A.l`]ALYSIS:
'The applicant is requesting approval of a 'Use Permit to allow a permanent second dwelling
unit to be located at 2554 Oak Knoll Way. The 2 acre site presently contains a mobile home.
CA. 14 ft, x 66 ft. mobile home is proposed as the second unit. Parcel sizes in the area, range
from 1/2 acre to 5 acres in size.
The property is zoned A -R. This designation allows duplex dwellings subject to approval of
a Use Permit. A. Board of Supervisors' interpretation, 83-445 (Section 24-33 of the Butte
County Code), states that a duplex is considered to be two dwellings, regardless of whether
they are structurally tied: Both the General Plan Land Use designation, Low Density
Residential, avid the A -R zone state that one single-family dwelling is allowed per parcel.
Flowever, the General Paan does allow other residential uses limited to a maximum density
of 6 dwelling units per acre. This proposal would result in a density of I dwelling- unit per
acre.
Section 24-47 requires that findings be made that the proposed use will not impair the integrity
and character of the zone in which the property is located. In addition, the use should be
compatible with surrounding properties. Since this proposal is for a residential use, the health
and welfare issues that need to be considered are, not applicable.
There are two parcels in the immediate vicinity of this site that contain two dwelling units
each. In addition there are mangy 1 acre lots in the vicinity of, the subject property. Also, as
stated in the Site History section of this report, a Use Permit for a second dwelling was
approved on the property in 1984. Circumstance or:the neighborhood character .has not
dramatically changed since 1984. Therefore, the request can be considered consistent. with the
character, and densities of the neighborhood and zone.
According to the California Environmental Quality Act, this proposal is a Class 3(a)
Categorical Exemption (the construction of less than 2 residential units over it 2 year period),

building permits.

WHEREAS, the undersigned are presently owners of that land commonly
known as AP No: , which is located in the unincorporated areas of Butte
County, California, near , the legal description of which is set -forth
in Exhibit "A" attached hereto and incorporated herein by this reference; and,
WHEREAS, said owners propose to develop their said land, and, In connection
with their development proposal, have submitted an application to the County of
Butte for the following discretionary land use entitlement: subdivision map_
parcel map use permit other (specify)

WHEREAS, said owners recognize that the cumulative impact of development
within the jurisdiction of the Oroville Elementary School District ("District"), Including
their proposed development, has created and is creating the need to augment V
educational services provided by the District and has Increased and is increi
need for the District to acquire facilities and equipment to provide such servic:

WHEREAS, said owners are aware that the District, neighboring school
districts, and the County of Butte, are studying Methods to provide funding to
acquire such facilities and to fund environmental and other studies as may be
deemed necessary to determine the needs for such facilities, and said owners
recognize that the subsequent imposition of any additional educational impact fees
by the District will benefit their property by providing a better educational systerrr;
and,
WHEREAS, said owners wish to mitigate the impact of their proposed
development by increasing the District's ability to provide adequate educational
servics and by recognizing that the District does not at present have an adequate
fundinig mechanism in place or other adequata resources necessary to provide for
the necessary additional educational facilities and equipment;
NOW, THEREFORE, the undersigned owners do hereby agree and consent a' s

County Board of Supervisors and the District Board of Education to supply the

funding mechanism for additional educational facilities and equipment, and agree to
paytheir pro rata share thereof.
2. The undersigned owners agree to cooperate with the District in its efforts in
creating the additional fees or other funding mechanisms as described above by
supporting the District before the County Of Butte, and with the other property
owners within the jurisdiction of the District.
3. The undersigned owners agree, prior to the issuance of any buiiding permit.

such additional educational impact fees or any other fees that may be IMposedaby an
ordinance adopted by the Board of Supervisors of the County of Butte and action of
the District Board of Education. it is understood that such fees shall be paid directly

The Feather River Recreation and Park District would like to express our concern over the
owing population of the Greater Oroville area .and the affect this will have on our District, We
