I remain, as I have been, anxious to resolve this matter. I need to know if you are going to request the District Attorney's Office to withdraw the complaint, and if he is going to do so. If the complaint is not going to be withdrawn, I will have to have my attorney prepare for court, do his discovery, research, depositions, interrogatories, have several of your employees, and other county employees served, etc.. Based upon the complaint, I do not think that a trior of fact will likely find against me. In any case, it is a further waste of everybody's time. "Mr. & Mrs. Sefers: Following our meeting on Wednesday, February 16th, I was able to contact Wanda Munsinger, our Code Enforcement Officer and I understand a continuance of court action was arranged. There should now be adequate time for you and the Building Division to agree upon a plan for reaching compliance. In reviewing the question of non -conforming windows, Mike Vieira informs me that the life safety aspect with respect to fire danger is of considerable concern and that the code is specific as to the requirements. He has no authority to waive or reduce the requirements. Further, the Building Appeals Board in this case cannot be turned to for an interpretation of the code, since the code is specific and there is no ambiguity. Attached, please find excerpts of the applicable code sections which pertain to the window openings. As you know, the Uniform Building Code is State law and does not originate with the County. In regard to correcting the windows, I regret to tell you that you will need to bring your building into compliance. Again, I am sorry if you felt rudely treated and I do understand your frustration in now being responsible for the improper construction performed by someone else.
