At the regular 'Meeting of the Butte County Planning Commission held July..27, 2000, the
Commission determined that Condition Number 8 of Use Permit 99-13 be administratively adjusted
to allow an occupancy of 208 persons for the approved paintball facility, provided that the County
right-of-way for Pacific Heights road can remain in use by the permit as specified in Condition 15
of the approved Use Permit.

Pursuant to the previsions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below, Steve Seidenglanz is hereby granted in accordance with the application filed to
operate an organized paint ball gaming course.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless oberwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within 24 months of the delivery
of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee, prior to such approval,
verification shall be made by each Department or Division that the modification is
consister_t with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
4. If any us: for which a use permit has been granted is not established within two years
of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to
establisl the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Conditions of Approval:
Plannine Division
1. All exterior lighting shall be designed and located so as to confine direct lighting to the
premises. A light source shall not shine upon or illuminate directly on any surface other than
the area required to be lighted. No lighting shall be of the type or in a location such that it
constitutes a hazard to vehicular traffic, either on private property or on abutting streets.
(Mitigation Measure #1)
2. The landowner and site operator shall be responsible for supervision of the site and games
during operations.
3. Gaming participants shall be made aware of the boundaries of the course through the use of
markers and/or fencing and other means. Surrounding properties shall be protected from
stray paint balls through the use of fencing, vegetation and protective netting where
necessary.
4. Daily hours of operation shall be 8:00 a.m. to 10:00 p.m.
20 parking spaces shall be provided at the facility in accordance with Butte County Code
Section 24-240.10.
6. In the event of predicted floodwaters, chemical toilets shall be removed.
7. A sign shall be placed on-site in a visible location during business hours to inform patrons
of any known risk of participation in paint ball gaming activities.
8. The maximum occupancy of the site shall be 80 participants and spectators at any time.
9. The applicant shall comply with all applicable State and local statutes, ordinances and
regulations.
10. Prior to use of the site as a commercial paint ball course the applicant shall contact the
Planning Division for a field inspection to verify that all conditions and ordinance
requirements have been met.

11. Netting installed for the protection of participants and surrounding properties during gaming
activities shall be designed to minimize the effect of floodwaters. Specifically the netting
shall be constructed to minimize exposure to the flood flow by avoiding a right-angle
orientation to the flood flows. Prior to installation, the design shall be reviewed to the
satisfaction of the Public Works Department, Land Development Division. (MM #3)

17. The applicant shall provide 2 chemical toilets on-site for use by customers. Additional toilets
should be provided for groups larger than 50 persons.
18. No food preparation shall take place within any structure without adequate on-site potable
water and sewage disposal. Prior to food dispensing of any kind, approval shall be obtained
from the Department of Environmental Health.
Air Quality Management District
19. Measures shall be taken to control fugitive dust emissions from all construction associated
with project improvements. Measures may include site watering or use of other acceptable 3
soil palliatives. (Mitigation Measure #2)

Prior to any grading work within the floodplain, all necessary permits shall be obtained from
the U.S. Army Corps. of Engineers, the State Reclamation Board, the State Department of
Fish and Game and the Butte County Land Development Division.

Prior to issuance of building permits, the owner shall deed to Butte County, in fee simple,
30 -feet of right-of-way from the centerline of Pacific Heights Road. The right-of-way shall
be sufficient for the installation of a standard S-5 Pedestrian Ramp at all street intersection.

Prior to the issuance the building permit for electrical service, establish 100 -year floodplain

Parking may be permitted where vehicles must back onto Pacific Heights Road right-of-way

provided that prior to establishment of the use, an agreement is entered into with the County,
which sets forth that all required parking areas be removed from County property at the
request of the County. The agreement shall be approved by County Counsel.

For your protection, you should be aware that as "owner -builder" you are the responsible party of record
on such a permit. Building permits are not required to be signed by property owners unless they are personally
performing their own work. If your work is being performed by someone other than yourself, you may protect
yourself from possible liability if that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a
business license from the city or county. They are also required by law to put their license number on all permits

This transmits a plot pian, structural details and supporting
calculations for the ramp at subject location.
I used 1.00 pounds/square foot for design loads for the ramp
framing, and Tables 16A and 16B for rail framing.
Framing and railing are in my opinion structurally adequate.
The height of the existing rail was 34". Section was raised to
handrail height of 42 inches. 4 x 4 x 7 ga. wwf was added between
posts, and 3" flat bar added at bottom to act as a wheel stop.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below, Steve Seidenglanz is hereby granted in accordance with the application filed to
operate an organized paint ball gaming course:

1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within 24 months of the delivery
of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services_, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee, prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with the application, fees paid and environmental determination .as
conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
4. If any use for which a use pemlit has been granted is not established within two years
of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to
establisli the use. .

5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Conditions of Approval:
Planning Division
1. All exterior lighting shall be designed and located so as to confine direct lighting to the
premises. A light source shall not shine upon or illuminate directly on any surface other than
the area required to be lighted. No lighting shall be of the type or in a location such that it
constitutes: a hazard to vehicular traffic, either on private property or on abutting streets.
(Mitigation Measure #1)

2: The landowner and site operator shall be responsible for supervision of the site and games
during operations.
3. Gaming participants shall be made aware of the boundaries of the course through -the use of
markers and/or fencing and other means. Surrounding properties shall be protected from
stray paint balls through the use of fencing, vegetation and protective netting where
necessary.!
4. Daily hours of operation shall be 8:00 a.m. to 10:00 p.m.
5. 20 parkin; spaces shall be provided at the facility in accordance with Butte. County Code
Sw��\ Section 24-240.10.
Q �pQ'eWW 6. In the event of predicted floodwaters, chemical toilets shall be removed.
7. A sign shall be placed on-site in a visible location during business hours to inform patrons
of any known risk of participation in paint ball gaming activities.
8. The maximum occupancy of the site shall be 80 participants and spectators at any time.
9. The applicant shall comply with all applicable State and local statutes, ordinances and
regulations.
10. Prior to use of the site as a commercial paint ball course the applicant shall contact the
Planning Division for a field inspection to verify that all conditions and ordinance
requirements have been met.
Land Development Division
11. Netting installed for the protection of participants and surrounding properties during gaming
activities shall be designed to minimize the effect of floodwaters. Specifically the netting
shall be constructed to minimize exposure to the flood flow by avoiding a right-angle
orientation to the flood flows. Prior to installation, the design shall be reviewed to the
satisfaction of the Public Works Department, Land Development Division. (MM #3)

12 Prior to any grading work within the floodplain, all necessary permits shall be obtained from
the U.S. Army Corps. of Engineers, the'State Reclamation Board, the State Department of.
Fish and Game and the Butte County Land -Development Division.
k3 Prior to issuance of building permits, the owner shall deed to Butte County, in fee simple,
30 -feet of :right-of-way from the centerline of Pacific Heights Road. The right-of-way shall
be sufficient for the installation of a standard S-5 Pedestrian Ramp at all street intersection.

( elevations and the lowest floor elevation for any structures. Show on the building permit site

15. Parking may be permitted where vehicles must back onto Pacific Heights Road right-of-way
provided that prior to establishment of the use, an agreement is entered into with the County,
which sets forth that all required parking areas be removed from County property at the
request of the County. The agreement shall be approved by County Counsel.
16 Prior to any construction on County property or right-of-way, an encroachment permit shall
be obtained.

