Oroville, CA 95955 March 22, 1980 Several weeks or more past I appeared before the Hoard of Super- visors on behalfof the members of our Church and a proposed building project, the location of which is to be on parts of two parcels of land in the Four Hundred block of Oakvale Avenue. The request was de- nied, under protest of several. women. I don't know where they were from, but we have canvassed the neighborhood within several blocks with a petition to learn if there are any who protest our plan; and we received 21 signatures ,20 of which are tion --opposed. Some desired to see a church built here., One of the 21 opposed because of our non- profit printing facility. All modern churches have something similar; However, we probably couldn't expect a grant by -the Supervisors anyways, because we were on the Agenda that was not heard till after the recess. During the recess and where most concerned were gathered these environmentalists (among whom were two of our members) had us played down before my 'hearing! I don't think our board members were recognized, but they were there. (Some jesting took place also). When my time fina)I.Y came, all protested except the only man that was there. Before this event the propoganda went out to people, that we may be a cult after the "Moony" or "Jones" cults., This did not only serve to stop our project (or delay it), but it has inflicted damage to my personal reputation. This was a great injustice to us. The notice in the Mercury 1„egister carried fay to the h/mt news letter, and as well to a Con., Litutional lawyer of a I.. -.,,w farm in the city of Sacramento. Some service was offered free of charge. But I said I didn't want further publicity, at least in that manner. As I have made it known before to the County of Butte, This land Was purchased exclusively for religious purpose, engineered by Ringle and Ringle at a cost then of $785.00 or more. It included all of the requirements of the County of Butter -at the time, and I was then told to get my Permit soon because the price was going up. But we had to wait for Church finances that were tied up at the time, accounting for the dolay. We purchased the Land in 1973, and since then all mat- ters have been filed with the County including Fees. When -then I came in for a Use Permit, 1. was told to bring my Plans in to the Planning Department; but this was followed up with request for E.I.R. We are presently having Baird McBride of Chico, civil. Engineers, doing an In the mean while, several months past, I put an Ad in the Mercury Church section to inform friends of our group's meetings, which we had held temporarily while undergoing preparations for building, etc. An inspector of the County called me, and told me, "You jumped the gun". Said my ad in the news paper showed that I was starting a church in my home. This I deny. Nevertheless I took the ad out of the paper and •-k13 2. Board of Super ors El wrote an apology for that. But as live said, it was a temporary thing pending the construction of a building, I pirposly purchased a home here on the strength of our Church quarters being located on the :land next door to us, which was once OK'd. We did not think we could, run into such an unfriendly system of government as we have of late experienced. And this attitude to- ward someone who has preached:gospelfor almost fourty years. Does not "the County want such people as us? We are already heavily invest- ed here, and have hopes of staying. But it has become a question whe- ther even religious rights mean anything under such controls as are being enforced -today. I was born into a family of a Baptist minister; my children and nay grandchildren are Baptist, but one I have a grandson just out of Bob Jones University in So. Carolina. I'm a writer of books, and have one faculty member of a Baptist CoJ7 ege who has written the introduc- tion in one of my books. He accl•me greater depth. One more thing, if I may ind aur patience. I telephoned to the Butte County Planning Departme. ,d asked, Can I go ahead to level out a roadway for gravelling �M:st to East off Oakvale), and also level, or prepare a pad for bu0 ling construction, while waiting the Use Permit? The man who answered said, "There is no law, State or County, against working on your ground." Then he added, "As long as you do it by the County Code". I don't see where any County -Code applies to what we want to do. Some Parking Area would be involved. I assume we can go ahead without waiting on our draft E.I.R. Seismicity Prior to August 1, 1975, the Oroville area was generally Considered to be an area of low seismic activity. however, an earthquake measuring On that date, 6.2 on the Aichter scale shook the OrOville area, causing considerable damage to some of the old buildings in the area, Principally those of brick, block Or concrete construction. All improvoments will be subject to the approval of Butte County Department of Public Works. Such improvements could include a stop siren at the propQsed driveway onto Oakvale Avenue widening for right -turn acceleration, re --striping, and possibly a left -turn lane onto the driveway. 8. Land Use and Aesthetics Impact: Land use differing from surrounding parcels may generate concern about aestbo-Ac value. Excessive light and glare from this Project site will be avoided as discussed eaj. li Public sentiment, as discussed previously, is favorable. 20 of 21 residents in the immediate vicinity indicated "no Opposition", and several responded with more favorable reaction welcoming a project that will retain large porta .ons Of Open land. The proposal includes a printing operation use, which may be considered a basiness activity. Oommexoial or business uses may not be appropriate in, this rural residentiarl and aTpiculm- tural area. However, this printing operation will not include re. -ail co mercial aotivities and will not'involve daily commercial traffic, but will involve publication of religious literature utilizing a proposed r printing room within the chap el/classroom building. This P in4-"ing activity will not be the central activity of tne proposed church facility and may not be accurately considered a "business". Enlargement or expansion of any approved church facility will req and a new use permit, involving additional environ- mental analysis and future public hearings. However, the extent of possible visitor use is a variable that is not controlled by the use permit other than provision of adequate -facilities (again, requiring expansion and a new use permit if substantial visitor growth is allowed). 10. Water Quality and Availability Impact: Water quality in Wyman Ravine may be adversely affected. Mitigation: Proper scheduling of construction will significantly reduce short-term increases in building - related contaminants. On-site runoff disposal will eliminate Jong --team focreases in surface contaminants carried from the site. Impact: Greater demand will be placed on the Oroville-Wyandotte Irrigation District water supply system. Mitigation: No mitigation is proposed since O.W.IiD. facilities are adequate for expansion of service, and no shortages or moratoriums on book -ups are forseen. 3.1, Noise Impact: .Noise levels will increase as construction commences, then decrease to levels consistent with or lower than adjoining parcels. Mitigation: Construction should be limited to accepted "working hours,". Following construction, no significant noise impacts are anticipated. 12. Energy Use Impact: The project will increase energy demaiids on Pacific Gas and Electric Company. Potential shortages in the future require responsible, timely action toward energy efficiency. Buyers of the property would probably do so with the intent to subdivide it. 2i Reduction of Planned Facilities. Unfortunately the, facilities planned represent the minimum necessities of the developer. Additional facilities wero, planned earlier in the project's history and have since been trimmed for various reasons. Further reduction of facilities would probably render the land useless to the present owners, requiring the subsequent sale of the land. 34 Subdivision.of the Land. Therefore, the current projection of waste generation is 15 cubic feet per week (3 cans @ 30 gallons each). The original figure of 400 cubic feet per week was excessive even for a large church facility. (For comparison, the proposed Valley View Subdivision for nearby properly was calculated to generate 600 cubic feet per week total. for 80 residences.) 3. Tax exemptions for the proposed facility are possible since the use will be a non=profit church. 4 Traffic estimates are difficult considering the uncertain fre- quency of visitor use. At this hearing the Commissioners decided that the order for two fire hydrants be referred back to the Fire Department', that is, for reconsideration, in view of our present smaller or minimum church_need.
