The Commission waived the reading of the Staff Findings. A video of the area was shown. The hearing was opened to the public. George Kuntze said he had no problems with the conditions. He said the request was for his wife's parents who are in their 80s. Commissioner Lynch asked Mr. Kuntze if he was aware of the condition for a bond and Mr. Kuntze said yes.. The hearing was closed. It was moved by Commissioner Ostrowski, seconded by Commission Lynch, and unanimously carried for approval as follows: A. Note that this project is categorically exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and C. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP 036-050-053 (George and Mary Kuntze) subject to the following conditions 1. Occup:,ncy of the mobile home is limited to Lloyd and Mabet Barnes. 2. No rent is t-) be charged to the occupant of the mobile home. 3. Oroville-Wyandotte Irrigation District: "In situations where more than one single family dwelling, units are located on a single parcel of land served by one water service, the chances of cross connection. are increased. Therefore, as a condition of approval for this Use Permit, this District would ask, that the applicant be required to install a backflow device in accordance with the specifications and requirements of O.W.I.D." ANALYSIS- This NALY IS.This is a request for a Use Permit to allow a mobile home as a temporary second dwelling. The project is located on the south side of Crane Avenue, approximately 1100 feet west of Oakvale Avenue. The applicants George and Mary Kuntze are proposing to locate a 840 square foot single -wide mobile home approximately 100 feet away from Crane Avenue, .,adjacent to an existing driveway. The mobile will be occupied by Mary Kuntze's parents. There is adequate room on the parcel. Water will be supplied by OWID and sanitary sewer by LOAPUD. Butte County Code Section 24-304 provides for remc ,al of the mobile home 'o days of the time that it is no longer being occupied pursuant to the code section. Tl also snakes provision for the County requiring a bond or deposit at the time of applicatio, ..ifficient size to cover the removal expense of the mobile home. This is to ensure that the taxpayers at Large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed .from the band or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks; awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem: reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers: This project is Categorically Exempt and appears to conform to the requirements of Butte County Code Section 24-304 regarding the placement of temporary mobile homes.