17. The applicant shall provide 2 chemical toilets on-site for use by customers. Additional toilets
should be provided for groups larger than 50 persons.
18. No food preparation shall take place within any structure without adequate on-site potable
water and sewage disposal. Prior to food dispensing of any kind, approval shall be obtained
from the Department of Environmental Health.
Air Quality Management District
19. Measures shall betaken to control fugitive dust emissions from all construction associated
with project improvements. Measures may include site watering or use of other acceptable
soil palliatives. (Mitigation Measure #2)

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below, Steve Seidenglanz is hereby granted in accordance with the application filed to
operate an organized paint ball gaming course.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within 24 months of the delivery
of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee, prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
4. 'If any use for which a use permit has been granted is not established within two years
of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to
establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Conditions of Approval:
Planning Division
All exterior lighting shall be designed and located so as to confine direct lighting to the
premises. A light source shall not shine upon or illuminate directly on any surface other than
the area required to be lighted. No lighting shall be of the type or in a location such that it
constitutes a hazard to vehicular traffic, either on private property or on abutting streets.
(Mitigation Measure #1)
2. The landowner and site operator shall be responsible for supervision of the site and games
during operations.
3. Gaming participants shall be made aware of the boundaries of the course through the use of
markers and/or fencing and other means. Surrounding properties shall be protected from
stray paint balls through the use of fencing, vegetation and protective netting where
necessary.
4. Daily hours of operation shall be 8:00 a.m. to 10:00 p.m.
5. 20 parking spaces shall be provided at the facility in accordance with Butte County Code
Section 24-240.10.
6. In the event of predicted floodwaters, chemical toilets shall be removed.
7. A sign shall be placed on-site in a visible location during business hours to inform patrons
of any known risk of participation in paint ball gaming activities.
8. The maximum occupancy of the site shall be 80 participants and spectators at any time.
9. The applicant shall comply with all applicable State and local statutes, ordinances and
regulations.
10. Prior to use of the site as a commercial paint ball course the applicant shall contact the
Planning Division for a field inspection to verify that all conditions and ordinance
requirements have been met.
Land Development Division
11. Netting installed for the protection of participants and surrounding properties during gaming
activities shall be designed to minimize the effect of floodwaters. Specifically the netting
shall be constructed to minimize exposure to the flood flow by avoiding a right -"Angle
orientation to the flood flows. Prior to installation, the design shall be reviewed to the
satisfaction of the Public Works Department, Land Development Division. (MM #3)
12. Prior tdany grading work within the floodplain, all necessary permits shall be obtained from
the U.S. Army Corps. of Engineers, the State Reclamation Board, the State Department of
Fish.. and Game and the Butte County Land Development Division.
Prior to issuance of building permits, the owner shall deed to Butte County, in fee simple,
30 -feet of right-of-way from the centerline of Pacific Heights Road. The right-of-way shall
be sufficient for the installation of a standard S-5 Pedestrian Ramp at all street intersection.
14. Prior to the'issuance the building permit for electrical service, establish 100 -year floodplain.
elevations and the lowest floor elevation for any structures. Show on the building permit site
plan map the contour elevations, and the location of an accepted NVGD benchmark and a
temporary -benchmark on-site.
15. Parking may be permitted where vehicles must back onto Pacific Heights Road right-of-way
provided that prior to establishment of the use, an agreement is entered into with the County,
which sets forth that all required parking areas be removed from County property at the
request of the County. The agreement shall be approved by County Counsel.
1 Prior to, any construction on County property or right-of-way, an encroachment permit shall
be obtained.
Environmental Health Department
17. The applicant shall provide 2 chemical toilets on-site for use by customers. Additional toilets
should be provided for groups larger than 50 persons.
18. No food preparation shall take place within any structure without adequate on-site potable
water and sewage disposal. Prior to food dispensing of any kind, approval shall be obtained
from the Department of Environmental Health.
Air Quality Management District
19. Measures shall be taken to control fugitive dust emissions from all construction associated
with project improvements. Measures may include site watering or use of other acceptable
soil palliatives. (Mitigation Measure #2)

This letter is a follow up to the citations you received in July 1998, by the Butte County Code
Enforcement for placing fill in a floodplain and the subsequent meeting we had in my office on
August 18, 1998.
This should also be considered a response to your letter of August 17, 1998. No one from the
County has misled you or been untruthful about the County's position. Our requirements and
communications to you have remained consistent.
I would like to begin by summarizing our previous correspondence that I have attached for your
reference:
• November 18, 1997 a letter from Stuart Edell notifying you that you needed a development
permit to construct a roadway within a floodplain. In that letter we also notified you that part
of your construction ,appeared to be on County owned property and that you were to restore
the property to its original condition or obtain an easement.
• January. 9, 1998 — a letter from you stating that the road was clearly defined in both a 1975
and a 1990 aerial photograph and that you were doing nothing more than to prepare this road
for base rock. You also stated that you had photographs that clearly depict that you did not
increase the roadway elevation; that you only made it level and accessible. In addition, you
stated that the photographs depict existing weed growth, which clearly defines that overall
you did not increase the road height past its existing high marks.

• January 23, 1998 I sent you a letter repeating our determination that you needed a
development permit for placing fill in a floodplain and notified you to cease and desist from
any more work in the floodplain until you obtained the necessary permits. In that letter I
suggested that in the alternative, you could lower the road and return the property to pre -
construction contoLrs. In addition, you were again notified to restore the County's property
to its original condition or obtain an easement.
• February 13, 1998 — I sent you a letter as a follow up from a meeting we had at the site where
you agreed to do certain remedial work on your access road to avoid the requirement to
obtain a development permit. We agreed that you would lower the profile of your access
road to the height of Pacific Heights Road or lower. We also agreed that before you did any .
additional improvements to the area that you would provide plans and obtain all necessary
permits.
Our agreement, on February 13th, was based on .my determination that there was a previously
existing elevated roadway at your site that was depicted by the existing weed grown contours
along the southern boundary of your property. Our agreement was for you to do the necessary
work to de -grade and restore the road elevation as it was depicted by the exiting weedy contours.
This elevation was determined to be at or below the elevation of Pacific Heights Road. We
agreed you would not do any additional work until you submitted plans and obtained the
necessary permits.
The existing weedy con�ours that we agreed to are shown clearly in photographs taken at the site
in November 1997. Be -ween Pacific Heights Road and a point approximately midway between
Pacific Heights Road and the tree line to the west, the existing weedy contours show an elevation
at or below Pacific Heights Road. At the midway point, the weedy contours slope downward to
a point where it hits "natural" ground at the base of the large oak tree located at the western end
of your road.
You did not comply wita the terms of our February 13, 1998, agreement. Between February 13,
1998 and July 1998, you continued to accept fill material at the site which was used to increase
the height and width of the access road without permits or approval. The citation was issued to
you in July 1998.
Below, please find a Corrective Action Plan that you will need to agree to and complete in order
for this Department to recommend dismissal of your pending citations.

1) De -grade fill area between Pacific Heights Road and a point 300 feet west to an elevation
not to exceed the elevation of Pacific Heights Road. Any future improvements
contemplated for this fill section such as road base, ballast material, etc. shall not exceed
the elevation of Pacific Heights Road.
2) De -grade fill area between the point 300 feet west of Pacific Heights Road to the natural
ground level at the base of the large oak tree located approximately 600 feet west of
Pacific Heights Road at a uniform slope. Any improvements contemplated for this
section shall not exceed this grade.
3) Provide an "as built" survey by a registered engineer or surveyor that shows the work
was completed as stated in items 1 and 2 above.
4) Remove any existing signs allowing dumping of fill and place sign that states no
dumping.
5) Agree that no additional fill will be placed within the floodplain without permits from the
County and other agencies as required.
6) Restore the County property to its original condition or obtain a license, easement or
other agreement from the County for the use of this property.

This Corrective Action is totally exclusive to any actions that the Regional Water Quality
Control Board may take in response to the reported fuel contamination at the site.

Following your January 9, 1998, letter, we have reviewed your project and determined a
development permit is still necessary for the fill placed within the Feather River flood plain on
your property (both locations).
We do not understand what you mean by the statement that a permit "be mitigated prior to its
issuance'; however, we would be willing to work with you and your engineer in developing the
necessary information to obtain a permit.. Our primary concern with your roadway is the
potential for increased upstream flooding caused by the damming effect of your elevated
roadway. One way to reduce the amount of engineering hydraulic analysis required would be to
lower the road and return the property to pre -construction contours. As the rainy season has
already begun, it is imperative that these effects be mitigated as soon as possible.
As stated in our November 18, 1997, letter, the signed permit application, together with three (3)
copies of your engineered plans, and project engineering analysis, should be submitted to the
Butte County Building Division of Development Services, for determination of permit fees and
processing. This process must be commenced within 5 days of the date of this letter.

