,As there has been no habitation or change in use of the shop/ag. Building, there is no
'reason to apply for additional permits or to seek inspection or approval for use of
-occupancy. The property �in question has recently been sold and is currently in escrow.
AAs part of the sale'agreement, the�new owner has arranged to clean up the property and
remove the inhabitable recreational vehicle in order to build a home.
We hope this affidavit will help you to understand that there has been a mistake on the
part of the Butte County Building Division. There is just no possibility that we could be
committing these offenses as again, we haven't even been in the State of California,
much less in the County of Butte.

This is a formal warning notice. Pursuant to Butte County Code (BCC) Section 41-2, we sent you a
courtesy notice dated January 11, 2001, notifying you that you are in violation of the BCC, and- 1998
California Building Code (CBC), at the above -referenced location. As of this date, the following
violations still exist:
Failure to obtain the required permits, inspections and approvals from this office for the
construction of a shop/ag. building, and deck is in violat' n of the 1998 California Building Code
adopted by Section 26-1 of the Butte County Code as follo'ws,
(a) Section 106.1 Permits Required
(b) Section 108.1 Inspections Required
(c) Section 108.4 Inspection Approval Required Before Use or Occupancy
(d) Section 3405 Change in Use Requires Conformance to Code
The above violations(s) shall be corrected or abated by you by submitting three (3) complete sets of plans,
applying for the required permits,,and paying the appropriate fees, including penalties. After permit
issuance and field authorization to proceed, the work must be completed and approved by this office
within the permit specified time.
In addition to the above referenced violations the following use is in violation of the Butte County Code:
1. Unauthorized camping or otherwise occupying a recreational vehicle.
This warning letter also advises that Item Number 1 listed above is a use that is in violation of the Butte
County Code, as follows:

Butte County Code, Chapter 24, Section 24-260 - Camping Limitations and Prohibitions.
A. No person shall place or park or allow the placing or parking of any trailer coach,
recreational vehicles, tent trailer or tent, or otherwise occupy or allow the occupancy of
any parcel (as defined in Section 24-305.310) for the purpose of camping (as defined in
Section 24-305.095) on public or private property within the County for a period in
excess of 9 days in any one calendar year, except in an outdoor recreational facility,
campground, recreational vehicle park, or hunting/fishing camp, lawfully established and
maintained pursuant to this Chapter.
The determination that Item Number 1 referenced on page 1 exists on the property is based on the
following definition in the Butte County Code:
Butte County Code, Chapter 24, Section 24-305.095 - Camping. Occupying or maintaining for
occupancy any place for temporary living, sleeping or other human occupancy purposes.
"Camping" does not include: The parking or storage of an unoccupied and otherwise unused
trailer coach, recreation vehicle, or tent trailer on a privately owned parcel, as defined in Section
24-305.31; occupying a trailer coach, or recreation vehicle, connected pursuant to county permit
to permanent sewage disposal and water supply systems; or occupying a trailer coach or a
recreation vehicle for any accessory use allowed in the applicable zoning district.
This is your final warning. Unless you contact this office and make the proper arrangements to correct or
abate.the violation(s) voluntarily, within ten (10) days from the date of this letter, enforcement shall be
pursued through the issuance of a citation (ordering you to appear in court) for said violation(s) and for
failing to comply with this warning letter.
Upon conviction of said violation(s) or of failing to comply with this letter, the court shall impose
penalties (fines) and a Notice of Violation shall be recorded in accordance with Butte County Code
Section 41-7. The Notice of Violation shall include a description of the premises the violation concerns, a
description of the violation, the date of your conviction and the action necessary to correct or abate the
violation(s).

