L [ RESOLUTION NO.37-91 LAKE OROVILLE AREA PUBLIC UTILITY DISTRICT APPLICATION FOR CERTIFICATE OF MERGER LAKE OROVILLE AREA PUBLIC UTILITY DISTRICT MAINTENANCE CENTER (APN 35-144-14,15,19) WHEREAS, the Board of Directors of the Lake Oroville Area Public Utility District has approved the installation of three above -ground fuel storage tanks at the site of the District's maintenance center, the address of which is 1945 Elgin Street, Oroville, California, the same being identified as Assessor's Parcel Number 35-144-14, 15 and 19; and, WHEREAS, a Use Permit (No. 91-13) for said above -ground fuel storage tanks has been approved by the Butte County Planning Commission on August 22, 1991; and, WHEREAS, a Building Permit application was filed with the Butte County Building Department on August 28, 1991; and, WHEREAS, the Uniform Fire Code of the State of California requires that all fuel tank structures be fifteen (15) feet from all property lines; and, WHEREAS, said District maintenance center is comprised of three parcels, identified above, whose common property lines are within fifteen (15) feet of the proposed location of the fuel storage facility, as shown on the site plan, attached hereto; and, WHEREAS, the Butte County Building Department will not issue a building permit for said fuel storage facility unless the three parcels comprising said District maintenance center are merged into one, thus eliminating the common property lines that are in conflict with said fuel storage facility per the Uniform Fire Code. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Lake Oroville Area Public Utility District that an Application for Certificate of Merger, in accordance with 566424.2 of the Subdivision Map Act of the State of California, be approved and submitted to the County of Butte for processing. BE IT FURTHER RESOLVED that the District's General Manager be authorized to execute said application and said Certificate of Merger upon approval by the County of Butte.