This letter is a follow up from our meeting last week, where we agreed that you would do certain
remedial work on your access road to avoid the requirement of obtaining a development permit.
We agreed that you would lower the profile of your access road to the height of Pacific Heights
Road, (or lower). Your engineer, NorthStar Engineering, would shoot the grade and set the
necessary control for the work to proceed in a timely manner.. While we did not discuss a
specific time frame at our meeting, I . am suggesting you accomplish this work no later than
March 6, 1998, if you are to avoid further enforcement action by the County.
We also discussed other improvements that you are contemplating for this area and the fact that
you will need to provide the County with all necessary plans for this future work and obtain any
permits that may be applicable. Please contact Land Development/Planning as your plans firm up,

Dear Steve:
I have reviewed your plans and we have discussed the construction of the proposed netting for
the above referenciA park. Your proposed netting is a green '/4" or smaller shade netting
approximately 10' wide. This netting is to be stacked in two layers to make a screen, which will
extend approximately 20' above the natural ground. The screen will be held in place by a plastic
clip, extending the full length between poles and small diameter steel cable on the top and
bottom which is continuous from the most westerly pole to the most easterly pole on both the
north and south property lines. The clip attaches securely to the netting and the steel cable slides
freely through the clip. The net and light poles are to be placed on 25' to 30' centers and would
extend westerly 150' from the Pacific Heights Road portion of the netting. The paint ball guns,
meeting criteria to 'be allowed in the park would have a_ range of approximately 125'. This
information is depicted on the attached site plan.

In order to comply with condition 11 and still provide for public safety, the following
requirements must be incorporated into the construction and operation of the netting:
1. Prior -:'to any flood event, the bottom steel cable on all of the netting must be
released or removed to allow each lower section of netting to move freely, when
subject to flood flows.
2. Provide sufficient overlap between the upper and lower sections of netting and at each
pole, to prevent paint balls from exiting the park area.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below, Steve Seidenglanz is hereby granted in accordance with the application filed to
operate an organized paint ball gaming course.
Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the granted use.
The use granted by this permit must be established within 24 months of the delivery
of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee, prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
4. If any use for which a use permit has been granted is not established within two years
of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to
establish the use. .
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Conditions of Approval.
Planning Division
1. All exterior lighting shall be designed and located so as to confine direct lighting to the
premises. A light source shall not shine upon or illuminate directly on any surface other than
the area required to be lighted. No lighting shall be of the type or in a location such that it
constitutes a hazard to vehicular traffic, either on private property or on abutting streets.

2. The landowner and site operator shall be responsible for supervision of the site and games
during operations.
3. Gaming participants shall be made aware of the boundaries of the course through the use of
markers and/or fencing and other means. Surrounding properties shall be protected from
stray paint balls through the use of fencing, vegetation and protective netting where
necessary.
4. Daily hours of operation shall be 8:00 a.m. to 10:00 p.m.

Section 24-240.10.
6. In the event of predicted floodwaters, chemical toilets shall be removed.
7. A sign shall be placed on-site in a visible location during business hours to inform patrons
of any known risk of participation in paint ball gaming activities.
8. The maximum occupancy of the site shall be 80 participants and spectators at any time. .
9. The applicant shall comply with all applicable State and local statutes, ordinances and
regulations.
10. Prior to use of the site as a commercial. paint ball course the applicant shall contact the
Planning Division for a field inspection to verify that all conditions and ordinance
requirements have been met.

activities shall be designed to minimize the effect of floodwaters. Specifically the netting
shall be constructed to minimize exposure to the flood flow by avoiding a right-angle

requested an engineered contour map for my project.
This is the same engineered contour map that I told you I would have Mr. Michael
Mooney complete for you. However, when I went to Mr Mooney and advised him that
the contour map that I had turned in and basically had copied -from a USGS map was
rejected he informed me that he felt it was ridiculous as he was unaware that contour
maps had to be engineered.
then advised him that the Use Permit.did not specify an engineered contoured map,
but that it wasn't worth the hassle not to comply with what I said I would do. So, I
assure you that it is being done.
At the same time I would like you to assure me that every contour map that has been
turned in to your department and approved has been engineered. And then I would
like you to try and explain to me, if you would be so kind, the necessity of an
engineered contour map for installing a power pole.

Dear Mr. Seidenglanz,
I am in receipt of your letter requesting information regarding the requirement of a contour site
plan prepared by a registered civil engineer and the reason for such requirement.
Condition #14 of Use Permit 99-13 clearly requires submittal of a site.plan delineating contour
elevations; the location of an accepted NGVD Benchmark, and a temporary benchmark on-site.
Chapter 7 (Professional Engineers Act) of the California Business and Professions Code, Section
6731 defines "civil engineering" (copy of section attached). Section 6731.1 (b) of that definition
specifically states that: civil engineering includes "determines the configuration or contour. of the
earth's surface or the position of fixed objects thereon related thereto, by means of measuring
lines and angles, and applying the principles of trigonometry or photogrammetry."
The requirement to provide a plan is found within Butte County Code Chapter 26 Article IV
Flood Hazard Prevention (copy attached). The Department of Development Services is directed
to enforce all the provisions of this article. Sections 26-22, 26-23, and 26-24 directs the
department to require -an application for all development and evaluate that plan and application for
conformance with improvements or projects within the flood hazard area. Those sections further
require that plans and. specifications be provided, drawn to scale, showing dimensions and
elevations of the site. „ Plans shall identify all work to be done, show existing and/or proposed
structures, fill; storage of materials, and drainage facilities. NGVD elevation information is also
required: Section 26•-23 requires the department to utilize applicable regulatory flood elevation
and floodway data from federal, state, and other sources when evaluating development projects.
Any encroachments including fill or grading are prohibited in a floodway unless a technical
evaluation demonstrates the. encroachments will not result in any increase in flood levels during
the occurrence of a base flood level discharge. Section 26-30 of the same Article requires the
department to maintain elevation information on file. These files are subject to review by FEMA
Y.

and DWR staff during regular Community Assistance Visits performed by them to verify
conformance with FEMA regulations and Butte County Code.
The information presented above and attached for your reference establishes the requirement for
contour plans. The preparation of those plans constitutes the practice of civil engineering by.
definition. Submittal of any plans requiring contour or other information defined as civil
engineering must bear the stamp and original signature of the qualified design professional. The
department must review those plans for conformance with Flood Hazard Prevention standards
and maintain that information for later review by FEMA and DWR to verify appropriate
enforcement of flood hazard regulations. Appropriate and effective enforcement of flood hazard
regulations assures the citizens of Butte County will be able to obtain flood insurance to protect
their home and property and further provide that FEMA will assist financially to mitigate the costs
of flood damage and emergency disaster services.

Sec. 26-21. Official maps.
The Butte County Board of Supervisors hereby adopts the flood
insurance study ("FIS") produced by the Federal Insurance Ad-
ministration ("FIA") of the Federal Emergency Management
Agency ("FEMA"), and accompanying flood insurance rate maps
("FIRM") and flood boundary and floodway maps ("FBFM") with
map index dated September 29, 1989, and all subsequent amend-
ments and revisions, as the official maps to be used in determin-
ing those areas of special flood hazard. The FIS and attendant
mapping present the minimum area of applicability of this article
and may be supplemented by studies of applicability of this
article and may be supplemented by studies for other areas which
allow implementation of this article and which are adopted by the
board of supervisors based on recommendations from the floodplain
administrator. The FIS, FIRMs, and FBFMs are on file with the
Butte County. Department of Development Services at 7 County

§ 26-22
(a) Additional requirements in flood hazard zones. Within
flood hazard Zones A, AE, AH, AO and "shaded" X on the official
maps there are additional requirements in conjunction with the
issuance of development permits for new construction, substan-
tial improvements and other developments, including the place-
ment of manufactured homes.
(b) Application. lb obtain a development permit in said zones,
the applicant shall first file an application ;therefor in writing on
a county form furnished for that purpose by the department of
development services and approved. by the director of develop-
ment services. Every such application shall:
(1) Identify and describe the work to be covered by the permit
for' -which application is made;
(2) Describe the land on which the proposed work is to be
done by lot, block, tract and house .and.street address, or
similar description that will ' readily identify and defi-
nitely locate the proposed building or work;
(3) Indicate the use or occupancy for which the proposed
work is intended;
(4) . Be accompanied by plans and specifications for the pro-
posed development drawn to scale, and showing the
dimensions and elevation of the site on which the pro -
work is to be done, existing and/or proposed dmc-

(5) Be signed by the permittee or his authorized agent who
may be required to submit evidence to indicate such
authority;

Sec. 26-23. [Review of development permit applications—
Generally.]
The department of developmentservices shall _review all devel-
opment permit applications to determine if the -site of the pro-
posed development is -reasonably safe from flooding and that all
necessary permits have been received as required by federal or
state law.

