According to our records, the courtesy notice has not resulted in abatement or correction of the following specific violations: 1. The accumulation of junk in public view. Your failure to eliminate the stated violations is cause for the issuance of this formal warning notice. This is notice that as . of this date, our records indicate that the following violations to the Butte County Code still exist: • Butte County Code Chapter 24 Section 24-65 - Applicability of zoning regulations. All uses of land within a zoned district not specifically authorized or permitted by regulations are prohibited. • Butte County Code Chapter 24 Section 24-95 - The AR (Agricultural -Residential) zone does not "specifically authorize" large accumulations of junk. The storing of more than 100 square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A "junkyard" is not an allowed use in the AR zone without a Use Permit. "Automobiles and other vehicles, dismantled, in whole or in part" are considered to be "junk." Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or not, from storing junk in public view. The determination that this violation exists on the property is based on the following definition in the Butte County Code: Richard C. and Jeannette Walsh AP#031-260-024 January 26, 2005 Page 2 • Butte County Code, Chapter 24, Section 24-305.240 - Junk. Any worn-out and discarded material in general that may be turned to some use including, but not limited to, any old iron, wire, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of bicycles, tricycles, baby carriages, automobiles, and other vehicles, dismantled, in whole or in part, kept, stored, located, situated or piled in public view, and all other similar personal property ordinarily defined and classified as "junk" kept, stored, located, situated or piled in public view and not screened from public view by a fence. • Butte County Code, Chapter 24, Section 24-305.451 - Violator. An adult owner, tenant, occupant, resident or other person having possession, control or any other ownership interest in or the right of access to the premises, who is suspected or alleged to have violated or to be in violation of any Butte County Code provisions of the Chapters specified in Butte County Code Section 24-305.451. In order to bring the property into compliance with the Butte County Code and avoid further enforcement actions, you are hereby requested to take the following abatement or correction actions: 1. Remove all "junk" in accordance with the Butte County Code, Chapter 24, Section 24- 305.240. This is your final warning. Unless you contact this office and make. the proper arrangements to correct or abate the violation(s) voluntarily, within ten 10 days -from the date of this letter, enforcement shall be pursued through the issuance -of a'citati"on (ordering you to appear in -court) for said violation(s) and for failing to comply with this warning,letter. Upon conviction of said violation(s) or of failing to .comply with this letter, the court shall impose penalties (fines) and a Notice of Violation shall be recorded in accordance with Butte County Code Section 41-7. The Notice of Violation will include a description of the premises, the violation concerns, a description of the violation, the date of your convictions and the action necessary to correct or abate the violation(s). They observed a mobilehome which had previously been involved in a fire. Access to the interior of the remaining structure was not obtained but the following observations of substandard conditions were made from the exterior. 1. William LEONARD was wanted as a parolee at large and was subsequently taken into custody per the authority of 3056 of the California Penal Code. During a subsequent search of the residence, Detective Castillo found .4 grams of methamphetamine. Due to insufficient evidence to prove possession, William Patrick LEONARD was not charged with a violation of 11377 of the California Health and Safety Code, possession of a controlled substance. DETAILS• On October 26, 1995, Detective Castillo was contacted by Butte County Code Enforcement Officers Gary Brown and Frank Cooke. Officer Gary Brown asked Detective Castillo if he could accompany them to 1127 Placer Street in Thermalito, California while they posted the residence as being uninhabitable and notifying any individuals which might be living there. Officer Gary Brown told Detective Castillo that the residence had been destroyed by fire and during a previous visit to that location he encountered several individuals who appeared to be living in the residence. Gary Brown told Detective Castillo that when he identified himself as a code enforcement officer, several of the individuals fled the area. The reason Gary Brown was requesting assistance by members of BINTF, was that he believed there was possible narcotics activity taking place at that location. Part of this belief was based on the observation of garden hose which ran into the residence and appeared to have a constant source of water running through it. When Gary Brown asked a subject at the residence what the water was running to,. the subject