_ Staff gave a summa
ry of the proposal. The Commission waived the reading of the Staff
Findings. A video of the site was shown.
Commissioner Nelson asked about CC&Rs for the existing development?
Staff said there are none at this time as no houses, have been sold in the subdivision.
Commissioner Lambert asked if this would create 48 duplexes instead of 24 single family
residences?
Staff said this is correct.
Chairman Lynch asked if the houses were developed as single family dwellings, could
granny housing be added to the parcels?
Staff said yes. Staff said the granny housing and aunt minnie options would be
eliminated with the duplex housing:
The hearing was opened to the puiblc.
Larry Standiford, representative, said 1 Homes have been built in. Phase I. He said the
applicant is looking for flexibility in marketing that he would get with duplexes. He said
the lots are on public water and public sewer.
Tile hearing was closed.
Chairinan Lynch said he did not have a problem with this project. He said there is a
lot of housing in Thermalito with two houses on a lot, He said this request is
compatible with the neighborhood:

This is a request for a Use Permit to allow the construction of duplex homes, rather than Single-
family homes, in a portion of an approved subdivision, The subdivision consists of 54 lots in two
units. Unit 1 contains 301ots avid Unit 2 contains 24 lots. The applicant is requesting that all of
Unit 2 be permitted to have duplex dwellings.
The property is located on the south side of Nelson. Avenue approximately 1200' east of 12th
Street, Thermalito. The subdivision roads consist of Coarse Gold Roads Mourning move Lane,
Golden Eagle Road and Sutters Mill Road. The surrounding properties are primarily developed
with residential uses or are vacant land. Property on the north side of Nelson Avenue is in the
City of Oroville.
The A -R zone allows for duplex, or multiple family, dwellings Subject to approval of a Use
Permit. The General Plan designation is Low Density Residential, which allovus for up to 6
dwelling units per acre, The total subdivision area is 13.08 acres, The addition of 24 units (total
g ` y g nits per acre, still "within the naxirnum density
requested)would bran the density to S.9 dwelling u
allowed.
To approve the Use Permit request, findings must be made that the proposed use will not impair

the integrity and character of the zone in which the property is located. In addition, the use
should be compatible with surrounding properties.
As the subdivision is approved for 54 homes; the increase of 24 units (48 duplex units) is 'less
than half of the total homes. All services will be� regardless ardless of duplex approval or

denial. Unit 2 of the subdivision is the farthest from Nelson Avenue and more visually protected
from from existing residences by fencing and distance. Property in the City of_Oroville, on the
xtorth side of Nelson Avenue, is zoned for single and multi -family units to a maximum density of
1 unit per 3,000 square feet.
With these considerations, it is not out of character to have duplex units within this subdivision,
not does the request impair the integrity of the neighborhood.
A Negative Declaration has been prepared for the proposed project in accordance with the
California Environmental Quality Act.
RECOMMENDATIONS:
A. Find that the requirements of CEQA have been completed and considered its making this
decision and adopt a Negative Declaration regarding environmental impacts;; and
B; Find that the proposed project is consistent with the basic purpose and intent set forth in
the General Plan and Zoning Ordinance; and
C. Find that the proposed use of the property will not impair the integrity and character of
the zone in which +he land lies and that the use would not be unreasonably incompatible

The Feather River Recreation and Park Distract would like to express our concern over the
growing population of the Greater Oroville area and the affect this will have on our District.
We have found that this increase in population is soverely affecting our ability to provide a,
sufficient level of services to our constituency. This particular subdivision is of a small size,
being four parcels with duplex ,dwellings, but we feel there is an impact to our District from
this project; We need to do something about this increasing problem before it becomes it
crisis environment.

We believe that this steady increase is good for the area and tht:t we can rflleviate the impact

I on the District through developer fees and for larger subdivisions, the creation of Lighting
and Landscape Districts, We believe that the Planning Department should recommend to
the Planning Commission and the Planning Conituission should recommend to the Board of
Supervisors that developer fees be established for the Feather River Recreation and Park
District and the other special, districts which are afflicted by this increased population
growth.
For the present and the Twin Peaks Dev, Inc., to eather View Subdivision 'Unit No. 2 project,
we feel that an equitable settlement 'should be made to the Feather River Recreation and
Park District for the increase in population which this will bring.