Sec. 26-24. Same—Criteria for evaluation.
(a) The county, in reviewing all -applications _ for new construe
tion, substantial improvements, prefabricated buildings, place-
ment of manufactured homes and other development(s) (as de-
fined in section 26-29 of this article) `will
t(1)_ Obtain, -review' and-reasonably`utilize,-if-available, any.
L --_ regulatory flood elevation and floodway data, from federal,
state or other sources, until such other data is provided by
the Federal Insurance Administration in a flood insurance
study;
(2) Require the use of construction materials and utility equip-
ment that are resistant to flood damage;
(3) Require the use of construction methods and practices that
will minimize flood damage;
(4) Require buildings and manufactured homes be designed or
anchored to prevent the floatation, collapse or lateral
movement of the structure or portions of the structure due
to flooding;
(5) Assure electrical, heating, ventilation, plumbing and air
conditioning equipment and other service facilities shall be

designed and/or located so as to prevent water from enter-
ing or accumulating within, the components during condi-
tions of flooding;
(6) -As'sur`e encroachments, including fill, new construction;
substantial improvements and other development, shall be
prohibited in any floodway unless a technical evaluation
demonstrates that the encroachments will not result in
any increase in flood levels during_ the occurrence of the p
base flood. discharge;.
(7) Require, for all new construction and substantial improve-
ments, that fully enclosed areas below the lowest floor that
are subject to flooding shall be designed to automatically
equalize hydrostatic flood forces on exterior walls by allow-
ing ,for the entry and..exit of floodwaters. Designs for
meeting this requirement must either be certified by a
. V registered professional engineer or architect or meet or

exceed the following minimum criteria: A minimum of two
(2) openings having a total net area of not less than one (1)
square inch for every square foot of enclosed area subject to
- ~ flooding shall be provided. The bottom of all openings shall
- be no higher than one (1) foot above grade. Openings may
be equipped with screens, louvers, valves, or other cover-
ings or devices, provided that they permit the automatic
entry and exit of,floodwaters.
(b) The county, in addition to the requirements in paragraph
(a) will:,,
(1) ' Require, within areas designated as Zones A, AE and AH
on the official map,_that the following standards are met;
a.' The lowest floor elevation of new residential struc-

improvements to residential structures shall be ele-
vated one. (1) foot or more above the regulatory flood
elevation.
b.' The lowest floor elevation of new nonresidential struc-
tures shall be elevated one (1) foot or more above the

regulatory flood elevation; or, such nonresidential struc-
tures, together with attendant utility and sanitary
facilities, shall:
1. Be floodproofed so that below the base flood ele-
vation the structure is watertight with walls sub-
stantially impermeable to the passage of water;
2. Have structural components capable of resisting
hydrostatic and hydrodynamic loads and effects of
buoyancy; and
3. Be certified by a registered professional engineer
or architect that the design and methods of con-
struction are in accordance with accepted stan-
dards of practice for meeting the provisions of this
paragraph.
(2) Require within any AO Zone that all new construction and
substantial improvements of residential structures have
the lowest floor elevated above the highest adjacent grade
at least one (1) foot higher than the depth number specified
in feet on the official map (at least three (3) feet if no depth
number is specified. Nonresidential structures shall either
- meet the requirements of this subsection or be floodproofed
'- in accordance with the requirements of subsection (b)(1)b.,
above.
(3) Assure that in regard to manufactured homes specific
anchoring requirements are as follows:
a. Areas designated Zone A and AO:
1..__ The lowest floor elevation of new manufactured.
homes and substantial improvements to manufac-
tured homes shall be elevated one (1) foot or more
above the regulatory flood elevation.
2. All manufactured homes and additions to manu-
factured homes shall be anchored to resist floata-
tion, collapse or lateral movement by one (1) of the
following methods:
(a) By providing an anchoring system designed to
withstand horizontal forces of fifteen (15)
pounds per square foot and uplift forces of
nine (9) pounds per square foot; or

(b) By the anchoring of the unit's system, de-
signed to be in compliance to [with] the de-
partment of housing and development mobile
home construction and safety standards.
b. Areas designated Zones AE and AH: Require that all
manufactured homes to be placed or substantially
improved be elevated on a foundation such that the
lowest floor of the manufactured home is elevated one
(1) foot or more above the base flood elevation, and be
securely anchored to an adequately anchored founda-
tion system in accordance with the provisions of para-
graph (b)(3)a.
(4) Require, within Zones AH and AO, adequate drainage
paths around structures on slopes, ,to guide floodwaters
-araund`and away from proposed structures.
(5) Require within any shaded Zone X that the following
standards are met:
a. - The lowest floor elevation of new residential struc-
tures (including manufactured homes) and substantial
improvements to residential structures shall be ele-
vated one (1) foot or more above the regulatory flood -
elevation.
b. The lowest floor elevation of nonresidential structures
shall be elevated or floodproofed to one (1) foot or more
above the regulatory flood elevation;, or, such nonresi-
dential structures, together with attendant utility and
sanitary facilities, shall:
1. Be floodproofed so that below the base flood ele-
vation the structure is watertight with walls sub-
stantially impermeable to the passage of water;
2.. Have structural components capable of resisting

Sec. 26-25. Subdivision applications.
All subdivision applications filed in Zones A, AE, AH and AO on
the official map shall be ' reviewed to assure that:
(A) All such proposed developments are consistent with the
need to minimize flood damage.
(B) Subdivisions and parcel maps shall, as a condition of
approval, establish regulatory flood elevations and note
same on final map prior to recordation of the final map.
(C) Adequate drainage is provided so as to reduce exposure to
flood hazards.
(D) All public utilities and facilities are located so as to
minimize or eliminate flood damage.

Sec. 26-26. New water and sewer [systems].
New and replacement water and sewer systems shall be con-
structed to eliminate or minimize infiltration by, or discharge into
floodwaters. Moreover, on-site waste disposal systems will be
designed to avoid or minimize impairment or contamination
during flooding.

Sec. 26-27. [Cooperation with other agencies.]
The county will work with appropriate state and federal
agencies in every way possible in complying with the National
Flood Insurance Program in accordance with the National Flood
Disaster Protection Act of 1973.

6,28. [Conflicting ordinances.]
This article 'shall take precedence over conflicting ordinances or
parts'of ordinances. The Butte County Board of Supervisors may,
from time to time, amend this article to reflect any and all
changes in the National Flood Disaster Protection Act of 1973.
The regulations of this article are in compliance ' with the Na-
tional. Insurance Program Regulation as published in the Federal
Register, Volume 41, Number 207, dated October 26, 1976.

Sec -.'26-29. Definitions.
Unl6ss specifically defined below, words or phrases used in this
article shall be interpreted so as to give them the same meanings
as they have in common usage and so as to give this article its
most reasonable applications:

subject to a one (1) percent or greater chance of flooding in
'any given year. This land is identified as Zones A, AE, AH,
AO and shaded X on the official maps.

accumulation of runoff or surface waters from any source.
(4), Floodproofing: Any combination of structural and
nonstructural additions, changes or adjustments to struc
-tur*es, including utility and sanitary facilities, which would
ii preclude the entry of water. Structural components shall
have the capability of resisting hydrostatic and hydrody-
namic loads and the effect of buoyancy.