told Gary Brown he did not know. According to Officer Brown, there was no electricity at the residence. BUTT E = NTE RAOENCY NARCOT = C S TAS K FORC E CASE NO.: B95 -UO -216 PAGE: 2 SUBJECT: LEONARD, William Leonard DATE: October 26, 1995 At approximately 1430 hours, Detective Castillo and support personnel accompanied Gary Brown and Frank Cooke to the Placer Street address. Support personnel consisted of the following individuals, BINTF Detectives John Thulin and Scott Malinowski, and BASS member Deputy Rick Hamilton. Upon arrival at the location, Gary Brown and Frank Cooke went to the residence and made contact with an individual who was later identified as William Patrick LEONARD. William LEONARD was the only subject at the residence at that time. Detective Castillo and support personnel waited at the road and were not involved in the initial contact with William LEONARD. During their contact with William LEONARD, Butte County Code Enforcement Officer Gary Brown asked him for permission for Code Enforcement Officers and BINTF personnel to enter the residence for the purpose of an inspection. William LEONARD granted permission. William LEONARD was first to enter the residence and did not allow anybody in for approximately one minute. During this time, Detective Castillo observed William LEONARD to be moving about in the area of a closet. It appeared to Detective Castillo that William LEONARD was attempting to conceal something within the closet. William LEONARD subsequently allowed individuals to enter the residence to conduct inspection. Through questioning, it was determined that William LEONARD was currently on active parole. California State Parole Agent Steve Mills was contacted and he subsequently responded to the residence. During the contact with William LEONARD, he told Detective Castillo that he was not living at the residence, however there was property in the residence that did belong to him. Because William LEONARD was on active parole and the fact that he did have belongings stored at the residence, a subsequent search was conducted. During the search of the residence, Detective Castillo focused on the closet where William LEONARD had been moving about and had appeared to have concealed something. Located on the floor of the closet beneath a pile of clothing, Detective Castillo found a plastic bag which contained an off-white powder material, believed to be methamphetamine. Detective Castillo performed a presumptive chemical test on this white powder which proved positive for methamphetamine. It was subsequently labeled GC -lb. The methamphetamine had a net weight of .2 grams. On the floor adjacent to this plastic bag Detective Castillo found a folded pharmaceutical type paper bindle, which was wrapped with orange tape. Contained in this paper bindle was an off-white powder substance, BUTTE 31NTERAGENCY . NARCOT = C S TASK FORCE CASE NO.: B95 -UO -216 PAGE: 3 SUBJECT: LEONARD, William Leonard DATE: October 26, 1995 believed to be methamphetamine. Detective Castillo performed a presumptive chemical test on the white powder which proved positive for methamphetamine. This methamphetamine had a net weight of .2 grams. It was subsequently labeled GC -2a. Also found with these items was item GC -3 a section of clear plastic bag which had been heat sealed on one end. This bag was empty. Located on the floor of the residence was a duffle bag which belonged to William LEONARD. Found in that duffle bag was a California Drivers License number N0408424, which was issued in the name of William Patrick LEONARD. Also found in that duffle bag was a bottle of prescription medication issued to William Patrick LEONARD. These items were taken as indicia. Although William LEONARD told Detective Castillo that he was not living at the residence, there was evidence that contradicted this statement. Numerous items of clothing belonging to William LEONARD were found in the residence. Also found in the residence were two ice chests that were filled with various items of' food. The interior of the residence was neatly kept and appeared to have been recently been lived in. Based on the items found in the residence, it was the opinion of Detective Castillo that William Patrick LEONARD was currently residing at that location. California, State Parole Agent Steve Mills directed Detective Castillo's attention to a window sill which was adjacent to and directly above the bed. Agent Mills pointed out to Detective Castillo a knife with a six inch blade which was stuck between the wooden window sill and the wall board. Agent Mills told Detective. Castillo that the proximity of this knife to the bed and the fact that William LEONARD appeared to be living in the residence constituted a parole violation. As a result of this violation, Agent Steve Mills placed a parole hold on William Patrick LEONARD per the authority of 3056 of the California Penal Code. Detective Castillo conducted a subsequent interview with William Patrick LEONARD. Prior to questioning William LEONARD, Detective Castillo advised him of his constitutional rights per miranda. When asked if he understood his rights, William Patrick