Dear Eric: We are in receipt of your letter of August 14 2006 regarding the above referenced billboard project. As you note, this property in located in the Enterprise Zone. We have reviewed your request that the County, "continue the processing of the above stated application." After review of the Butte County Code sections detailed below (copy here attached), we have concluded that it would be contrary to the October 1, 1991 Memorandum of Understanding between the City of Oroville and Butte County and contrary to the Butte County Chapter 3 Codes listed below for the County to entertain processing and/or issuance of a building permit for this project. WJ Butte County Chapter 3 Code: Section 2-134 Purposes. The purposes of this article are to implement the provisions of that certain memorandum of understanding regarding enterprise zone projects entered into by and between the County of Butte and the City of Oroville and dated October 1, 1991, as said memorandum of understanding may be amended from time to time, and specifically to coordinate and facilitate new industrial and commercial developments in the unincorporated area of the Oroville Enterprise Zone. (Ord. No. 3016, § 1, 6-23-92) Section 2-135 Processing of project applications. (a) Planning commission functions. Notwithstanding any other provisions in this Code to the contrary, the City of Oroville Planning Commission is appointed to act in lieu of the County Planning Commission and to perform all of the duties thereof as'to all industrial and commercial projects within the unincorporated area of the Oroville Enterprise Zone as it is not established by the State of California and as the boundaries thereof may hereafter be lawfully amended. For purposes of this section, "projects" shall include development permits, use permits, and variances. Appeals from actions of the Oroville Planning Commission pursuant to this section shall be made to the board of supervisors in the same manner and subject to the same county fees as appeals from actions of the Butte County Planning Commission. (b) Project application procedures and standards. Such project applications shall be filed with the City of Oroville, subject to the fees and adopted procedures and standards of the city as they now exist or may exist at the time of such application. Such projects will be subject to city design review requirements and improvement standards. However, the zoning regulations applicable to all such projects will be those specified in the applicable county zoning ordinance, and county sewage disposal requirements shall apply, except as to those projects which connect to a publicly -owned, maintained and operated sewage system, in which case the requirements of the public entity which owns, maintains and operates the sewer system shall apply. (c) Projects to which this section is not applicable. The Butte County Planning Commission shall retain its present authority as to all other projects within said area, including all residential projects and all general plan, zoning and specific plan amendments and enactments. Applications for such projects will continue to be processed in accordance with the procedures and standards of the County of Butte. (Ord. No. 3016, § 1, 6-23-92). Dear Mr. Monago: Please be advised that Oroville City staff has reviewed the application for development and use of the site that generally conforms to the site plan, which was received by the.Planning Division on April 6, 2004. This site plan indicates that the office will be located on the southern boundary of the property, close to Lincoln Boulevard. The above -noted application has been approved, subject to the conditions of approval described below. A. On-site storm drainage shall be collected and detained on-site and then transported via underground conduit to an approved detention/retention drainage facility or other approved drainage facility. d) Show existing and proposed easements. e) Grading shall not begin until grading plans have been approved by Public Works. f) Utilities. All utilities shall be installed underground. There shall be no buildings constructed, or the storage of any materials, under or over any PG&E facilities or inside any PG&E easements. Any relocation of existing utility equipment shall be at developer's expense. g) Parking areas. i. The type of tree shall be approved by the Director of Parks and Trees. b) Any of the right-of-way along Lincoln Boulevard that is not occupied by frontage improvements shall be landscaped with a variety of shrubs in a manner approved by the Director of Parks and Trees. c) Fifty percent (50%) of parking areas that provide six or more parking spaces (for combined area) shall be shaded in accordance with City Code. Plans shall include shade calculations for parking. 4) Sanitary sewer permits must be obtained through Butte County Environmental Health. B. During the construction process: 1) Fugitive dust emissions. A person shall take every reasonable precaution not to cause or allow the emissions. of fugitive dust from being' airborne beyond the property line from which the emission originates; from any construction, handling, or storage activity; or any wrecking, excavation, grading, clearing of land, or solid waste disposal operation. Reasonable precautions shall include, but are not limited to: Use, where possible, of water or chemicals for control of dust in the demolition of existing buildings or structures, construction operations, construction of roadways, or the clearing of land. ii. Although this design worked ■ in the majority of situations, it was never a true representation of the actual ■ dimensional requirements for ramp landings at doorways. It is not ■ required to provide a "door width plus 42" boxed landing at the top of a ■ ramp. California has amended this diagram in. their current guidelines to ■ reflect the actual requirement. ■ ■ You will note on the diagrams immediately following this paragraph that ■ the placement of a pedestrian ramp that is both adjacent and parallel to a ■ building frontage requires a good deal of consideration. Since doors ■ cannot reduce the required width of a ramp (this includes the landing) by ■ more than 3" when fully open, a door that encroaches by more than 3" into ■ the required landing width will require the provision of a full landing prior ■ to the door. The length of this landing would be dependent on whether it ■ was at the top or bottom of the ramp slope; 60" minimum at the top of a ■ ramp and 72" minimum at the bottom of a ramp. As previous guidelines required ■ mounting height to be 30 to 34.", many handrails constructed prior to 1994 ■ are deficient in height. ■ Stairways that are re uired to be more than 88" in width require the ■ installation of an intermediate handrail for. each 88" of required width. ■ Building agencies frequently and incorrectly require property owners to . ■ ' -install additional handrails every 88" at any stairway or stepped section on ■ a property. While most interior stairways are built to required widths, ■ many exterior stairways and step sections span significant distances for ■ architectural enhancement purposes. The required minimum width of ■ these sections must be determined to establish whether or not additional ' ■ intermediate handrails are in fact necessary. ■ One of the most constantly argued issues on stairways is in regards to the ■ maximum allowable diameter of the handrails.