Lowest floor: The lowest floor of the lowest enclosed area
(including basement). An unfinished or flood -resistant en-
closure, usable solely for parking of vehicles, building
access or storage, in any area other than a basement area,
is not considered a building's lowest floor, provided that
such enclosure is not built so as to render the structure in
violation of the applicable nonelevation design require-
ments of this article.
(6)
Manufactured home: For the purposes of this article, a
structure, transportable in one (1) or more sections, which
is built on a permanent chassis and designed to be used
with or without a permanent foundation when connected to
the required utilities, including a recreational vehicle, or
travel trailer placed. on a site for more than one hundred
eighty (180) days.
.(7)
Manufactured home park (subdivision): "Manufactured
home subdivision" means a parcel (or contiguous parcels)
of land which has been divided into two (2) or more lots for
rent or sale and the placement of manufactured homes.
(8)
Regulatory flood elevation: The water surface elevation of
the 100 -year flood.

Structure: Awalled and roofed structure, including a gas or
"
liquid storage tank that is principally above the ground,
including but without limitation to buildings, factories,
sheds, cabins, and mobile homes.
(10)
Substantial improvement: "Substantial improvement" means
any repair, reconstruction or improvement of a structure,
the cost of which equals or exceeds fifty (50) percent of the
market value of the structure either:
a. Before the improvement is started; or
b. If the structure has been damaged and is being re-
stored before the damage occurred.
For the purposes of this definition "substantial improve-
ment" is considered to occur when the first alteration of
any wall,- ceiling, floor or other structural part of the
building commences, whether or not that alteration affects
the external dimensions of the structure. The term does

knot, however, include any alteration to comply with eidst-
ing state or local health, sanitary, building or safety codes
or regulations as well as structures, listed in national or
state registers of historic places.
(11) 100 -year flood: The condition of flooding having a one (1)
percent chance of annual occurrence.

Sec. 26-30. Records; notice of water course alteration.
(1) The department of development services will maintain a
record of elevation information required by section 26-22(bX6).
(2) The department of development services will notify, in
riverine situations, adjacent communities and the department of
water resources (DWR) prior to any alteration or relocation of a
watercourse, and will submit copies of such notification to the
Federal Insurance Administration.
(3) ^.'Che department of development services will assure that
the flood -carrying capacity within any altered or relocated por-
tion of any watercourse is maintained.

6728.5. Authority for rules and regulations
The board may adopt, amend or repeal, in accordance with the provisions of Chapter
4.5 (commencing with Section 11371), Part 1, Division 3, Title 2 of the Government Code,
such rules and regulations as are necessary to implement these sections.
6728.6. Immunity
Each member of a professional engineers review committee or other board -appointed
committee and any board -appointed representative of the board shall be granted the same
immunity as is granted to a public employee pursuant to Article 3 (commencing with Section
820) of Chapter 1 of Part 2 of Division 3.6 ofTitle 1 of the Government Code. [pp. 104 - 106]
Article 3. Application of Chapter
6730. Evidence of qualifications; registration
In order to safeguard life, health, property and public welfare, any person, either in a
public or private capacity, except as in this chapter specifically excepted, who practices, or offers
to practice, civil engineering, electrical engineering or mechanical engineering, in any of its
branches in this state, including any person employed by the State of California, or any city,
county, or city and county, who practices engineering, shall submit evidence that he is qualified
to practice, and shall be registered accordingly as a civil engineer, electrical engineer or mechanical
engineer by the board.
6730.2. Requirement for responsible charge
It is the intent of the Legislature that the registration requirements which are imposed
upon private sector professional engineers and engineering partnerships, firms, or corporation
shall be imposed upon the state and any city, county, or city and county which shall adhere to
those requirements. Therefore, for the purposes of Section 6730 and this chapter, at least one
registered engineer shall be designated the person in responsible charge of professional engineering
work for each branch of professional engineering practiced in any department or agency of the
state, city, county, or city and county.
Any department or agency of the state or any city, county, or city and county which
has an unregistered person in responsible charge of engineering work on the effective date of
this section shall be exempt from this requirement until such time as the person currently in
responsible charge is replaced.
6731. Civil engineering defined
Civil engineering embraces the following studies or activities in connection with fixed
works for irrigation, drainage, waterpower, water supply, flood control, inland waterways, harbors,
municipal improvements, railroads, highways, tunnels, airports and airways, purification of
water, sewerage, refuse disposal, foundations, grading, framed and homogeneous structures,
buildings, or bridges:
(a) The economics of, the use and design of, materials of construction and the
determination of their physical qualities.
(b) The supervision of the construction of engineering structures.
` (c) The investigation of the laws, phenomena and forces of nature.
(d) Appraisals or valuations.
(e) The preparation or submission of designs, plans and specifications and engineering
reports.
(f) Coordination of the work of professional, technical, or special consultants.
(g) Creation, preparation, or modification of electronic or computerized data in the .
performance of the activities described in subdivisions (a) through (f).
Civil engineering also includes city and regional planning insofar as any of the above
features are concerned therein.
Civil engineers registered prior to January 1, 1982, shall be authorized to practice all
land surveying as defined in Chapter 15 (commencing with Section 8700) of Division 3.
[NOTE: The last registration number issued to a civil engineer registered before January
1, 1982 was 33,965.1
6731.1. Civil engineering; additional authority
Civil engineering also includes the practice or offer to practice, either in a public or
private capacity, all of the following:
(a) Locates, relocates, establishes, reestablishes, or retraces the alignment or elevation
for any of the fixed works embraced within the practice of civil engineering, as described in
Section 6731.
(b) Determines the configuration or contour of the earth's surface or the position of
fixed objects thereon or related thereto, by means of measuring lines and angles, and applying
the principles of trigonometry or photogrammetry.
(c) Creates, prepares, or modifies electronic or computerized data in the performance
of the activities. described in subdivisions (a) and (b).
6731.2. Authority to offer to practice or procure land surveying
Any registered civil engineer may offer to practice, procure, and offer to procure, land
surveying work incidental to his or her civil engineering practice, even though he or she is not
authorized to perform that work, provided all the land surveying work is performed by, or
under the direction of, a licensed land surveyor or registered civil engineer authorized to practice
land surveying. Further, any registered civil engineer may manage or conduct as manager,
proprietor, or agent, a civil engineering practice which offers to practice, procure, and offers to
procure, such incidental land surveying work.
6731.3 Construction project management services
A registered civil engineer may also practice or offer to practice, either in a public or
private capacity, construction project management services, including, but not limited to,
aonotruetion projeet deai6n revic—ve and cv&luation, construction ,uuLilimLiun mid auNei viaiuu,
bid evaluation, project scheduling, cost -benefit analysis, claims review and negotiation, and
general management and administration of a construction project.
6731.4 Responsibility for construction management services
If a registered civil engineer provides construction management services pursuant to
Section 6731.3, Section 6703.1 shall not limit the responsibility of the engineer for the services
actually provided.
6732. Use of seal, stamp or title by unregistered person
It is unlawful for anyone other than a professional engineer registered under this chapter
to stamp or seal any plans, specifications, plats, reports, or other documents with the seal or
stamp of a professional engineer, or to in any manner, use the title "professional engineer,"
"licensed engineer," "registered engineer," or "consulting engineer," or any of the following
branch titles: "agricultural engineer," "chemical engineer," "civil engineer," "control system

1. The fill material is not contaminated and is placed in a manner that will not impede flood
flows nor will it readily erode.
2. The fill material will be placed only in that area outlined on your map.
3. The work will be done in conjunction with your building permit for electrical service to the
portable office.
4. Comply with Use Permit 99-13, condition 12.