LEONARD told Detective Castillo yes. When asked if he would waive his rights and answer questions, William Patrick LEONARD told Detective Castillo yes. The following is a summary of that interview. William LEONARD told Detective Castillo that although he had property and clothing at the residence, he was not currently residing there. As for the clothing in the residence, William LEONARD told Detective Castillo that he would bring the clothing with him in case he needed it. When questioned about the methamphetamine located in the closet, William Patrick LEONARD denied any knowledge of those items being in the residence. However, William LEONARD told Detective Castillo that he was a current user of methamphetamine. Although this methamphetamine had been located in the closet where William LEONARD had been seen moving about, the elements of possession in this investigation are somewhat difficult to prove based on the following circumstances. The residence in which William LEONARD was found had been partially destroyed by a fire and was left uninhabitable. Due to the fire, what was left of the residence could not be secured. The residence itself did not belong to William LEONARD and there were other individuals who did have regular access in and out of the residence. This information was confirmed by the property owner who arrived at the residence. Because the elements of possession are somewhat questionable, no criminal charges will be filed against William LEONARD with regards to the possession of methamphetamine. However, a violation of parole was established based on the location of the knife in the window sill and as a result, Parole Officer Steve Mills placed a hold per 3056 of the California Penal Code on William LEONARD. William LEONARD was subsequently transported to the Butte County Jail. RECOMMENDATIONS: This report was taken for information purposes only. The methamphetamine located in the residence was seized as contraband for destruction. The California Driver's License and prescription medications belonging to William LEONARD were taken as indicia. However, they can be returned to William LEONARD upon his request. (b) Tanks shall be located in an area not accessible to motor vehicles or shall be provided with protection from contact by vehicles by means of posts or other permanent barriers. (c) Tanks elevated above ground shall be maintained on rigid noncom- bustible supports of adequate size to support the tank when filled, in- stalled on concrete foundations or footings to prevent• movement or settling. The tank shall be securely fastened to the supporting frame. (d) Every tank shall be adequately designed, installed, vented, and maintained to prevent entrance of rain and debris. (e) A shutoff valve located immediately adjacent to the gravity feed connection of a tank shall be maintained in the supply line to the mobile home. (f) Fuel oil connectors from the tank to the mobile home shall be brass orcoppertubing or approved flexible metal hose not smallerthan 3/8 inch and shall be protected from physical damage. Aluminum tubing shall not be used. (g) Valves and connectors shall be listed standard fittings maintained liquid -tight to prevent spillage of fuel oil on the ground. (2) Lack of, or improper kitchen sink. (3) Lack of hot and cold running water to required plumbing fixtures in a mobile home. (4) Lack of adequate heating facilities. (5) Lack of adequate lighting. (6) Lack of adequate ventilation. (7) Lack of adequate room and space dimensions. (8) Dampness of habitable rooms. (9) Infestation of insects, vermin, or rodents. (10) General dilapidation or improper maintenance. (11) Lack of connection to required sewage disposal system. (c) Structural hazards shall include but not be limited to the following: (1) Deteriorated or inadequate stabilizing devices. (2) Defective or deteriorated flooring or floor supports. (c) Tanks of not more than 500 U.S. gallons may be maintained on a mobile home lot, providing the distance to a mobile home, important building, property line which may be built on, or source of ignition, is at least 10 feet. Authority to Order Disconnect Fuel Gas Equipment The enforcement agency is authorized to order the gas utility or person supplying gas to a mobile home park to disconnect any gas piping or equipment found to be defective and in such condition as to endanger life or property. Gas piping or equipment which has been ordered disconnected by the enforcement agency shall not be reconnected to a gas supply until a per- mit has been obtained to alter or reconstruct the gas piping and the com- pleted work has been inspected and approved by the enforcement agency. Toilets, showers, and lavatories shall continue to be provided as fol- lows: (a) In mobile home parks constructed and operated exclusively for de- pendent mobile homes: One toilet, one shower, and one lavatory for each sex for each 15 dependent mobile home lots. (c) Toilet facilities for dependent mobile homes shall not be farther than 400 feet from any dependent mobile home lot. (d) Each toilet shall be for the exclusive use of the occupants of the mo- bile home lots in the mobile