Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, the First United Pentecostal Church is hereby granted Use Permit 99-21 to allow a 900 square foot shop building, a 24' x 60' caretaker's mobile home and a 14, 400 sq. ft. church building with classrooms, kitchen and dining facilities, offices and storage rooms subject to the following conditions: Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning .Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and re-application and a new permit shall be required to establish the use. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: All new outdoor lights installed on the site shall be fully shielded. Lighting shall be directed downward and contained on-site. Excess light and glare shall not be allowed on adjoining properties. Prior to issuance of building permits, improvement plans showing the location and type of light fixtures to be installed shall be submitted to and approved by the Planning Division. (MM) 2. At the request of the adjacent property owner, prior to the issuance of a Certificate of Occupancy by the Building Division for the church structure, a solid fence of wood or masonry material, or cyclone and slatted, at least 6 feet in height shall be installed along the entire interior property line. (MM) . 3. A landscaping site plan is required to be submitted to and approved by the Planning Division prior to issuance of the building permit, grading or land clearing activities. The landscaping site plan shall depict landscaping surrounding the church and along the access road and list plant species including the locations where they are to be planted. Landscaping is required to be maintained in a healthy and living condition. The following specific requirements shall apply (MM): a. Perimeter landscape areas abutting a residential district shall have a vegetative screen of 60 inches minimum in height of evergreen plants. This is in addition to the solid fence of wood or masonry material as required by Condition 2. 'The vegetative screen is required whether or not a fence is installed at the request of an adjacent property owner as required by Condition 2. b. At least one tree shall be planted for every 10 spaces. The recommended spacing of trees within the landscape areas abutting a residential district is 8 to 12 feet apart. Trees shall be planted within islands of the parking area and evenly spaced. C. Method of irrigation system. d. A concrete curb shall be installed around the perimeter of each landscaped area at least 6 inches higher than the finished grade of the parking area. 4. Measures shall be taken to control fugitive dust emissions from all road and other civil construction associated with project improvements. Measures may include site and road watering and/or use of other acceptable sod palliatives. Dust control measures shall be noted on any necessary improvement plans. Questions regarding fugitive dust control may be directed to the Butte County Air Quality Management District at phone number (530) 891- 2882. (MM) Hours of construction shall be limited to 8:00 a.m. to 8:00 p.m., Monday through Saturday, with no work on Sundays.. (MM) 6. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 7. Prior to use of the site for uses approved ;vith this permit, the applicant shall contact the Planning Division for a field inspection to verify all conditions and ordinance requirements have been met. Outdoor activities, such as carnivals, festivals or weddings, etc. are restricted to daylight hours only Monday through Sunday. Indoor group activities are limited to 10:00 pm Monday.through Sunday, except for 12 events per year where group activities may occur past 10:00 P.M. . . 9. The grounds shall be adequately lighted. A evening caretaker/watchman may live on-site. 10. Prior to the initiation of use, an electronic security gate shall be installed at the entrance to the church from 10th Street. 11. One lighted sign of 4 feet x 8 feet, the top of the sign not more than 10 feet above the ground, is permitted at the entrance of 10th Street at the location depicted on the approved site plan. The sign shall be located outside the County's right-of-way. 12. Prior to the issuance of a Certificate of Occupancy by the Building Division for the church structure, fire hydrant identification, reflector or post reflectors shall be installed acceptable to the County Fire Warden. 13. A pressurized community water system is required for fire protection. Prior to the issuance of a Certificate of Occupancy by the Building Division for the church, install a new 6 inch fire hydrant at the 10th Street entrance and also at a location 300 feet from the 10th Street entrance as specified by the Butte County Fire Department. Specific locations and flow requirements shall be in accordance with the Fire Department specifications and to the satisfaction of the County Fire Warden. Residual fire flow shall be 2000 g.p.m. Submit plans to the Fire Department for review and approval prior to construction of facilities. (MM) 14. Prior to the issuance of a Certificate of Occupancy by the Building Division for the church structure, provide an all weather access of a least 10 foot wide and with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. 15. Prior to the issuance of a building permit deed to Butte County, in fee simple, 30 feet of right-of-way from the centerline of 10`'' Street. 'The right-of-way shall be sufficient for the installation of standard No. S-5 at all street intersections. 16. Prior to the issuance of a building permit submit road and drainage improvement plans for the installation and construction of street frontage improvements on 10`'' Street to RS -2A standard, including, but not limited to, P.C.C. curb, gutter and sidewalk and the required street section for parcels of one acre or less. Construct or install the required improvements prior to the issuance of a Certificate of Occupancy by the Building Division for the church structure. 17. Prior to the issuance of building permits, a plan for permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel of facility, and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Construct or provide bonding for the drainage facilities pursuant to Section 26 -13 of the Butte County Code. 18. Prior to building permit issuance for the proposed use, the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees may include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 19. Plans shall be prepared by a licensed architect or engineer authorized.to practice in the State of California. 20. The property owner shall record an avigation easement that will run with the land notifying future property owners, heirs and assigns of the Oroville Municipal Airport's right of continued use of the airspace above the project parcel and acknowledging any and all existing or potential airport operational impacts. 21. Building and roofing materials shall be selected which do not create significant reflection or glare.