This is a courtesy notice to notify you that you are in violation of the Butte County Code, as
follows, at the above -referenced location.

onstruction of a 14 x 14 building, 10 x 10 deck and 8 x 30 travel trailer.
Since permits and inspections are required 'for the above work, please submit three (3) complete

until these permits are issued and you are authorized by our field inspector to proceed. The field
authorization cannot be made until the existing work is inspected and approved.
It is the County's goal to obtain voluntary compliance with the Butte County Code. However,
you should be advised that Butte County has an active Code Enforcement Program which
provides an effective means of enforcement if voluntary compliance is not obtained.
Enforcement may be pursued through the issuance of citations, fines and the recording of a
Notice of Violation including a description of the action necessary to abate the violation.
You have thirty (30) days to voluntarily comply with the above directions or to present an
acceptable plan for.abatement or corrective actions to be taken by you. Should you have any

Re: continuing code problems
Dear Mr. Vierra:
This complaint would be in regards to parcel number 030-320-034, Michael Jones. It is
my understanding that your office previously removed Mr. Jones from that property for
code violations. I was told that he was living on property that he cannot legally live on.
Please be advised that for better that the last 2 months, he and another person have been
living on the property again.
Please accept this as a formal complaint on that situation. Mr. Jones lessens the value of
our property by his flaunting of the laws.

abate the noncompliance, or unless a Notice of Compliance is recorded, or unless the provisions of Section 41-10(a)
are waived by the Director of the affected County department. A Notice of Compliance may be recorded after the
noncompliance has been corrected or abated, upon payment of a $300.00 fee.

This is a formal warning notice. Pursuant to Butte County Code (BCC) Section 41-2, we sent you a
courtesy notice dated January 11, 2001, notifying you that you are in violation of the BCC, and 1998
California Building Code (CBC), at the above -referenced location. As of this date, the following
violations still exist:
Failure to obtain the required permits; inspections and approvals from this office for the
construction of a shop/ag. building, and deck is in violation of the 1998 California Building Code
adopted by Section 26-1 of the Butte County Code as follows:
(a) Section 106.1 Permits Required
(b) Section 108.1 Inspections Required
(c) Section 108.4 Inspection Approval Required Before Use or Occupancy
(d) Section 3405 Change in Use Requires Confonnance to Code
The above violations(s) shall be corrected or abated by you by submitting three (3) complete sets of plans,
applying for the required permits, and paying the appropriate fees, including penalties. After permit
issuance and field authorization to proceed, the work must be completed and approved by this office
within the permit specified'time.
In addition to the above referenced violations the following use is in violation of the Butte County Code:
1. Unauthorized camping or otherwise occupying a recreational vehicle.
This warning letter also advises that Item Number 1 listed above is a use that is in violation of the Butte
County Code, as follows:,

Butte County Code, Chapter 24, Section 24-260 - Camping Limitations and Prohibitions.
A. No person shall place or park or allow the placing or parking of any trailer coach,
recreational vehicles, tent trailer or tent, or otherwise occupy or allow the occupancy of
any parcel (as defined in Section 24-305.310) for the purpose of camping (as defined in
Section 24-305.095) on public or private property within the County for a period in
excess of 9 days in any one calendar year, except in an outdoor recreational facility,
campground, recreational vehicle park, or hunting/fishing camp, lawfully established and
maintained pursuant to this Chapter.
The determination that Item Number 1 referenced on page 1 exists on the property is based on the
following definition in the Butte County Code:
Butte County Code, Chapter 24, Section 24-305.095 - Camping. Occupying or maintaining for
occupancy any place for temporary living, sleeping or other human occupancy purposes.
"Camping" does not include: The parking or storage of an unoccupied and otherwise unused
trailer coach, recreation vehicle, or tent trailer on a privately owned parcel, as defined in Section
24-305.31; occupying a trailer coach, or recreation vehicle, connected pursuant to county permit
to permanent sewage disposal and- water supply systems; or occupying a trailer coach or a
recreation vehicle for any accessory use allowed in the applicable zoning district.
This -is your final warning. Unless you contact this office and make the proper arrangements to correct or
abate the violation(s) voluntarily, within -ten (0) days from the date of this..letter; enforcement shall be
pursued through the issuance of a citation (ordering -you to appear in court) for said violation(s) and for
failing to comply with this warning letter. .
Upon conviction of, said violation(s) or .of failing to comply' with this letter, the court shall impose
penalties (fines) and a.Notice of Violation shall,be recorded in accordance with Butte County Code
Section 41-7., The Notice of Violation shall include a description of the premises the violation concerns, a
description of the violation, the date'of your conviction and the action necessary to correct or abate the
violation(s).