home park. (e) mobile home parks constructed and operated exclusively for inde- pendent mobile homes need not be provided with public toilets, showers, or lavatories. (f) Toilets, lavatories, and showers shall be within 400 feet of all lots not provided with a lot water service outlet and a three inch lot drain inlet. (g) Toilet, lavatory, and shower facilities shall be separated and dis- tinctly marked for either men or women. (h) Showers shall be provided with hot and cold running water. Each shower shall be contained within a separate compartment. Each shower compartment shall be provided with a dressing area of not less than six square feet of floor area that shall have hooks for hanging clothing and a bench or chair for use by the occupant. A mobile home lot drain inlet need not be provided with a trap except where a mobile home not bearing insignia of approval is installed, or pro- posed to be installed, on a lot and the enforcement agency determines that the mobile home plumbing fixtures are not protected by approved traps. The park operator shall obtain the necessary permits from the enforce- ment agency and shall install the required trap and vent on the lot drain inlet. (a) A mobile home shall be connected to the mobile home lot drain inlet by means of a drain connector consisting of approved pipe not less than Schedule 40, appropriate fittings and connectors, and shall not be less in size than the mobile home drain outlet. The fitting connected to the mo- bile home lot drain inlet shall be a directional fitting to discharge into the drain inlet. A flexible connector shall be used at the lot inlet end of the pipe. (b) Drain connectors for recreational vehicles may be of flexible non - collapsible hose having a smooth interior finish. Recreational vehicles occupied as a residence or located year-round in a mobile home park shall have a drain connector complying with subsection (a). (c) A drain connector shall be maintained with a grade not less than one-eighth inch per foot. A drain connector shall be gastight and no long- er than necessary to make the connection between the mobile home drain outlet and the drain inlet on the lot. If the mobile home or recreational ve- hicle is in such condition that identification numbers are not available to determine ownership, the notice shall be given to the owner of the land on which the mobile home or recreational vehicle is located. The notice shall state the conditions which render the mobile home or recreational vehicle unfit for human occupancy or use and shall order the abatement thereof within 30 days after date of notice. If, in the opinion of the en- forcement agency, such conditions can be corrected or abated by repair thereof, the notice shall state the repairs which are required. (a) If the initial notice of the enforcement agency has not been com- plied with on or before the expiration of 30 days after date of notice, the enforcement agency may institute proceedings for the abatement of the mobile home or recreational vehicle. (b) If the enforcement agency determines to proceed with the abate- ment, it shall give notice of intention to abate the mobile home or recre- ational vehicle as apublic nuisance not less than 10 days priorto such ac- tion. The notice of intention to abate shall contain a statement of the hearing rights of the registered and legal owners of the mobile home or recreational vehicle and the owner of the land on which the mobile home or recreational vehicle is located. The statement shall include notice to the property owner that he may appear in person at a hearing or may pres- ent a sworn written statement denying responsibility for the presence of the mobile home or recreational vehicle on the land, with his reasons for such denial, in lieu of appearing. The notice of intention to abate shall be mailed, by registered or certified mail, to the owner of the land as shown on the last equalized assessment roll and to the last registered and legal owner of record of the mobile home or recreational vehicle, unless the mobile home or recreational vehicle is in such condition that identifica- tion numbers are not available to determine ownership. The notice of in- tention to abate may also be served by personal service at the discretion of the enforcement agency. (c) The officer or employee of the enforcement agency upon giving no- tice as aforesaid shall file an affidavit certifying to the time and the man- ner in which such notice was given. He shall also file therewith any re- ceipt card which may have been returned to him in acknowledgment of the receipt of such notice by registered or certified mail. (a) Upon request for such a hearing, the registered and/or legal owner of the mobile home or recreational vehicle, and the owner of the land on which the mobile home or recreational vehicle is located receiving a no- tice of intention to abate shall be granted a hearing on the matter before an authorized representative of the enforcement agency, or any other board, commission, or official authorized to conduct such hearings. This request shall be made to the enforcement agency.within 10 days afar