Current regulations limit the County Staff's discretion to deny these applications if they meet the conditions of;our ordinance. The ordinance was drafted many years ago when state law essentially directed that these types of senior citizen second units could not be denied. Recent court cases have however, clarified the process and regulationswhi14 cities and counties can require. Due to these recent court cases, we proposed amendments to the ordinance. The amendments were reviewed by the Planning' Commission and adopted by the Board of Supervisors. The revised ordinance took effect on December 8, 1994.
