RESOLUTION NO. 3677
A RESOLUTION ABANDONING THAT CERTAIN PORTION
OF BUTTE AVENUE LYING EAST OF 5th STREET AND
WEST OF 4th STREET AND FINDING THAT SAID
PORTION OF BUTTE AVENUE IS UNNECESSARY FOR
PRESENT OR PROSPECTIVE PUBLIC STREET PURPOSES
AND RESERVING AN EASEMENT AND PROPRIETARY
RIGHT FOR PUBLIC UTILITY PURPOSES
BE IT HEREBY RESOLVED, by the City Council of the City of
Oroville as follows.:
1. That the above described portion of Butte Avenue
lying East of 5th Street and Weskt of 4th Street and depicted.on
that plat attached hereto labeled Exhibit "A" and by this refer-
ence incorporated herein is unnecessary for present or prospective
public street purposes, and
2. By virtue thereof said portion of Butte Avenue is
hereby vacated and abandoned, with the City, however, specifically
reserving all. proprietary rights of the City and/or any public
utility in and to any pipes, wires, conduits or other similar
property of a public nature including all easements and rights
of way referable thereto, and in particular reserving unto the
City an easement and right of way for public utility purposes
10 feet in width adjoining and adjacent to the Northerly edge
of Butte Avenue as realined and more particularly described in
Exhibit "B" attached hereto and by this reference incorporated
hereat.
3. The City Clerk shall attest to the adoation of
his Resolution.

RE: Abandonment of a Portion of Butte Avenue
In January 1980, the City receiveda request to abandon the
northerly 40' of Butte Avenue in Block 19 of Thermalito from
Ray Martin, Manager of Oroville Title Company. This request
was reviewed by the Planning Commission on April 14, 1980,
June 9, 1980, October 13, 1980, November 10, 1980, March 9,
1981, April 13, 1981, and June 8, 1981. The City Council
reviewed the abandonment on May 4, 1981, May 18, 1981, and
July 6, 1981.
In April 1981, the Planning Commission recommended to the City
Council that Butte Avenue be realigned and..that portion of the
existing Butte Avenue not utilized in th.e realignment be
abandoned finding that this portion is not necessary for
present or future road purposes. The realignment shall be a
40' right-of-way, a 10' public utility easement shall be
dedicated on the north boundary of the realignment, and a 30'
cul-de-sac shall be constructed at the east end of the
realignment.
On May 4, 1981, the City Council held a public hearing on the
Commission's recommendation and continued action on the
abandonment to May 18, 1981. Because of input received at the
May 18, 1981 meeting, the Council referred the matter back to
the Planning Commission for reconsideration of their original
recommendation.
The Commission reconsidered the abandonment�.on June 8, 1981.
The Commission's recommendation to the City Council is
outlined in the attached memo.

On July 6, 1981, the City Council approved Resolution. No. 3677
abandoning only the southerly 10' and northerly 10' of Butte
Avenue, and reserved the northerly 10''as an easement for
public utlities.
Resolution No. 3677 is not clearly written:although it does
say "that certain portion of Butte Avenue...." and no Exhibit B
has been found.
In essence, the City Council abandoned 10'.'of the northerly
portion of -Butte Avenue and then reserved that same'10' as an
easement.
There still exists.60' of right -of -wap along AP No's. 31-22-6-
012, 019, 020, 021 and 022 with the remainder of Butte Avenue
having an 80' right-of-way.
