and frame construction, 24 x 26. There are six live oak troes on the propertye
one fruitless mulberry tree, 6 fruit trues. Tho house will be equiped WLth
furniture for young children, the living room to be the main classroom, Large
back bedroom may eventually be made into 'A classroome Small bedroom to be used
as sleeping quarters. Therm will be chain link fencing for two playgrounds, one
in the back and 'one in the front. Tho fruit trees will be moved this January
to the outside of the withranYgc1rcularQdrive.Tnthe Grounducoverrdinplan

the front playground. There will be grass, tan bark and sand added on the

The house sits about 250 ft. from Oakvale.

a building that appears to be a garage or storage building. They also have live
oaks and shrubbery. Zoned lt.A.}louse is approx.200 ft. from Oakvale. y
The house to the North of us is a single family dwelling. It has many' trees, shrubs,
garden and grass, it too is located on approx. 6 acre's of land with a use permit
for a seminary which is in the process of being built. Zoned R.A. douse is locate
close to_Oakvale.
The property to the West of us is a large acreage horse ranch. Zoned A.Ab Trees
are near the house which sits about 500 ft. from Oakvale, pasture for horses is
in the front of the house.
The property to the East of us re cannot see because of our trees. Think access
to this property must come From Mt. Ida W.

XXX. DISCUSSION OF ENVIRONMENTAL EVALUATION
The proponent of this project has applied for a use permit to
allow a preschool. for 12 children on the applicant's residential
property. The preschool would be composed of an existing house,
1,152 square :feet in size; a garage (existing) 624 square feet
in size; and a playiround area enclosed by a fence. Playground
equipment would be installed in the outside fenced area.
The preschool would primarily provide before and after care for
children attending Ophir Elementary School.
A residence and garage currently occupy the project site, which
is 3/4 of acre in size. The site is located in rolling foothill
terrain, approximately ;four miles southeast of Oroville. Access
to the site is provided by Oakvale Avenue. The subject parcel
fronts the east side of oakvale Avenue, approximately 1,200 feet
north of Mt-. Ida Road. The site is designated Low Density
Residential,, in the County General Plan, and zoned A -R.
Surrounding land uses consist of orchards, residences at rural
densities and open foothill woodland property. Neighboring parcels
are primarily designated Low Density Residential in the General,
Plan, and zoned A -R and AR -5 Sixes range from one to 15 acres

Environmental concerns associated with this project are reviewed
in in checklist items in the :following section.

hazard is rated Moderate to High in the Safety Clement of the
General Plan. Since a minimum amount of new overcovering is
proposed for the project site, and slopes are generally less than
15 percent, potential soil, erosion is not considered a serious
hazard for most of the project site. However, due to the com-
position of the soil, steep gradient of the access driveway, and
provable heavy use of `this access, the potential for erosion on
or adjacent to the driveway as a result of storm runoff may be a
significant.

boundary of the project site presents a palpable hazard to the
safety of smaller children on the premises. The ditch has a
perennial flow of water in it. Depths vary from one to three
feet with a moderately swift current in several locations.

ANALYSIS: The applicant of this project has requested a Use Permit to overate
a preschool located on property fronting the east side of oakval.e Av,.=a, four
miles southeast of Oroville. The preschool would be composed of an existing
house, 11152 square feet in aize; a garage (existing) 624 square feet in size; raid
a �-!ayground area enclosed by a fence. Playground equipment would be installed
within the outside fenced area.
Primary access to the rubjeet property would be provided by Oakvale Avenue, which
currently supports light traffic volumes from surrounding rural residential
development. Average daily traffic (ADT) figures on Oakvale were recorded in
1981. These traffic counts are presented below: Oakvale, north. of Hilldale
1,020; Oakvale, south of Hilldale 1,230; Oakvale, north of Mt. Ida 880; and
Oakvale, south of At. Ida '860. The average hourly traffic (AHT) on Oakvale
wbald range from 66, south of Mt. Ida to 95, south of Hilldale. The higher
ART near Olive Hwy. (south & north of Hilldale) reflects the presence of an
elementary school. (Ophir) in. Oakvale just south. of Hilldale Avenue. The approval
of three subdivisions in the vicinity of 0plir Elementary School ',iay add a minimum
of 500 traps per day to that section of Oakvale near the elementary school.
Cumulative increases in average daily traffic as a result of project implementation
would not be substantial. Moreover, this traffic would be concentrated on the
section of Oakvale with a lower. ADT.. However, a need for off-street parking
would. develop when vehicles arrived to unload or pickup children. The shoulder
'
of Oakvale is not sufficiently wide in front of the school to allow for several:
vehicles to safely perform the foregoing; tasks.
Although a preschool is not a residential or equivalent use, the small scale
of activities proposed in the project, and very low densities in the vicinity
of the subject parcel, would mitigate any serious land use conflicts (eg., x
noise, litter, excessive vehicular traffic) with surrounding properties. f ,'

The proximit- of the O.W.I.D. ditch along the eastern boundary of the project i
site represents a tangible hazard to the safety of smaller children on the premises.
The ditch, usually sustains,a steady flow of water. Depths vary from one to three'
.eet, with a moderately swift current in several locations. The applicant proposed
to erect a fence around the outside play area, and maintain constant supervision
over the children.
Application of gravel and other dust palliatives to the access driveway would =
reduce soil erosion from storm runoffin the rainy season, and abate the generation
of dust during the dry months. j
An environmental document has been prepared in accordance with theCaliforniaj
Environmental Quality Act for this project and a Conditional Negative Declaration j

} The hearing was opened.
Proponents: Mr. Trask said that he and his wife had a combination of
40 years of working with children; that they were retired and getting
restless and wanted to again work with children. I -Ie asked that they
be permitted to sign some kind of a covenant to permit them to construct
curb, gutter, sidewalk, etc. at a later date --stated that Mr. Sims of
the State Tire Marshall's Office had given them an 0. K. and that fence
posts for a 4 ft. fence were already in awaiting approval of the use
permit for installavion of the chain link; and that children would
always be under supervision when out in the play area.
Ms. Blair noted that the Commission has no power to enter into a covenant
and .�aminded the Commission that conditions imposed should be reasonably
related to the use proposed, but cautioned that the Division of Forestry
could possibly, have 7:oncerns other than those of the State Fire Marshall.
Commissioner Wheeler voiced concern that the 4 ft,, fence might not be
adequate noting the existence of the nearby irvigation ditch. Vice;
Chairman Lambert agreed.
Marily Trask commented that there would never be a child on the playground
without a. teacher, and in response to Commissioner Schrader's concern
regarding traffic safety she added that it was .k State Law that all
children attending pre-school be brought inside the building --that they
could not be let off at the street.
The hearing was closed. Commissioner Schrader made a: motion, seconded
by Commiss^iur_er Wheeler to
