On November 22, 1999 an inspection was conducted -by this department. The owner. (Philip Wilson) and tenants are not currently occupying the structure. The'structure at this site has numerous electrical hazards including but not limited to open conductors and conductor splices, . unprotected conductors, and a lack of proper grounding and bonding. The structures have been posted for non -habitation. ° As the Chief Building Inspector for Butte County, I am requesting that the electrical and gas to the structure referenced above be disconnected until appropriate actions are taken to resolve'the hazards. Further, I request that the electrical and gas service not be reconnected until an authorization from this Department is granted to'do so. Accumulation of garbage for more than seven (7) days. This warning letter also advises that Item No. 9 is a use that is•in .violation of the Butte County Code, as follows: Butte County Code, Chapter 24, Section 24+65 - Applicability of zoning regulations. All uses of land within a zoned district not specifically authorized or permitted by regulations are prohibited. Butte County Code, Chapter 31, Section 31-50 - The owner or tenant of any premises, business establishment or industry shall be responsible for the satisfactory removal of solid waste accumulated on said premises. To prevent propagation, harborage or attraction of flies, rodents or , other vectors and the creation of a nuisance, solid waste, excepting non-flammable inert material, shall not be allowed to remain on the.premises for more than seven (7) days. Non-flammable inert materials stored on a premises shall not be allowed to become either a harborage for rodents, insects or other vectors, nor a'public. nuisance. Such inert non-flammable materials which are not properly stored shall not be allowed to remain on a premises for more than thirty (30) days. , The determination that Item No. 9 exists on the property is based on the following definitions in the Butte . County Code: 1 • • k 1. Butte County Code,' Chapter 24,Section 24-305.170 Garbage. "Garbage" means every accumulation of animal or vegetable waste, matter -that attends or results from the preparation, consumption, decay, .dealing in, or storage of meat, fish, fowl,'fruits, vegetables or other, food products and shall include any food container in which there is putrescible material either solid or liquid. L Butte County Code, Chapter 24, Section 24-305.370 - Rubbish. "Rubbish" shall mean all nonputrescible solid wastes, combustible, or noncombustible, including, but not limited to, paper, cardboard, yard clippings, grass, ashes, wood; bedding, crockery, .glass, metal and other similar -materials, excepting compost boxes. Butte County Code, Chapter 24, Section 24-305.360 - Refuse. "Refuse" shall mean and include any solids or semi-solid waste other than domestic sewage, including, but not limited to, garbage,. rubbish and trash. Butte County Code Chapter 24, Section 24=305.451 - Violator.- An adult owner, tenant, occupant, f resident or other person having possession, control or any other ownership interest in or the right .of access to the premises, who is suspected .or alleged to have violated or to be in violation of any Butte County Code provisions of the Chapters specified in Butte County'Code Section 24-305..451. It is the County's goal to obtain voluntary compliance with the California Title 25. However, you should be advised that Butte County ha's an active code enforcement program which provides an effective means of enforcement. A re -inspection will be made to determine compliance. Provided, however, that any expansion, enlargement or extension of the nonconforming use be allowed only upon securing a use permit pursuant to Section 24-43. Any such - restoration or reconstruction of a nonconforming use not requiring a use permit shall commence within twelve (12) months and be completed within twenty-four (24) months of the time of damage or' it shall be deemed aban doned. Upon application to the planning commission an extension of time - for the restoration of a nonconforming.use may be granted not to exceed five (5) years in total. SECTION 24-37.8 MAINTENANC3.AND REPAIRS FOR SAFETY Nothing in this chapter shall prevent the normal, ordinary, customary maintenance of a nonconforming use provided that such maintenance does not . include major structural alterations which have the effect of expanding, enlarging or extending the nonconforming use. Nothing in this chapter shall prevent any such repair, alteration or restoration to a safe condition of any portion of a nonconforming use when so directed by the Butte County Public Works Director upon a findingithat'such is necessary for the protec- tion of the public health .and safety. SECTION 24-37.9 CONSTRUCTION -- USE 'PERMITS -- AMENDMENTS (a) Nothing in this chapter shall require any change in the.plans, con- struction size or designated use of any land, building or structure for which building permits have been issued', in accordance with the provisions of'.this chapter or ordinances -then -in effect. Provided, however, that the actual, use or construction under such permit has started prior to the effective date of this chapter -and in all such cases be carr ied.out in a normal manner until completion. (b) Except as provided in subsection (a) of this section and Section -24-43, any rezoning or subsequent amendment of this chapter which has the effect of eliminating a particular conditional use or.changing the conditions under which a particular conditional use -may be allowed shall remain valid, unless specifically stated to the contrary in .the amending ordinance. Subject to the limitations of Section 24-43 any such use permits shall remain valid and may be used, extended, trans- ferred or modified through amendment to the same extent thatithe rezoning or amendment was not adopted.' It appears the odor is due to leakage from the toilet wax ring seal, which has saturated*. - the carpet installed around the toilet. .I also noted open wiring on :the lights on the enclosed front porch.. The following recommendations are made to correct these conditions: 1. Check the toilet for leaks;. replace' the seal if leaking. 2. 'Remove the carpet from around the toilet, and replace with a smooth, cleanable waterproof material. 3. Provided, however, that any expansion, enlargement or extension of the nonconforming use be. allowed only upon securing a use permit pursuant to Section 24-43. Any such restoration or reconstruction of a nonconforming use not requiring a use permit shall commence within twelve.(12) months and be completed within twenty-four (24) months of the time of damage or it shall be deemed aban-' doned. Upon application to the planning commission an extension of time for the restoration of a nonconforming use may be granted not to 'exceed five (5) years in total. SECTION 24-37.8 MAINTENANC3 AND REPAIRS FOR SAFETY Nothing in this chapter shall prevent the normal, ordinary, customary maintenance of a nonconforming use provided that such maintenance does not . include major structural alterations which have the effect of expanding, enlarging or extending the nonconforming use. Nothing in this chapter shall prevent any such repair, alteration or restoration to a safe condition of any portion of a nonconforming use when so directed by the Butte County Public Works Director upon a finding that such is necessary for the protec- tion of the public health and safety. SECTION 24-37.9 CONSTRUCTION -- USE PERMITS -- AMENDMENTS (a) Nothing in this chapter shall require any change in the plans, con- struction size or designated use of any land, building or structure for which building permits have been issued; in accordance with the provisions of this chapter or ordinandes then in effect. Provided, however, that the actual use or construction under such permit has started prior to the effective date of this chapter and in all such cases be carried out in a.normal manner until completion. (b) Except as provided in subsection (a) of this section and Section 24-43, any rezoning or subsequent amendment of this chapter which has the effect of eliminating a particular conditional use or changing the conditions under which a particular conditional use may be allowed shall remain valid, unless specifically stated to the contrary in the amending ordinance. -Subject to the limitations of Section 24-43 any such use permits shall remain valid and may be used, extended, trans- ferred or modified through amendment to the same extent that the rezoning or amendment was not adopted.
