Applications for which a permit has not been issued, will expire by limitation one year after date of application. In
order to renew action on an application after expiration, a new application, plans and fees will be required.
FEE REFUNDS
Refunds can only be made upon written request by the person who paid the fee. The request must be made within
two years from the date of fee payment on permits not issued, and two years from the date of permit issuance for
permits issued; however, on issued permits refunds can only be made if no construction work has been done. Filing
fees, plan checking fees for work plan checked and other department costs are not refundable.

404.1 System Selection. Refrigeration systems shall be limited in application in accordance
With Table 1 l -B and the requirements of this section.
1104.2 Volume of Occupied Space. The quantity of refrigerant in a high -probability system
shall not exceed the amounts shown in Table 11-A based on the volume of the normaV
occupied space. The volume, of the smallest, enclosed, normally occupied space shall be used
to determine the permissible quantity of refrigerant in a system which is located in, serves or
,passes through such space.
EXCEPTIONS: 1. If the airflow to any enclosed spaced served by a porion of an air -
duct system cannot be shut off or reduced below one quarter of its maximum, tie
cubical contents of the entire space served by that portion of the air -duct system may
be used to determine the permissible quantity of refrigerant in the system.
2. Refrigerated process or storage areas meeting the requirements of
Section 1104.3.
INTERPRETATION:
1995 California Mechanical Code, Tables 1 I -A and I I -B amended'as shown on the attached
Tables.
REASON:
Current Code language prohibits the use of high -probability, direct expansion, coolig
systems in I-1.1 Occupancies. This prohibition is inconsistent with ANSI/ASHRAE Standard
15-94, Safety Code for Mechanical Refrigeration and will create unanticipated financila
hardship for some health care facilities. OSHPD has determined that the cost of compliance
with the current Uniform Mechanical Code (UMC) language far exceeds the benefits tha
might be achieved by compliance.. OSHPD has contacted a sampling of the members of the
ICBO Subcommittee that wrote UMC Chapter i l and determined that the UMC prohibition

Dear Mr. Vieira;
I have attached a draft version of Chapter 11 Refrigeration from the new 2000 International
Mechanical Code with specific regard to direct expansion mechanical systems within 1-3
occupancies, which Shulamit Rabinovich, of Ted Jacobs Engineering Group, has provided me.
As Shulamit and I have discussed previously with you, the new mechanical code will allow DX
type units in 1-3 occupancies.
Please note however the following:
1. (page 2) Section 1103, 1103.2.1 classifies refrigeration systems and their allowable use
in 1-3 Occupancies,
2. (page 3) Table 1103.1 Refrigerant Classification and Amount lists the R-22 type of
refrigerant proposed for the Butte County Juvenile Ball, as type A-1, not to exceed 9.4
pounds/ per 1,000 cubic feet,
3_ (page 5) Section 1104.2.1 reduces the amount of refrigerant shown in the above-
mentioned table by 50%
Therefore, even with the reduction of the amount of refrigerant to 4.7 pounds/ per 1,000 cubic feet
in 1-3 Occupancies, the previously -calculated amount of refrigerant for Butte County Juvenile Hall
still falls well below this at:
o 2.68 pounds per 1,000 cubic feet of total volume cell space, and
a 0.75 pounds per 1,000 cubic feet of total volume dayroom space
I hope you find that the information being provided to be satisfactory in order to accept our
request to use OX units. Although, the new code is still in draft form awaiting approvals, the
allowance of DX in 1-3 institutions Is expected to be accepted without further debate. Since time

Proposed variance - to allow use of the high probability systems ( DX systems) in the
correctional facilities.

By allowing only low probability systems in Occupancy Groups I-3 the Uniform Mechanical
Code creates a financial hardship for correctional facilities. Based on the overall benefit, the cost
to correctional facilities and the public is unreasonable.
The Uniform Mechanical Code's (UMC) prohibition of high probability systems in correctional
facilities is not based on any recognized standard. The UMC is more prohibitive than the
American National Standards Institute/ American Society of Heating, Refrigeration and AIR
Conditioning Engineers (ANSI / ASHRAE) Standard 15-94, Safety Code for Mechanical
Refrigeration. The proposed variance will make code enforcement for correctional facilities
consistent with the nationally recognized ANSI / ASHRAE Standard 15-94, Safety Code
Mechanical Refrigeration.
Approval of the variance to use DX systems - High Probability System results in the
enforcement of a nationally recognized standard that protects the public health and safety at a

