This department considers the requested approval action to be "adjudicatory' as opposed to "legislative". it is the position of the Department that due to the limitations imposed by the SFL, no mitigation measures in excess of those ' rropAded by the SFL may be imposed as conditions upon the granting of the actin .i under condition, Murttieta Valley Unified School District V. Butte County ]Fire Department/California Department of Forestry: "30' setback from property lineto, new dwelling for "defensible space". Meet Fire Safe Regulations of PRC 4290. Oroville Elementary 'School District: See attached letter. ANALYSTS: This project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 857 Mt. Ida Road, Oroville area. The proposed mobile will be located near the north property line approximately 150' off Mt. Ida Road on a 5.01 acre parcel. The proposed location will not cause any hardship on the adjacent properties or result in any land use conflicts. The adjacent parcels are either vacant or are used for residential purposes. The temporary mobile will be used to house the daughter of the applicants and her family, Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also. makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a_rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. these amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. the applicant proposes to place a double -wide mobile home on Ahe property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B. Find that this proposed use of the property will not impair the ;integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health 2 BUTTE COUIe Ty pI ANNINO COMMISSION S'TAi,? iOINDINGS - August 19, 1992 and general welfare of the persons residing or working in the neighborhood or to the general health, welfare, and safety of the County because and C. No rent is to be charged to the occupant of the mobile home. 3. Meet the ,requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. 4. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission may grant an extension of the Use Permit not exceeding one year. 6. rm the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased then in that event, the Use Permit granted herein shall automatically expire and the mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7.