per- sonal service or acknowledgment ofmceipt by mail of the notice of inten- tion to abate the mobile home or recreational vehicle. If the owner of the land on which the mobile home or recreational vehicle is located submits a sworn written statement denying responsibility for the presence of the mobile home or recreational vehicle on his land within such time period, this statement shall be construed as a request for hearing which does not require the presence of the owner submitting such request. If such a re- quest is not received within 10 days from the date of personal service or acknowledgment of receipt by mail of the notice, the enforcement shall have the authority to abate the mobile home or recreational vehicle. (b) Upon receipt of a request for hearing, or sworn written statement by the owner of the land on which the mobile home ormcmational vehicle is located denying responsibility for the presence of the mobile home or recreational vehicle on his land, the enforcement agency shall set a time and place for such hearing and shall give the petitioner written notice thereof. Receipt of such request for hearing or statement by the owner of the land on which the mobile home ormcmational vehicle is located, shall operate to delay any action by the enforcement agency until after hearing. (a) At the time and placed fixed in said notice, the authorized represen- tative of the enforcement agency, or other board, commission, or official authorized to conduct such hearings shall proceed to hear the testimony of the officers or employes of the enforcement agency and the owner or his representatives, respecting the condition of said mobile home or rec- reational vehicle, the estimated cost of its reconstruction, repair, or re- moval, and any other matter pertinent thereto. Upon the conclusion of said hearing, the board, commission or official conducting the hearing shall render a decision in the matter, and such findings shall be reported to the enforcement agency. If said mobile home or recreational vehicle is found to be a nuisance, the owner shall be ordered to abate the same within 30 days after the date of posting the order on the mobile home or recreational vehicle. (b) The enforcement agency shall post a copy of the order to abate the mobile home or recreational vehicle as a nuisance in a conspicuous place on the mobile home or recreational vehicle. Such order shall be mailed to the owner of the property on which the mobile home or recreational vehicle is located, and to the last registered and legal owner of record of the mobile home or recreational vehicle or delivered by personal service in the same manner as set forth in Section 1712. (d) Nuisance shall include but not be limited to the following: (1) Any public nuisance known at common law or in equity jurispru- dence. (2) Whatever is dangerous to human life or is detrimental to health. (3) Whatever renders air, food, or drink unwholesome, or detrimental to the health of human beings. (e) Hazardous electrical wiring shall include but not be limited to the following: (1) All electrical wiring except that which conformed with all applica- ble laws in effect at the time of installation and which has been main- tained in good condition and is being used in a safe manner. (2) Electrical conductors which are not protected by overcurrent pro- tective devices designed to open the circuit when the current exceeds the ampacity of the conductor. (3) Electrical conductors which do not have ampacity at least equal to the rating of outlet devices or equipment supplied. (4) Electrical conductors which are not protected from physical dam- age. (5) Metallic boxes, fittings, orequipment in an electrical wiring system which are not grounded to prevent shock. (f) Hazardous plumbing shall include but not be limited to the follow- ing: (1) All plumbing except that which conformed with all applicable laws in effect at the time of installation and which has been maintained in good condition and which is free of cross connections and siphonage between fixtures. (2) Lack of effective "P" traps providing a water seal for each plumb- ing fixture. (3) Lack of effective venting of plumbing drain piping. (4) Broken, unsanitary or leaking plumbing pipe or fixtures. (5) Any fixture, fitting, device orconnection installed in such a manner as to permit contamination of the potable water supply. (g) Hazardous mechanical equipment shall include but not be limited to the following: (1) All mechanical equipment, including all heating equipment and its vent, except that which conformed with all applicable laws in effect at the time of installation and which has been maintained in good and safe con- dition, and is being used in a safe manner. (2) Unvented fuel burning heating appliances. (3) Heating or fuel burning equipment, including its vent, without ade- quate clearance from combustible material. (4) Unsupported, loose, or leaking fuel supply piping. (h) Faulty Weather Protection which shall include but not be limited to the following: (1) Deteriorated or ineffective waterproofing of exterior walls, roof, or floors, including broken windows or doors.
