Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth bellow:Steve Seidenglanz is hereby granted a Use Permit in accordance
with application filed: 10/31/96 to allow the expansion of an existing R.V. park to include 94
spaces, 20 camping sites, a store/office, and a lodge on property zoned LI located at
4488 Pacific Heights Road, Oroville.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and .issuance of Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within 24 months of the delivery of
the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Director of Development
Services or designee upon receipt of a substantiated written request by the applicant.
Prior to such approval, verification shall be made by each Department or Division that
the modification is consistent with the application, fees paid and environmental
determination as conditionally approved. Changes deemed to be major or significant in
nature shall require a formal application for amendment.
4. If any use for which a use permit has been granted is not established within two years
of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to establish
the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon. and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental Quality
Act identifying potentially significant environmental effects that the project may have.
Provisions and thEI design of the project and the conditions added to the project will
mitigate such effects to a level of insignificance; and

B. Affected local, state, and federal agencies provided additional information regarding
potential environmental impacts and these potential impacts related to fisheries, wildlife
habitat, water quality, flooding, and site development have been considered and have
been determined to be less than significant with the inclusion of mitigation measures
and conditions of project approval; and
B. The Planning Commission has independently reviewed, analyzed, and considered the
proposed Negative Declaration with mitigation measures prior to making its decision on
the project, and the Negative Declaration reflects the independent judgement of Butte
County; and,
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property will not impair the integrity and character of the zone
in which the land lies in that the LI zoning allows commercial recreational uses as
conditional uses and permitted uses in the zone do not create a definitive
incompatibilibi with the operation of a recreational area. Within the zone similar
recreational uses are located in the immediate area that do not have a history of
incompatibility; and
B. The proposed, increase in use would not be unreasonably incompatible with, or. injurious
to, surrounding properties in that the project is conditioned to reduce associated
impacts to a level of insignificance that are similar to existing conditions in the area and
similar recreational uses are located in the immediate area -that do not. have a history of
incompatibility; and
C. The proposed increase in use of the property would not be detrimental to the health,
safety, and general welfare of the persons residing or working in the neighborhood, or
to the general health, welfare and safety of the residents of the County in that the
request is consistent with the existing use on site and will be conditioned to reduce
associated impacts to a level of insignificance. The project design and improvements
will meet all County'and State regulations related to sewage disposal, development in a
flood plain, access, and frontage improvements.
A. Subject to the firdings indicated in Sections 1 and 2 of this Permit and the conditions
below, a Negative Declaration is hereby adopted and the Use Permit approved for
Steve Seidenglanz on APN's 036-510-024 and 030 to allow expansion of an existing
R.V. park to include 94 spaces, 20 camping sites, a store/office and a lodge on property
zoned'Ll located at 4488 Pacific Heights Road, Oroville.
Mitigation Measures:
1. A permanent sight obscuring eight (8) ft. tall fence shall be maintained along the
eastern boundary of the r.v. park that abuts the adjacent surplus storage yard. The
fence shall have landscaping planted and maintained along the west face of the fence
that at full maturity, will cover the fence and provide a permanent visual barrier. A
landscaping plan shall be submitted to the Planning Division for review and approval

prior to issuance of use permit that indicates the type of landscaping to be used and
how the landscaping will be maintained.

2. The operator of the r.v. park shall prepare and maintain an emergency action plan that
contains a warning method based on Department of Water Resources flood stage
projections and' an evacuation procedure.for both persons and property in the event of
flooding. The lan shall be submitted to the Planning Division for review and approval
prior to operation of permitted facilities.

3. The public use, ,defined as non-r.v./camping park use, of the lodge and other park
facilities for reunions, receptions, picnics and similar events for gatherings of 25
persons or more, shall be limited to twenty-four (24) events per year.

4. Show on the site plan a 100 foot Limited Development Setback along the Feather River
measured from the normal high water line as depicted on the approved site plan.
Development in this area shall be limited to functions that do not require permanent
facilities or alterations to the topography. The lodge facility and boat ramp are the
single exemptions from this condition.

5. Best Management Practices shall be utilized for normal (non -flood level) stormwater
run-off treatment prior to entering the Feather River and be approved by the
Department of Public Works, Department of Fish & Game and the Regional Water
Quality Control Board.

6. The proposed boat launch facilities and commercial use of motorized watercraft shall
be reviewed an approved by the Department of Fish & Game prior to operation of
facilities.

Conditions:
7. Camping activities are not limited to length of stay restrictions, but are not permitted to
become a permanent living situation as determined by the Director of Development
Services. A permanent living situation shall be determined based on the type of use
involved, the purpose and length of stay, and the condition of the site in question.
8. The applicant shall obtain all applicable permits from the Department of Water
Resources for development in the Feather River Floodway and submit a copy to the
Planning Division prior to operation of permitted facilities.

9. Prior to any clearing, grading and/or construction in the 100 year floodplain the following
entitlements must be obtained: a California Department of Fish & Game 1604
Streambed Alteration permit and a Army Corps of Engineers 404 permit or exemption
certificate, or as required by these agencies.

10. Prior to issuance of use permit, the applicant shall contact the Butte County Tax
Collectors Office to begin the process of a Transient Occupancy Registration
Certificate. A Transient Occupancy Registration Certificate shall be required within ten
(10) days after commencing business.

11. Construction activity shall be prohibited in the river channel during spawning season for
shad and salmoid fisheries and a 200 foot setback from the Feather River shall apply to.
the use heavy equipment to reduce the impact of ground vibration during this period.
12. This Use Permit: is limited and subject to the approved plans on file in the Butte County
Planning Division.
13. Applicant shall comply with all other applicable state and local ordinances, statutes and
regulations.
14. This project lies, within an identified Federal Emergency Management Agency (FEMA)
flood plain, as shown on Flood Insurance Rate Map (FIRM) Panel. B for Community
060017. The County of Butte, as a participating community, has adopted Chapter 26,
Article IV, Flood Hazard Prevention, of the Butte County Code in compliance with
Federal regulations. Issuance of Permits to develop Mobile Home and Recreational
Vehicle Parks is controlled by the state Department of Housing and Community
Development, subject to use permit issued by the County of Butte. To absolve the
County of Butte of any liability resulting from issuance of permits by the State of
California all development within the flood plain should be in accordance with the Code
of Federal Regulations and Butte County Code, Chapter 26, Article IV, Flood Hazard
Prevention. The State of California shall assume full liability for any exceptions or
variances granted to said codes.
15. Deed to Butte County, in fee simple, 30 ft. of right-of-way from centerline of Pacific
Heights Road. The right-of-way shall be sufficient forthe installation of standard No.
S-5 at all street intersections.
16. Construct or install the required improvements or sign a covenant acceptable to the
Department of Public Works to allow construction at a future time.
17. A plan for a permanent solution to drainage shall be submitted to and approved by the
Department of Public Works. The drainage plans shall specify how drainage waters
shall be detained on-site and/or conveyed to the nearest natural or publicly maintained
drainage channi:l or facility and shall provide that there shall be no increase in peak
flow run-off to said channel or facility.
18. .Establish 100 year floodplain elevations and the lowest floor elevations for any
structures. Show on the site plan map for building permits the elevations (by contours)
and the location of an accepted NVGD benchmark and a temporary benchmark on-site.
19. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction of the County Fire Warden. Average required
hydrant spacing 500 feet', hydrant size 6 inches, and residual flow of 300 gpm/2 hours.
Submit plans to the Fire Department for review and approval prior to construction of
facilities.
20. Provide all weather access to all structures, which is designed to carry a 40,000 pound
fire apparatus at least 10 feet wide with a 15 foot vertical clearance.

21. Maintain a secondary access to the park from Pacific Heights Road to the satisfaction
of the Fire Department.

22. The_ recirculation filter/treatment facility shall be located above the 100 year floodplain
and the leachfield area shall be located above the 10 year floodplain. The entire
wastewater system located within the floodplain shall be watertight.

23. The wastewater system shall be installed under permit and inspection from the
Environmental Health Division (EHD) and operated under a Waste Discharge Permit
from the Regional Water Quality Control Board (RWQCB).

24. The wastewater system shall have regular monitoring and testing results administered
through the EHID to ensure no there is no contamination of groundwater. Water quality
testing of the Feather River shall be conducted every six months to the satisfaction of
the EHD to ensure that wastewater discharge requirements are being met.

Conditions:
All overnight, non -vehicular camping shall be conducted in the six clearly
demarcated spaces and not involve the outdoor accumulation of camping gear,
supplies and refuse beyond what is reasonable for overnight camping.
2. Camping activities are not limited to length of stay restrictions, but are not
permitted to become a permanent living situation as determined by the Director
of Development Services. A permanent living situation shall be determined
based on the type of use involved, the purpose and length of stay, and the
condition of the site in question.
3. Maintain an all weather access to buildings for a 40,000 pound fire apparatus.
4. Provide a covenant for the installation of curb, gutter, and sidewalk to the RS -2A
road standard on Pacific Heights Road.
5. This Use Permit is approved subject to the plans on file in the Butte County.
Planning Division.
6. Execute a hold harmless agreement in a form satisfactory to County Counsel.
7. Insurance on project shall name Butte County "also insured."
8. Applicant shall comply with all other applicable state and local ordinances,
statutes and regulations.

SPECIAL CONDITIONS:
1. It shall be the responsibility of the applicant/owner/mana.ger to
keep himself aware of flood data from the California Department of
Water Resources, and to initiate evacuation when necessarv. .
2. All the mobile homes shall be maintained on wheels to facilitate
evacuation.
3: An evacuation plan for the.entire mobile home park should be
submitted to the California Department of..Water Resources.
4. The method of sewage disposal for the three additional mobile homes
shall conform to the requirements of the California Regional Water
Quality Control Board.and the Butte -County Health Department.
5. All requirements of Water Quality Control Board.

7. Install one 2500 gal. water storage tank with all weather access
for Fire Department. Tank to be provided with one valve and a 2-1/2".
NH Fire Department connection with one protective cap -- or as
otherwise approved by the Butte County Fire Department.
Applicant must also comply with'all other applicable State and local
statutes, ordinances and regulations.