Dear Michael:
We are currently designing the mechanical systems for the new Butte County Juvenile Detention Facility in
Oroville.
As we proceeded into the design of this facility, we have had numerous discussionswith the County regarding
available mechanical system for satisfying the air conditioning needs. Our two choices are air cooled chillers
running a chilled water system or a direct expansion (DX) type system. As you are aware, the California
Building Code has dis-allowed DX type systems for institutional, i.e. hospital and detention type occupancies
(1-1.1 and 1-3).
However, California OSHPD, which oversees inspection and licensing of 1-1.1 occupancies has allowed DX
units in current projects, recognizing the cost implications of using chilled water cooling systems on small" ;
projects. OSHPD issued a CAN (Code Application Notice), based on ANSI/ASHRAE Standard 15-1994, see
Attachment #1.
In addition, we have contacted various Code Agencies and the following is a summary of information regarding
how various Codes and Agencies address use of refrigerants in Institutional Occupancies:
IMC - Not addressed, not prohibited.

All group Al refrigerants are not toxic. Any potential injury stems from leaking refrigerants displacing oxygen
from the air. Small amount of refrigerant cannot do that.
For this project, we have prepared the following information:
Volume of cells served by a single Air Conditioning Unit -11,167.6 cubic feet. Amount of refrigerant in the unit
(R-22) is 30 Ib. (based on Armstrong Model LGA -210).
As' a result, there are 2.68 pounds per 1,000 cu. ft. of the enclosed cells space.
If, in addition to the cells, dayroom volume is considered (28,600 cubic feet) then the amount of refrigerant
per 1,000 cubic feet of space is equal to .75 Ib.
Per 1998 CMC table 11-A an allowable quantity for high probability systems for R-22 is 9.4 Ib. per 1,000 cubic
feet of space.
The proposed system will contain only 8.02% of the allowable quantity of the refrigerant.
Please note that in order to comply with the Code requirements, the stoppers are provided at all volurime' '
dampers so that the airflow to any enclosed space served by a portion of an air -duct system cannot be shutoff
or reduced below one quarter of its maximum.
Based on the above, we request that the County allow Code variance for the Table 11-B Occupancy 1-3 for
high -probability system to revise "NONE" to read "Group Al only".

INTERPRETATION:
At the request of owner or owner's representative the Office will allow use of high -
probability systems in Hospitals, Skilled Nursing Facilities and Correctional Treatment
Centers per ASHRAE Standard 15-1994, safety Code for Mechanical Refrigeration as an
alternate to Sections 1104.1 and 1104.2 and Tables 11-A and 11-B, 1998 Califo is
Mechanical Code.
REASON:
Current Code language prohibits the use of high -probability, d ect x ansio cooling
systems in Hospitals, Skilled Nursing Facilities, License li 'cs, 'd: ;Co ectional
Treatment Centers. This prohibition is inconsistent wit AN /ASHRA Staii' d 15-
94, Safety Code for Mechanical Refrigeration

5.2.2 Low -Probability System. A low -probability sys-
tem is any system in which the hasic design, or location of
the components, is such that leukage of refrigerant from a
Failed connection, seal, or component cannot enter the occu-
pied space. Typical low -probability systems arc (a) indirect
closed systems or (b) douhle indirect systems and (c) indirect
open spray systems if the following condition is met:
In a low -probability indirect open spray system, the
secondary coolant pressure shall remain greater
than refrigerant pressure in all conditions of opera-
tion and standby. Operation conditions are defined
in 9.2.2.1 and standby conditions are defined in
9.2.2.2.
53 Changing Refrigerant. A change in the type of refrig-
erant in a system shall not be made without the notification
of the authority having jurisdiction, the user, and due obser-
vance of safety requirements. The refrigerant being consid.
ered shall be evaluated for suitability.
6. REFRIGERANT CLASSIFICATION
6.1 Refrigerants are classified by ANSUASHRAE 344 into
safety groups illustrated in the following matrix:

6.2 Single -component refrigerants and azeotropic blends
so classified are listed in ANSI/ASHRAE 34-19924 along
with the criteria for classification. The safety group classifi-
cations shown in Table 1 of this standard originate in ANS1/
ASHRAE 34-1992. Additional refrigerants are included in
ANSI/ASHRAE 34-1992. As new data become available,
refrigerant classifications are subject to change in ANSI/
ASHRAE 34.1992.
6.3 Zcotropic blends are classified by worst-case composi-
tion of fractionation as follows:
For refrigerants that are capable of change in flammabil-
ity or toxicity. such as by fractionation of zcutropcs, a dual
rating. separated by a solidus (/), shall be provided. The first
ruing shall be the classification of the refrigerants as formu-
latcd. The second rating shall be the classification of the worst-
case composition of fractionation (.,;cc Appendix C for details).
7. RESTRICTIONS ON REFRIGERANT USE
7.1 System Selection. Refrigerating systems shall be
applied in accordance with T:thlc 2 and the requirements of
7.2, 7.3. and 74.
To use Table 2. determine the occupancy class in accor-
dance with Section 4. safety refrigerant group per ANSI/
ASHRAE 344 (a partial lilt is given in Table 1 For the conve-
nience of the user). anti

one rule exists, each is a limitation on the other.
7.2 General Restrictions—Safeguards. Means shall be
taken to adequately safeguard piping, controls, and other
refrigerating equipment to minimize
possible accidental
damage or rupture by external sources.
7.3 General
Restrictions—Nonindustrial Occupancy
7.3.1 Stairways and F,xitways. Refrigerant piping shall
not be installed in an enclosed public stairway, stair landing,
or means of egress.
7.3.2 Corridors and Lobbies. Portions of a refrigerating
system shall not interfere with free passage through public
corridors, and refrigerating systems installed in n public cor-
ridor or lobby shall be limited to (a) unit systems containing
not more than the quantities of Group Al refrigerants speci-
fied in Table 1 or (b) sealed absorpti
on systems as specified
in Table 3.
7.3.3 Unventilated Spaces. When the refrigernnt-con-
tainingparts of a system are located in one or more unventi-
lated spaces, the volume of the smallest occupied space shall
be used to determine the permissible quantity of refrigerant
in the system. This does not apply to machinery rooms since
they are always ventilated and are not considered occupied
space. If the limitations of Table 1 are exceeded, a machinery
room is required.
When a building consists of several stories of unparti-
tioned space, the permissible quantity of refrigerant in the
system shall be based on the volume of the smallest occupied
story
.
7.3.4 Ventilated Spaces. When an evaporator or con-
denser is located in an air duct system, the volume of the
smallest occupied space—or, in the case of an unpartitioned
multi -story building, the volume of the smallest occupied
story—served by the duct shall determine the permissible
quantity of refri
gerant in the system.
Exception: When the air duct system serves several
enclosed spaces, the permissible quantity of refrig-
erant in the system Shall not
exceed the amount
determined by using the total volume of those
spaces in which the airflow cannot be reduced to
less than one-quarter of its maximum when the fan
is operating.
7.35 Plenums. The space above a suspended ceiling
shall not be included in calculating the permissible quantity
of refrigerant in the system
unless such space is continuous
and is part of the air return system.

7.4 System Application Requirements
7.4.1 Equipment Applied in a High -Probability Sys-
tem. In addition to the provisions of 2.5, listed equipment
with refrigerant charge not exceeding 6.6 lb (3 kg) shall be
deemed to meet the system application requirements when
the equipment is installed in accordance with its listing and
manufacturers installation instructions.
7.4.2 General System Application Requirements.
Except as permitted in 7.4.1, the following rules for system
application requirements are applied as specified in Table 2,
based on refrigerant group,4 system probability, and occu-
pancy. These rules do not stand alone.
Blends that are capable of fractionating to change the
flammability or toxicity (see 6.3) are treated according to
their worst-case classification. For example, an AIIA2 blend
follows the rules for A2 refrigerants. The amount of blend
allowed corresponds to the limit on the quantity of A'_' refries
crani in the blend. The total amount of the blend is limited as
in footnote d of Table 1.
Rules:
1. The quantity of refrigerant in each system shall be lim-
ited as listed in Table 1. The quantity of refrigerant per
occupied space shall be the maximum amount of refrig-
erant that will leak into the occupied space at any one
time, based on a leak from any single independent
refrigeration circuit.
2. The quantity of refrigerant in each system is (inured to
50% of the amount listed in Table 1.
Exception: Rule I applies in kitchens, laboratories, and
mortuaries. If any portion of a refrigernnt system
containing more than one pound of refrigerant
(except R-744) is in a room with a flame -sustaining
device, this device shall be provided with a hood to
exhaust combustion products to the open air, Oth-
erwise Rules 5 and 6 shall be followed.
3. For refrigerating systems of 100 hp (74.6 kW) or less.
when the quantity of refrigerant in tach system exceeds
Table 1 quantities, the rules for commercial occupancy
shall apply unless the following occurs:
(a) occupancies containing machinery are separated
from other occupancies by tight construction and is
with tight -fitting doors:
