Box 357 Palermo, CA 95968 RE: Substandard Housing 4875 Lincoln Blvd., Oroville AP#035-222-024 Dear Mr.Ortiz & Ms. Rodriquez: This department has received a complaint alleging health and/or safety hazards at the above -referenced property. Butte County Assessor's records indicate that you own or control the property. .. On March 5, 2004, an inspection was made regarding the complaint and the following conditions were observed which are in violation of the California Health and Safety Code, Section 17920.3 (b) 2, 6; (d); (g); (h); which pose health and safety hazards to the occupants and render the dwelling substandard. This letter is your thirty (30) day warning letter to correct or abate the following violation: Any building,or portion thereof including any dwelling unit, guest room .or suite of rooms, or the premises on which the same is located, in which there exists any of the following listed conditions to an extent that endangers the life, limb, health, property, safety, or welfare of the public or the occupants thereof shall be deemed and hereby is declared to be a substandard building: 1. Replace all deteriorated floor joist and flooring in bathroom. (b) 2 2. Ceiling damage in bathroom due to moisture or roof leak.(b) 6 3. Exposed electrical wires in bedroom closet needs to be protected or removed.(d) 4. Faulty weather protection around windows & front door.(g) 5. Remove combustible material from hot water heater b-vent.(h) At the time the above -referenced property becomes vacant, it shall not be occupied until all violations are corrected. Rodriquez March 15, 2004 Page 2 It has been determined by inspection and research that there are currently code violations present on your property at the above -referenced location. Specifically, the violations include: Maintaining an unsafe structure This is an advisory notice that these uses are in violation of the Butte County Code, as follows: Butte County Code, Chapter 28, Section 2813-1 - State Housing Law adopted by Reference. This section adopts the State Housing Law. You are in violation of maintaining a residential building not meeting the minimum standards. In order to comply with the Butte County Code and State Housing Law, you are hereby requested to immediately contact the Department of Development Services, Building Division at (530) 538-7541 to obtain the necessary permits and inspections to bring your residential building within minimum standards. Butte County Code,. Chapter 26 - C.B.C., 1998 Addition, Section 102 - Unsafe Buildings or Structures. All buildings or structures regulated by this code which are structurally unsafe or not provided with adequate egress, or which constitute a fire hazard, or are otherwise dangerous to human life are, for the purpose of this section, unsafe. Any use of buildings or structures constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster, damage or abandonment is, for the purpose of this section, an unsafe use. Parapet walls, cornices, spires, towers, tanks, statuary and other appendages or structural members which are supported by, attached to, or a part of a building and which are in deteriorated condition or otherwise unable to sustain the design loads which are specified in this code are hereby designated as unsafe building appendages. All such unsafe buildings, structures or appendages are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the procedures set forth in the Dangerous Building Codes or such alternate procedures as may have been or as may be adopted by this jurisdiction. As an alternative, the building official, or other employee or official of this jurisdiction as designated by the governing body, may institute any other appropriate action to prevent, restrain, correct or abate the violation. Butte County Code, Chapter 26, Section 26-6(b) - Unsafe for Human Habitation. This dwelling has been posted by the Butte County Department of Development Services, Building Division as unsafe for human habitation. There are numerous conditions existing which are in violation of the State Housing Law and the Health and Safety Code. It is unlawful to occupy this dwelling. It shall be vacated at once and remain vacant until clearance to occupy is received from the Butte County Department of Development Services, Building Division. Andres Ortiz Fidela M. Rodriquez March 15, 2004 Page 3 It is a misdemeanor to occupy this building, or to remove or deface this notice. Butte County Code Section 26-6 (b). Failure to vacate this dwelling as required by law will result in legal.action through the District Attorney's Office. In order to bring the property into compliance with the Butte County Code and avoid further enforcement actions, you are hereby requested to take the following abatement or correction actions: Bring all residential and non-residential buildings to meet minimum standards. Obtain all required permits from the Building Division of the Department of Development Services for all additions and structures built without approvals and permits. 2. All unsafe buildings or structures must be abated by repair, rehabilitation or demolition as per the Butte County Code, Chapter 26, CBC, Section "Unsafe Building or Structures." It is the County's goal to obtain voluntary compliance with the California Health and Safety Code. However, you should be advised that Butte County has an active code enforcement program which provides an effective means of enforcement. A re -inspection will be made to determine compliance. If voluntary compliance with this notice is not accomplished by correction of the above -referenced violations, enforcement may be pursued through the issuance of a citation to appear in the Butte County Municipal Court. Upon conviction and per Section 41-7 of the Butte County Code, violators may be fined and a Notice of Violation may be recorded which include a description of the action necessary to correct the violation. Furthermore, failure to comply will result in the Franchise Tax Board being notified of your non-compliance. You will then be prevented from claiming state tax deductions for taxes, depreciation, amortization, or interest expenses connected with the property as long as it remains substandard. ' This notice is given to you pursuant to Section 24436.5 of the California Revenue and Taxation Code. To comply with the California Health and Safety Code, Section 17920.3 (b) 2, 6; (d); (g); (h); you must obtain all required permits for repairs from the Butte County Department of Development Services, Building Division, 7 County Center Drive, Oroville, California. You have thirty (30) days to voluntary comply with the above -referenced directions. Failure to obtain the required permits, inspections and approvals from this office for installation of a travel trailer. Occupying the travel trailer without the required approvals. Since travel trailers are not allowed in the RN zone, the travel trailer must be removed from the property or the occupancy and use must cease and desist immediately and the travel trailer be placed in dead storage.
