MfcCabe, Deputy County Counsel SUBJECT PRATT USE PERMIT DATE; February 23, 1973 We have reviewed your memo of February 21, 1973 and attachments regarding ter. Pratt's use permit and have also discussed the matter with Bill Cheff of the Public Works Department. Our conclusion, for the reasons discussed below, is ttbat Mr. Pratt `s use permit is valid. One of the conditions of Pratt's use permit was that he comply with requirements of the Department of Public forks-. Sometime during the orae -year period after issuance of the permit, Mr. Pratt discussed his nlans with Public Works and was advised of the following con,;itions which he would be required to comply with: Installation of curbs., gutters, drainage and sidewalks and dedication of right-of-way. Later, still within the orae -year period, he was requested to delay his curb, gutter and sidewalk installation ' to coincide wich a County reed construction project adjacent to his property,; and Inc did so, delaying this hark perhaps as much as one Year and not compiering it until sometime after the initial arae -year period after issuance of his permit. In august, 1972 he complied with the dedication requirement- t In view of the fact. that tar. Pratt was delayed at y the Count's request and that he has made substantial expenditures to comply with the conditions imposed upon him, we do not believe the County could vow argue that the permit is no longer valid. While it could perhaps be argued that fir. Pratt could have commenced construction of his drive-in before complying with the curb, butter and sidewalk conditions and that: the delay was therefore irrelevant, we do not find this argument persuasive in view of the general practice of the Public Works department to advise permitees that they Faust comply with use permit conditions before a building permit will be issued. (Mr. Pratt states that it was his under stand;Lng that he couldnot continue with his project until he had met the use permit conditions.), Accordingly, we have concluded that Mr. Pratf.'s use permit is still. valid.