As per UP:99-13, Item 12 and our subsequent conversation yesterday. We are seeking
approval to grade the Easterly and the SE front portion of the front property to create
adequate drainage of rainwater into existing ponds. We believe this is necessary so
that the playing fields won't become soggy and therefore unuseable.
We estimate that in the SE corner of the playing field we need to add approximately 4
inches of material to get the proper drainage slope. We don't feel this is an issue as
we have hauled out of this property in excess of 50 bottom dumps of -material that
consisted of concrete rubble that had been historically dumped on this property in the
past.
We transported this material and used it for the base of repairing our road on the
Northside of our holdings.
In addition we have moved some dirt around in order to cover up protruding rocky
areas that we felt could be dangerous either as a trip hazard or while playing the game
of paintball within those areas.
In addition we have removed two truck loads of waste material that had previously
flooded onto the property such as water heaters, couches, mattresses and general
debris.
In addition prior to receiving the use permit we leveled, graded and put road base on
the front Eastern portion of the property for proper parking.

This letter is in reference to UP 99-13, Paint Ball Park, and the charges that have been
assessed to this account. I feel that these charges are unreasonable and I am asking
you for a specific accounting of time, itemized and not just a lump sum bill as I have
already received; see enclosed bill.
This high price spurred me to look at the cost of my first permit on my RV Park issued
in 1996 which cost $1319.16. That permit included sanitation, and fire, which the current
use permit did not need to address. On the current permit there are no buildings, no
sanitation, no fire, no water and I am still charged $2198.50.
If you take into account that not only didr I turn in a completed application, but I turned
in a complete environmental report as well. In other words, most of the work was done
prior to planning receiving the application. We had done this in hopes that this would
speed up the process as well, but it took 106 days from the initial turn in of the
application to the time we came before the Planning Commission. I find the time factor
and price unreasonable as this was a basic simple use permit.
However, as nice as your people were to work with, they imposed numerous conditions
that were unnecessary and I was not advised of the available parking on county
property that should have been available to me. This created a limit to our occupancy
of 80 people, when planning should have known we could have used county property
to park on, given the circumstances that prevails on Pacific Heights Rd. And our .l.1
occupancy should be raised to comply with that parking area as well. As one example,
you made us deed 30 feet from the center line of the road to Butte County, which is
normal in itself, but your planners knew, or should have known, that Butte County
already owned that property. It cost us $150.00 for drawing up that document and I am
asking for a refund of that expense, as it was totally unnecessary.
In proceeding with the use permit conditions I have run into what I consider to be
intentional road blocks which consist of arrogance, lack of courtesy and the permit for
my electrical pole is being held ransom by a department head, Mike Viera. Mr. Viera
has interfered with my progress and when I personally asked him for inspection of my
electrical pole he refused to discuss it with me until I had met other conditions that
were not related to the electrical permit, even though condition #10 precluded me from
operating the Paint Ball Park, until all conditions were satisfied. In addition he refused
to answer questions and told me he didn't have to answer my questions and when I
asked him if this was part of the new "User friendly policy" he told me that he didn't like
the way I did business. This conversation was witnessed by John Starr, a premier
contractor here in Oroville, who was standing behind me at the counter.
When I left the building department I was so frustrated that it made me want to stop
investing in our community. But, after I had a chance to reexamine the actions I
realized that this didnit involve the employees of the County, the people that work hard
every day and follow Y:he rules. This involved Department Heads, who abuse their
power, lie, who use ransom as a tactic and are discourteous. These same Department
Managers retaliate to anyone who questions their authority.
Mr. Parilo your Buildirg Department Managers are out of control. Over 75% of your
planning staff have lost confidence in your leadership style. This is not acceptable to
the environment or economy of Butte County. I intend to ask our County Supervisors
for a change and I am: including copies of signed petitions urging a change, from 20
plus other leading companies and leading citizens of our community doing business
with the Butte County Planning Department.
Also included is a coy of a letter from the Butte Environmental Council, likewise
criticizing the current management style.

This letter is in reference to UP #99-13, Paintball Park, where you have personally
requested an engineered contour map for my project.
This is the same engineered contour map that I told you I would have Mr. Michael
Mooney complete for you. However, when I went to Mr Mooney and advised him that
the contour map that I had turned in and basically had copied from a USGS map was
rejected he informed me that he felt it was ridiculous as he was unaware that contour
maps had to be engineered.
I then advised him that the Use Permit did not specify an engineered contoured map,
but that it wasn't worth the hassle not to comply with what I said I would do. So, I
assure you that it is being done.
At the same time I would like you to assure me that every contour map that has been
turned in to your department and approved has been engineered. And then I would
like you to try and explain to me, if you would be so kind, the necessity of an
engineered contour map for installing a power pole.

Mr. Seidenglanz at counter. Scott Rutherford had advised Mr. Seidenglanz that certain items
identified in the Use Permit # 99-13 were required prior to issue of electrical permit. Mr.
Seidenglanz apparently did not want to comply with those requirements, but insisted that permits
be issued. Scott asked me to accompany him to the counter to confer with he and Mr.
Seidenglanz. I advised Mr. Seidenglanz of the same requirements identified by Scott.
Specifically, we were asking for Use Permit items #12, 14, 15, and 16. When I refused to issue
the electrical permit, Mr. Seidenglanz asked if I was acting independently on this issue. I
advised him that I was acting as the Building Official for the County of Butte. He continued to
ask if I was acting independently or if I had conferred with anyone regarding permit issuance. I
declined answer. He stated that he thought our lack of permit issuance was poor customer
service.
Note: Use Permit item 12 requires all necessary permits be obtained from the U.S. Army Corp.
of Engineers, the State Reclamation Board, the State Department of Fish & Game, and the Butte
County Land Development Division be obtained PRIOR to any grading work within the
floodplain.

Discussed issuance of electrical permits with Mr. Seidenglanz at counter. He produced a site
plan on which he had established contour elevations from a topo map. Explained to him that his
engineer was required to perform that function. He became irate, stated that we had no right to
establish such a requirement - told him that # 14 was a specific condition of his use permit,
which he signed, and that it must be completed. Also began to discuss # 12, which he stated had
absolutely no relationship to whether or not we began to perpetuate his use of a site on which
illegal grading and fill has been done, by issuance of an elec. permit. Told him we would not
issue without use permit items, and land development clearance. Became even more anct
requested the appearance of my supervisor, Michael Vieira.
MCV was polite, but refused to issue the elec. permit without use permit conditions fulfilled.
Left our counter, went to Land Development, where he was told again to fulfiliPrmit
conditions. In a discussion with Randy Wilson of Planning Division, I was told that Seidenglanz
was told repeatedly th.-I conditions needed to be completed or that they would become an
impediment.

have reviewed your letter of September 21, 1999, including all attachments and have
the following comments. First, I am not practicing civil engineering either publicly or
privately. Section 6730 states that a person who practices or offers to practice requires
registration as a civil engineer. "Practice" is defined as the continued exercise of a
profession. I simply prepared a map of my own property showing contour lines that
were determined by an agency recognized as having the.authority to do so, the United
States Geological Survey (USGS). A reasonable person would fail to see how my use
of USGS contours constitutes practicing the profession of civil engineering.
Does the Building Division not recognize the USGS as an accurate and reliable source
of contour mapping? This would seem to be a conflict with the Department of
Development Services present practice of accepting USGS contours for parcel maps,
subdivision maps and use permits pursuant to the Application Submittal Requirements
(attached). If your office has more stringent standards than the Planning Division,
either you are going beyond published standards or the Planning. Division is using
erroneous standards for application requirements. In either case, the Building Division
seems to intend to hold my project to a different standard. If need be, I will request that
the Department of Development Services research all other use permit approvals for
projects located in flood plains and determine if USGS contours were used in the
preparation of site plans. The research will show that the requirements you are making
of my project are suspect and well beyond the accepted standards of past applications.
Chapter 7 of the Business and Professions code clearly does not apply to this situation.
That code simply states that civil engineering can include the activity of determining the
con figuration or contour of the earth's surface or.the position of fixed objects
thereon ... It does not however, put these activities exclusively in the domain of the civil
engineer. It is unfortunate that your office continues to exact unreasonable demands
when reasonable accommodation exist and have been offered.

