The CoMmis5ioner waived reading of the Sta++ Findings. The hearing was opened to the public. Chairman Schrader stated he had a problem -Finding a hardship in th.ts Case. K. C. Hendrix stated that the hardship was the wind and rain comming in his wont door and untable to open the bedroom winda�4 with no overhang. He discussed the problems with constructing a 4 +t. overhang with no supports. He stated that this tiould need 4 r. 6 inch Supports but he was not sure what the weight requirements would be. Chairman Schrader stated that he was out to see this site and that there were no others in the area with this problem and no other variances granted in the Vicinity. Mr. Hendrex, stated that the new houses, in the area have entryways. The hearing was closed. Chaxrman Schrader stated that he could find no way to approve this variance that there was no hardship, Commissioner BehUnin stated that he had talked with Mr. Hendrix and he had suggested to Mr. Hendrix that he come out even wit.11 the eaves with an overhang. It was moved by Commissioner Behuninj, seconded by Commissioner Avis, and unanimously carried for denial as follows,. A. EXISTING ZONING: R-1 ZONING HISTORY: Zoned a. -I Feb. 28, 5984 Ord'. 2393 Zoned A -R Dec. 19, 1960 Ord. 689 SURROUNDING ZONING: R-1, R-3 SURROUNDINGLAND USE: Single Family dwellings at urban. densities GENERAL PLAN DESIGNATION: medium Density Residential APPLICABLE REGULATIONS: Butte County Code Sections 24-33y and 24-1.32, 1.0-8 and 10-13 Comments: Public 'Works: "l. Show hardship, other structures in the area are setback, to grant variance would break the integrity of setback in the area. ANALYSIS' This project is.a request to place a porch in the front yard setback on property located on the north side of Stump Drive in the Oroville area.. The existing building was built approximately 52 feet from the center- line of Stump Drive with a standard two foot eave overhang. The neighbor- ing two homes were built at the 50 foot setback line with, the eaves Pro- jecting the allowed two Beet into the setback area. The gable roof in area of the front door of the subject home provides' little or no protection to the prevailing southeasterly stormsthatare common in the Oroville area. The applicant wishes to extend the horizonal eave line of the House across the front porch and Saving room window areas and to extend the eaves out to approximately 7' l0'' from the house. The applicant could build an eavp that extended four :feet from the house and only two ;feet into the setbac]e area and still meet the requirements of the Butte County Codes. This lOUld result in an eave overhang in the vicinity of the front door approxa,)aaatoly twice rxs great as other homes in the area. Granting the Variance to a,llov a porch 46 feet From the centerline of the street would likely result in similar applications in the neighborhood from people wishing to extend their eaves. The subject.Vtroperty is a 7000 sq. ft. low in a subdivision, and typically the homes in that subdivision were placed so as to maximize back yard space and minimize front yard area: RECOMMENDATION' A. Note that this project is Categorically Exempt from environmental review,• and B. Find that this project does not meet the requirements of :Section 24-49'. of the Butte County Code in that there are no special circumstances applicable to the property, including size, shape, topography, location or surroundings, that the strict application of the setback requirements of Chapter 10 of the Butte County Code and. Chapter 24 of the Butte County Code deprives the property of privileges enjoyed by other property in the vicinity and under ;identical zoning classi- fication,• and C, Deny the Variance to allow construction of a porch within the front yard setback area as shown on the site plan for AP 35-30-17 (K. C. Hendrix) If the Commission can make the findings required by Section 24-49 with regard to deprivition of privileges then it would be proper to A.