Section 26-22 of the Butte County Code states that additional requirements are needed
in flood hazard zone A, AE, AH, AO or "shaded" X in conjunction with development
permits for new construction, substantial improvements and other developments. First,
the placement of a single power pole can hardly be considered new construction or a
substantial improvement. Secondly, nowhere in the ordinance does it require the
application or maps to be prepared by a civil engineer. In fact, there is no reference.to
a civil engineer in the entire code section. Since I am not placing any building on the
site, the determination of a lowest floor elevation is immaterial. If I am mistaken, please
educate me as to the public interest, health or safety concern that is being met by this
requirement for a single power pole. If this is truly your concern then I can expect the
same scrutiny for every utility pole erected in a flood zone?
Finally, the Use Permit (UP 99-13) condition #14 simply states: "Prior to the issuance of
the building permit for electrical service, establish /00 year floodplain elevations and the
lowest floor elevations for any structures. Show on the building permit site plan map
the contour elevations, and the location of an accepted NVGD benchmark and
temporary benchmark on-site." I am not proposing to place any permanent structures
on the site negating the need to establish a 100 year flood plain elevation and
appropriate floor elevations. I have submitted USGS contour elevations and an
accepted NVGD benchmark. Considering this condition has been complied with,
withholding my building permit for the electrical service pole is without reasonable
justification and can only be seen by a reasonable person as an act of harassment.
Please inform me specifically, if the Department of Development Services, Planning
Division is in agreement with your interpretation of Condition #14 and if so, was it
clearly the intent of the Planning Commission in a public hearing to require this level of
scrutiny for the installation of a single power pole? Depending on the response, it may
be necessary to review with the Planning Commission in a public hearing with the
benefit of public testimony and public scrutiny, whether or not the intent of the
Commission to protect the public health and safety is met by the materials I have
submitted. I expect that the Commission will find I am in full compliance with the intent
of the conditions of project approval.
To look back at my past use permit approvals for the campground and RV park, itis
apparent this far less intensive project involving no permanent site improvements other
than a single power pole, is being held hostage by the over zealous abuse of authority.
This is not, and should not be an. acceptable course of action by a public official and it
remains to be seen if the Director of Development Services is going to continue to look
the other way and allow this abuse and totally inappropriate behavior to continue in our
County.

I am in receipt of your letter requesting information regarding the requirement of a contour site
plan prepared by a registered civil engineer and the reason for such requirement.
Condition 914 of Use Permit 99-13 clearly requires submittal of a site plan delineating contour
elevations, the location of an accepted NGVD Benchmark, and a temporary benchmark on-site.
Chapter 7 (Professional Engineers Act) of the California Business and Professions Code, Section
6731 defines "civil engineering" (copy of section attached). Section 6731.1 (b) of that definition
specifically states that civil engineering includes "determines the configuration or contour of the
earth's surface or the position of fixed objects thereon related thereto, by means of measuring
lines and angles, and applying the principles of trigonometry or photogrammetry."
The requirement to provide a plan is found within Butte County Code Chapter 26 Article IV
Flood Hazard Prevention (copy attached). The Department of Development Services is directed
to enforce all the provisions of this article. Sections 26-22, 26-23, and 26-24 directs the
department to require an application for all development and evaluate that plan and application for
conformance with improvements or projects within the flood hazard area. Those sections further
require that plans and specifications be provided, drawn to scale, showing dimensions and
elevations of the site. Plans shall identify all work to be done, show existing and/or proposed
structures, fill, storage of materials, and drainage facilities. NGVD elevation information is also
required. Section 26-23 requires the department to utilize applicable regulatory flood elevation
and floodway data from federal, state, and other sources when evaluating development projects.
Any encroachments including fill or grading are prohibited in a floodway unless a technical
evaluation demonstrates the encroachments will not result in any increase in flood levels during
the occurrence of a base flood level discharge. Section 26-30 of the same Article requires the

6731 defines "civil engineering" (copy of section attached). Section 6731.1 (b) of that definition
specifically states that civil engineering includes "determines the configuration or contour of the
earth's surface or the position of fixed objects thereon related thereto, by means of measuring
lines and angles, and applying the principles of trigonometry or photogrammetry."
The requirement to provide a plan is found within Butte County Code Chapter 26 Article IV
Flood Hazard Prevention (copy attached). The Department of Development Services is directed
to enforce all the provisions of this article. Sections 26-22, 26-23, and 26-24 directs the
department to require an application for all development and evaluate that plan and application for
conformance with improvements or projects within the flood hazard area. Those sections further
require that plans and specifications be provided, drawn to scale, showing dimensions and
elevations of the site. Plans shall identify all work to be done, show existing and/or proposed
structures, fill, storage of materials, and drainage facilities. NGVD elevation information is also
required. Section 26-23 requires the department to utilize applicable regulatory flood elevation
and floodway data from federal, state, and other sources when evaluating development projects.
Any encroachments including fill or grading are prohibited in a floodway unless a technical
evaluation demonstrates the encroachments will not result in any increase in flood levels during
the occurrence of a base flood level discharge. Section 26-30 of the same Article requires the
department to maintain elevation information on file. These files are subject to review by FEMA
and DWR staff during regular Community Assistance Visits performed by them to verify
conformance with FEMA reeulations and Butte County Code.
The information presented above and attached for your reference establishes the requirement for
contour plans. The preparation of those plans constitutes the practice of civil engineering by
definition. Submittal of any plans requiring contour or other information defined as civil
engineering must b !ar the stamp and original signature of the qualified design professional. The
department must review those plans for conformance with Flood Hazard Prevention standards
and maintain that ir%rmation for later review by FEMA and DWR to verify appropriate
enforcement of floc d hazard regulations. Appropriate and effective enforcement of flood hazard
regulations assures the citizens of Butte County will be able to obtain flood insurance to protect
their home and property and further provide that FEMA will assist financially to mitigate the costs
of flood damage and emergency disaster services.

A Use Permit is subject to a public hearing by the Planning Commission. All Parcels
within a 300' radius of the application boundaries, but not less than 10 parcels, will be,
notified of the. application by the Planning Division at least 10 calendar days prior to the
public hearig.
Conditions may be added, which in the opinion of the Planning Commission, are
deemed reasonable and necessary: to preserve the integrity and character of the zone;
to secure the general purposes of the Butte County General Plan and Chapter 24 of the
Butte County Code. Conditions of approval may include, but are not limited to: time
limitations, development plan approval, hours of operation, fencing, landscaping,
dedication of right-of-way, and street and drainage improvements. Conditions of
approval will be binding on the applicant.

After a meeting with a Butte County Planner the following checked items will be required

Dear Mr. Viera,
have reviewed your letter of September 21, 1999, including all attachments and have
the following comments. First, I am not practicing civil engineering either publicly or
privately. Section 6730 states that a person who practices or offers to practice requires
registration as a civil engineer. "Practice" is defined as the continued exercise of a
profession. I simply prepared a map of my own property showing contour lines that
were determined by an agency recognized as having the.authority to do so, the United
States Geological Survey (USGS). A reasonable person would fail to see how my use
of USGS contours constitutes practicing the profession of civil engineering.
Does the Building Division not recognize the USGS as an accurate and reliable source
of contour mapping? This would seem to be a conflict with the Department of .
Development Services present practice of accepting USGS contours for parcel maps,
subdivision maps and use permits pursuant to the Application Submittal Requirements
(attached). If your office has more stringent standards than the Planning Division,
either you are going beyond published standards or the Planning. Division is using
erroneous standards for application requirements. In either case, the Building Division
seems to intend to hold my project to a different standard. If need be, I will request that
the Department of Development Services research all other use permit approvals for
projects located in flood plains and determine if USGS contours were used in the
preparation of site plans. The research will show that the requirements you are making
of my project are suspect and well beyond the accepted standards of past applications.
Chapter 7 of the Business and Professions code clearly does not apply to this situation.
That code simply states that civil engineering can include the activity of determining the
con figuration or contour of the earth's surface or.the position of fixed objects
thereon ... It does not however, put these activities exclusively in the domain of the civil
engineer. It is unfortunate that your office continues to exact unreasonable demands
when reasonable accommodation exist and have been offered.
Section 26-22 of the Butte County Code states that additional requirements are needed
in flood hazard zone A, AE, AH, AO or "shaded" X in conjunction with development
permits for new construction, substantial improvements and other developments. First,
the placement of a single power pole can hardly be considered new construction or a
substantial improvement. Secondly, nowhere in the ordinance does it require the
application or maps to be prepared by a civil engineer. In fact, there is no reference to
a civil engineer in the entire code section. Since I am not placing any building on the
site, the determination of a lowest floor elevation is immaterial. If I am mistaken, please
educate me as to the public interest, health or safety concern that is being met by this
requirement for a single power pole. If this is truly your concern then I can expect the
same scrutiny for every utility pole erected in a flood zone?
Finally, the Use Permit (UP 99-13) condition #14 simply states: "Prior to the issuance of
the building permit for electrical service, establish 100 year floodplain elevations and the
lowest floor elevations for any structures. Show on the building permit site plan map
the contour elevations, and the location of an accepted NVGD benchmark and
temporary benchmark on-site." I am not proposing to place any permanent structures
on the site negating the need to establish a 100 year flood plain elevation and
appropriate floor elevations. I have submitted USGS contour elevations and an
accepted NVGD benchmark. Considering this condition has been complied with,
withholding my building permit for the electrical service pole is without reasonable
justification and can only be seen by a reasonable person as an act of harassment.
Please inform me specifically, if the Department of Development Services, Planning
Division is in agreement with your interpretation of Condition #14 and if so, was it
clearly the intent of the Planning Commission in a public hearing to require this level of
scrutiny for the installation of a single power pole? Depending on the response, it may
be necessary to review with the Planning Commission in a public hearing with the
benefit of public testimony and public scrutiny, whether or not the intent of the
Commission to protect the public health and safety is met by the materials I have
submitted. I expect that the Commission will find I am in full compliance with the intent
of the conditions of project approval.
To look back at my past use permit approvals for the campground and RV park, it is
apparent this far less intensive project involving no permanent site improvements other
than a single power pole, is being held hostage by the over zealous abuse of authority.
This is not, and should not be an acceptable course of action by a public official and it
remains to be seen if the Director of Development Services is going to continue to look
the other way and allow this abuse and totally inappropriate behavior to continue in our
County.

North arrow and scale of drawing. All maps shall be drawn to an
engineering scale of a size sufficient to reasonably show all required
features. A north arrow preferably oriented to the too of sheet.
O All maps must be clear and legible.
4. A preliminary title report showing current ownership and dated within 6
months of the application submittal shall be filed with the application.
5. Proposed method of domestic water and proposed method of sewage
disposal including soils/percolation/ground water data with enough detailed
information to allow the Division of Environmental Health to complete their
review of the project. Your application will be incomplete unless this
information is provided to or waived, in writing, by the Division of
Environmental Health.
6. A written request for any exceptions pursuant to Section 20-4 of the Butte
County Code.
7 Additional information as deemed necessary by the Department of
Development Services, Public Works, Environmental Health Division, Butte
County Fire Department, or Agriculture Commissioner.
B. PUBLIC HEARING REQUIREMENTS
Applications for Tentative Parcel/Subdivision Maps or Waiver are subject to a public
hearing by the Development Review Committee. All parcels within a 300' radius of the
application boundaries will be notified of the application prior to the public hearing.

USE PERMIT
APPLICATION SUBMITTAL REQUIREMENTS
Prior to submitting a Use Permit application, it is requested that the applicant discuss
the application requirements, County procedures, zoning provisions and possible
conditions of approval with the Development Services Staff. Please note that
acceptance of your application is not an indication of approval.
A- SPECIFIC INFORMATION
The following specific information and material shall accompany a Uniform Application _
at the time of submittal. Applications will not be considered complete nor will they be
acted upon until all submittal requirements have been met. All items, maps and exhibits
submitted in support of this application shall become the property of Butte County. .
The following items are required to be submitted at the time of application:
1. A completed, signed, Uniform Application and Environmental Information.
form. If the application is signed by an agent for the property owner, and
agent authorization form must be submitted along with the Uniform
Application. The application shall not be accepted unless signed by the
owner or authorized agent.
2. Payment . of the currently required Application Fee and/or Deposit (Any'
unused portion of the deposit will be returned upon final action, if any
remains).
3. Thirty-five (35) copies of plans which shall include a detailed site plan drawn
to scale. All plans shall be drawn on uniform size sheets no -greater than 24"
X 36". The finished plans shall be folded to 8 1/2" x 11". The detailed site
plan must include:
❑ Name and address of Applicant, Engineer and/or person who prepared
the plan
0 " Property lines and lot dimensions
0 Assessor Parcel Number(s) and the street address.
0 Proposed use and/or uses of the property.
❑ Proposed landscaping plan, if applicable.

0 Dimensioned locations of existing and proposed improvements on the
property (including, but not limited to, buildings, driveways, parking
areas, wells, septic tanks and leach fields).
❑ Distances from any significant natural and constructed features of the
property, such as streets, access roads, streams, rock outcroppings,
major tree stands, storm drains, bodies of water, railroads, to the
property lines.
❑ Location of all slope banks, ponds, creeks, buttes, sloughs, rock
outcroppings, natural drainage courses, irrigation canals and existing
vegetation worthy of consideration for preservation, such as oak trees. -
0 Any existing faults or fractures and geologic hazards.
0 North arrow and scale of drawing. All plans shall be drawn to an
engineering scale with the pn#erred scale of 1" = 20', with a north arrow
preferably oriented to the top of sheet.
0 All plans must be clear and legible.
4. One copy of 8 1/2" X 11" transparency reduction of the detailed site plan.
5.. A vianity map showing closest major cross streets,. zoning and existing land.

B. * PUBLIC HEARING REQUIREMENTS
A Use Permit is subject to a public hearing by the Planning Commission. All Parcels
within a 300' radius of the application boundaries, but not less than 10 parcels, will be
notified of the application by the Planning Division at least 10 calendar days prior to the
public hearing,.
Conditions may be added, which in the opinion of the Planning Commission, are
deemed reasonable and necessary: to preserve the integrity and character of the zone:
to secure the ganeral purposes of the Butte County General Plan and Chapter 24 of the
Butte County ^"'ode. Conditions of approval may include, but are not limited to: time
limitations, development plan approval, hours of operation, fencing, landscaping,
dedication of right-of-way, and street and drainage improvements. Conditions of
approval will be binding on the applicant.

Submittal Requirements -.Use Permit
After a meeting with a Butte County Planner the following checked items will be required
to be submitted at the time of application:
1. One (1) set of colored plans mounted on foam boards, which shall
include an illustrative site plan, illustrative building elevations,. and any
necessary cross-sections. Portions of this requirement may be waived
by the Planning Manager.
2. One (1) full size reproducible sepia for each sheet in the plan set of the
detailed site plan.
3. Building materials on a sample board, 81/2" X 11".
4. Detailed site plan including the following:
Building setbacks from the ultimate road right-of-way (front, rear,
sides).
Proposed and existing on-site driveways and/or roads.
Location, height, and materials of walls and fences (sections may
be required).
All driveways, drawn to scale, on adiacent and across the street
properties within 100 feet of the subject site.
Existing curbs
site or within
widths on -
Typical street section(s).
Nearest cross streets on both sides with plus or. minus distances
from subject site.
Approximate location of all buildings within 100 feet, on adiacent
prooertles.
Proposed method of sewer and water connection or alternative
method of sewage disposal and potable water supply.
Existing and nearest fire hydrants.
Access, both pedestrian and vehicular, showing service areas and
points of ingress and egress.
Off-street parking and loading areas showing location, number and
typical dimensions of spaces, and wheel stops placement.
Internal circulation pattern.
Elevation contours, at a minimum per USGS maps.

improvements, landscape concepts such as earth mounding and meandering walkways,
walls, groundcover, trees, shrubs, shadows, paving and other elements as may be
necessary to illustrate the site plan. (Dimensions may be excluded from this plan).
